The plight of the Human Rights Community

There is mass speculation regarding the number of civilians trapped inside LTTE areas. Human Rights groups who make a living out of such situations have claimed that 250-000 (MSF) to 300,000 (AI Report) civilians are trapped in these areas. How these organizations arrived at these figures is a mystery, or is it?

A careful observation of these agencies' information extraction process reveals that there is much to be desired in terms of their methodology for getting at the 'truth'. This is because the exact number of civilians trapped in those areas is not known even by the military. There has not been a census conducted in those areas in two decades. The Army's best guesstimates puts the number around 100,000 civilians at the most.

So how do these organizations gather their information?

When it comes to the collection of information from 'the other side', there has been a practice by these organizations, even diplomatic missions, of hiring or networking either directly or indirectly with Tamil nationals residing both in Colombo and in the Districts. This is based on the idea that they have better access and therefore better information about the Tamils in the said area.

The issue of natural bias is often overlooked as a result of high expectation for professionalism from the said officers. These networks are maintained by a 'local operation' meaning a small office/s maintained in Sri Lanka by a group of expatriates and their local employees. The major sources of these organizations are as follows:

  • Political affairs officers of embassies/High Commissions who rely on Tamil journalists from mainly the print media (Thinakkural etc)
  • Tamil nationals attached to NGOs/INGOs/UN agencies both at the head quarters and district level (ICRC, SLRC, Local 'Civil Society' and Human Rights Groups)
  • Tamil nationals attached to various Ministries (Ministry of Rehabilitation etc)
  • Expatriate staff of NGOs/INGOs/UN who meet randomly at Colombo's favourite watering holes (These expatriate officers disseminate information gathered through local staff)
  • Local officers/district staff obtain information through their own networks of Tamil journalists/Grama Niladhari etc. Some may have an opportunity to interview returning civilians.
  • Sinhala journalists who get tidbits from friends in the Military
There is however a serious problem with this methodology, particularly in the current context.

1. The area of contention has shrunk. One can cover the area under LTTE control with one's thumb on a map of Sri Lanka.
2. No rebel 'administration' exist, hence there cannot be accurate estimates even if they tried
3. Civilian and civil administration, interaction and communication systems within the area and connection to the outside world has ceased and replaced primarily by an LTTE Military communication system, which is naturally biased.
4. Returning civilians may have an 'idea' of the numbers displaced but it is by far inaccurate and limited to their immediate experience/individual networks/capacity.
5. Quality and capacity of the information gatherers and their methods are highly questionable. Many local journalists are part-time regional reporters and are untrained. Members of the networks providing ad hoc information are not trained professionals.
6. No scientific surveys are possible. Access to the areas under LTTE control, even the No FIRE ZONE is denied by the Tigers (though access to government IDP centers are allowed).

The repercussions of this failed systems of reporting on humanitarian conditions in the Vanni are numerous. These include:

1. 'Naming and shaming' the government based on inaccurate information backfires on the agencies themselves and their networks
2. Wide-spread animosity and antagonism towards functioning and sometimes useful civil society groups
3. Credibility and standards of practice of international humanitarian agencies get eroded
4. Defaming of Sri Lanka- defaming of a democratically elected government or its people supporting a military solution is sometimes tantamount to defaming the entire nation, particularly in the west
5. Based on the 'established credibility' of these agencies and their reports, international media continues to defame our nation and its right to defend itself
6. These falsifications strengthen the separatist ideology of the Diaspora pro-LTTE groups resulting in taxation of Tamils living in the west, self-immolation by misled individuals, diplomatic stand-offs (Indian Central Govt-Tamil Nadu and Sri Lanka) and finally;
7. Strengthening the hand of Tamil ultra nationalists hell-bent on eternal perpetuation of hatred and subsequently a 'Round-2' of the fight.
8. Undue external interference in the conflict- The reports issued by these agencies put undue pressure on the state actor whereas it is the non-state actor that is holding the civilians against their will. In fact, thousands of Tamils attempting to reach government controlled areas at south Puthukudirippu were fired at (some killed) and subsequently driven out to Mathalang, general area north of Puthukudirippu recently.

It is therefore only natural for these agencies to now take stock of their methodologies, particularly in Sri Lanka. We would strongly urge them to do so and go as far as saying that we would even offer our services in reaching out for the truth.

While I agree with the fact that whoever committed crimes against innocent Tamil Sri Lankans were not punished in certain cases, I have to disagree with you on your belief of 1972 education reforms. These reformations were brought forward to help the Sri Lankan children from underprivileged areas. However, we still kept a certain percentage on the merit list. For your information, the underprivileged areas included Mulathivu, Mannar, Kilinochchi, Baticoloa, Trinco, and Ampara. The introduction of district quota system negatively affected Colombo, Gampaha, Kaluthara, Galle, Mathara, and Kandy districts as well. Therefore, your point about 1972 educational reforms affecting Tamil Sri Lankans only is not valid at all.
Do you think it is fare to ask for 50 percent of the country for exclusive ownership of the country for an ethnic minority? Do you know that the Sinhala civilization existed in every corner of the country? Why is current Colombo city has more Tamils than Sihnalese? Is it because of discrimination? Why don’t we have a single Sinhala civilian in Jaffna despite the presence of several military cantonments there? What happened to the Sinhala merchants and entrepreneurs who used to live in Jaffna? These are the questions you have to ask yourself before embarking on another quest.
Without getting too much in to details, I would say that you are welcome to live among other Sri Lankans peacefully as equals. However, no reason is valid to give a piece of the country for the exclusive ownership of an ethnic minority.

The Common Error of calling this country a land of many nations and why it should be removed forthwith from our political vocabulary.

We often hear many people, including even reputed intellectuals, university dons who teach political science, politicians, and many others, both local and foreign, calling this country a country of many nations - a multinational country. The presence of more than one ethnic community may have prompted them to do so. All countries the world over have people of different ethnic groups living within their territories. So this is not something peculiar to this country. Under that situation, if they apply the same criterion they apply to Sri Lanka then all other countries also need to be called multinational. But the tragedy is they don't.

Any given country has only one Nation. Therefore to single out and call Sri Lanka a multinational country in my opinion is a myth of the first order. It was invented and imposed on the Sri Lankan people by the colonial rulers in order to keep the Lankan nation divided for easy governance at the beginning and now to keep it divided to prevent progress and development, for their own benefits, such as economic and military. I think the propagation of this multinational myth, like the provincial divisions, is a major factor responsible for the present communal and separatist movements in this country. It has given them confidence, external and internal support and the apparent legitimacy to agitate for separation

Most of our own people also use this word to describe our society, probably not knowing what is really meant by a nation and also not realizing the long term political and socio-economic implications such erroneous usage is bound to have on the Islands national unity and its future. This trend of referring to Sri Lanka as a multinational country came to vogue particularly during Premadasa period. Since then it had been widely used by all politicians, mainly to win the minority votes, and then the media, both the print and the electronic as a display of intellectual standards, day and night and today it has almost been accepted by the society as a fact of life. Only two days ago I heard a Leading TV channel in a popular programme staged in Mahamaluwa Kandy, announced that this country has 23 nationalities. By doing so they are only providing ladders for the communal monkeys to jump and set ablaze our national unity.

As a matter of fact, as far as I know, no country in the world has more than one Nation. Because, the notion of a nation, is often co-terminus with a country where a group of united people live within a clearly defined territory and governed by one sovereign government. If you look up the world atlas you can clearly see this universal reality. The relationship between a nation and different communities that constitute it, in my opinion, could be compared to the one that exists between the ocean and the rivers that drain in to it from the different lands. The rivers in this process even cease to be fresh in taste and turn salty after they enter the ocean. They loose their identity, once they enter the mighty ocean but still maintain their individual identity within the land through which they flow. Nevertheless they continue to be eternally interdependent and that is the reality.

Before we go further to refute the idea of describing this country as a multinational country, let us first try to understand what is really meant by a nation. The most common definition of a nation would be 'a united people organized in to a state'. Such a nation will have the basic characteristics of a definite territory, people, and a sovereign government. The people within such territory often speak one language, belong to one race, profess one religion and have one common culture or at least have one dominant language, religion and culture, by which that nation is identified. The people who have built up the civilization of that country over a long period of time invariably are installed as the nation.

Most nations are identified by a language. For example England (English), Germany (German), France (French), Portugal (Portuguese), Spain ((Spanish), Italy (Italian), Russia (Russian), India (Hindi), Japan (Japanese), Korea (Korean) and China (Chinese) etc. Meanwhile some other countries in the new world like America, Australia or New Zealand or Canada that were colonized by Europeans have their nations named after the name of the country given to designate the location (Australia-the southern land) or the name of the man who discovered it in modern times (America-after Amerigo Vespucci). But they also share the common characteristics like the territory, common language, a religion and a common history when it comes to nationhood.

Another distinct factor that goes to make a nation is the people who are responsible for the history and the civilization in that country. Therefore the formation of a nation obviously takes a long period of time. Although a nation can have people belonging to a number of races and religions it will have only one common territory, one dominant race and one sovereign government. The name of the majority group with the common language and religion who have built up the civilization within that territory is usually given to the nation in that country.

When you put the Sri Lankan nation in to this framework the nation is either Sri Lankan or Sinhala. Sinhale was the name of this country. It meant the land of the Sinhala people or Sinhalese. Sinhala is a language and Sinhalese are the people who speak Sinhala as their mother tongue. All the people living within this country, whether they are Tamil or Muslims or any other could also be called Sinhalese to that extent, without prejudice to the language they speak or the religion they profess. In fact this has been the practice from the 6th century BC to at least 1815. The dominant race who inhabited this Island from very early times was the Sinhalese and they are the people who have built up the civilization of this country from the 6th century BC onwards. They are also the dominant ethnic group who founded the nation. Their Language was Sinhala and they have been Buddhists by religion at least from the 4th century BC. All this has been clearly established by archaeological and epigraphic evidence displayed all over the Island and the rich literary evidence at our disposal. Tamils and Muslims who came subsequently from time to time got integrated with the Sinhala main stream and became citizens of this country.

The fact that most Tamils, Muslims and other ethnic immigrants have Sinhala ge names and some of them have even embraced Buddhism clearly proves this process of ethnic integration. Tamils as an ethnic group has no country in the world where they can call themselves a nation, because, they don't have a country of their own. Even in Tamilnadu in South India which is considered the home land of the Tamil race where there are about 80 million Tamils live they are not a nation, although the most appropriate place where Tamils could claim to be a nation is South India. In India too they are only an ethnic group within the Indian Nation. So one who calls Sri Lanka a multinational society has to first justify how a minority of about 1.2 million Tamils in Sri Lanka where the total population is around 20 million and of that Sinhalese form nearly 15 million, could call themselves a Nation?

The names Sri Lanka and Sinhale have been co-terminously used to call this country from very early times. In fact the first name by which it was called was Lanka and later called Sri Lanka. The name Lanka first appears in the legendary Skanda Purana. Next it is used in Ramayanaya believed to have been compiled around 2000BC. Even the Vedeha's Mahavamsa written in the 5th century AD used the word Lankadeepa-the Island of Lanka. According to Mahawamsa when Vijaya and his retinue inquired about the name of the newly found land, Upulvan who was present as a disguised recluse said it is called Lankadeepa. Subsequently Greeks called it Taprobane, probably going by the word Tambapanni. In his first map of this country Taprobane, Egyptian mathematician Claudius Ptolemy called it Salice or Salika. Arab traveler Edrise called this Selen-dib or Serendib. This links up the later names, Seylan, Seilan and Ceilao of the Portuguese and Ceylon of the British. The Tamils called it EELAM and Ilankai.

One common factor to be noted with all these names, except Taprobane, is that all of them have been derived from the word Sinhale. What more evidence is needed to prove that this land had been the land of the Sinhala Nation who inhabited it for 2500 years and moulded its civilization? It is also pertinent to note here that the four ancient tribes, who lived here when Vijaya arrived, namely Yaksha, Raksha, Naga and Deva who were called 'SIVHELA' were also integrated in to this Sinhala nation along with the establishment of the Vijayan regime in the 6th Century BC. Thus all documentary evidence of the classical period, including, those of South India, have undisputedly called this country, the Land of the Sinhala Nation even from the time prior to the dawn of history. Therefore it is absolutely futile for any pseudo academic or a communalist group or some other local or foreign party with vested interests like global geopolitial or maritime economics to call this a multinational country and rob the Sinhala people of their legitimate claim to its nationhood.

Historically only Sinhala people as a race could claim to be a nation in this country. All others are only small immigrant ethnic groups who arrived later and got integrated to the main stream of the Sinhala Buddhist society subsequently. Therefore neither the Tamils nor the Muslims could be described as nations in this country. Muslims are also only a group of people who profess the Islam religion. Therefore none of these groups can claim to be recognized as nations in this country. As a matter of fact there is no nation called Muslim any where in the world. Therefore all these ethnic groups should give up this claim for separate nation hood and begin to think and act as Sri Lankans in order to build up a strong Sri Lankan nation. Furthermore they should also accept the historical realities of this Island concede to the fact that. Also they should accept Sri Lanka as their mother land and give up the practice of considering India or any other country as their mother lands as they have been doing hitherto. Their allegiance should be confined only to Sri Lanka. I think they should learn from Obama and Sonia Gandhi as to how they should adjust to the country and the society where they live. Now that the biggest problem we faced, terrorism, has been defeated, this is the best time we should also initiate action to defeat communalism and separatism and to unite all ethnic groups as one Sri Lanka nation.

Finally, in the wake of the defeat of the LTTE, I would like to make few suggestions as to how we should set about in building this strong nationhood and consolidating it to make this Island nation once again a peaceful, vibrant and prosperous country.
In spite of the fact that the government has defeated the so- called invincible LTTE we have to remember that yet there are two other dangers that are still alive. They are communalism and separatism, the twin brothers of terrorism. If do not defeat them as well they will again give rise to terrorism. Defeating both these evils may be even more difficult unless we take appropriate actions and strike while the iron is hot. I think this is the best time to do that. If we succeed in doing that then that will be the real beginning of our true independence from the yoke of colonial rule. Further it will also mark the starting point of restoring the pristine and glorious Lanka that was devastated by Magha in the 12th century, which no ruler has been able to do for the past 800 years.

What the government is going to do to overcome this situation also has to be perceived in a broader perspective as many are the parties, both local and foreign, who are eagerly waiting to upset the apple cart. Even those who now 'kiss the hand that cannot be cut' including our own opposition, have already started to cry wolf and call for a 'political solution'. One has to remember that except the present Indian government all others like the EC, America, Canada and even Japan would definitely press for a pro-Tamil power devolution package that would keep Sri Lanka destabilized and finally lead to separation. For those who cry for a political solution, the best answer the government can give is that it has already done so by defeating the terrorists. I don't think any of the above powers will want a peaceful, vibrant and prosperous Sri Lanka. Therefore we have to be extremely cautious with their advice on this issue. What ever the government do, it has to be very careful not to let down the victories and the sacrifices the armed forces and the people of this country have done to gain this victory. It also has to keep in mind the faith and trust they kept on the leadership and the government. I know it is a real Herculean task. But no solution should fall behind the aspirations of the people of this country. The final solution must be a home made one based on the aspirations of the people of the land. We should never allow any external power to dictate terms to us as it happened in 1987. Let every body be tolled very clearly that we are an independent sovereign state whose destiny has to be decided by its own people.

The best way to overcome this situation, in my opinion is to go for a popular mandate from the people of this country as early as possible and get the 2/3 majority in Parliament required to go for a new constitution so that they can make a new start. Assuming that the government will go for such far reaching change, I would like to list few propositions for consideration that would have the greatest support and approbation of the general public of this country. Once you get a popular mandate the President can go ahead with its implementation and neither the external forces nor the internal elements can then change the course of history.


1 Ban all political parties based on ethnicity, language, religion or regional identity and
promote a two party system of government with an alternative party and not an
opposition party as we have now.
2 Have only one official language and one common identity for Sri Lanka as a nation
3 De-politicize public service and make meritocracy the main criterion of recruitment to
public service.
4 Scrap the Provincial divisions of the country and re-introduce the indigenous system of
Three Sinhale political divisions and make the village the basis of national development
and ban all future ethnic segregation and encourage ethnic integration.
5 Replace the existing constitution with new one that ensures the protection of the
Island's territorial integrity, sovereignty, national unity and promotes good governance,
economic and social prosperity and ethnic harmony, and peace among its subjects.
6 Create a post of Deputy Prime Minister to be held by the Tamils and Muslims
alternatively (say T 3 and M 2 years)
7 Have a powerful Executive Presidency answerable to the Parliament and people
8 Lay down a national policy on all national issues so that the development of the country
will continue smoothly according to national aspirations irrespective of change of
governments.
9 Let justice, fare play, freedom and equality prevail over all its citizens and let the good
of the country and its people take precedence over all other considerations. In order to
facilitate this process, I propose the government set up a Presidential advisory council
of the four Mahanayakas and three dignitaries to represent the other three religions.

10. Re-install patriotism, dignity, honesty and commitment to public good in public
office and respect to age old traditions of state craft as the foundation of national
resurgence.

This of cause is only an idea of one solitary man. It certainly needs more thinking, perhaps more rational and pragmatic, but the final goal should be one. That is a peaceful, vibrant and prosperous Sri Lankan Nation that will once again make this Island nation the much envied resplendent 'Pearl of the Indian Ocean'. I hope those who are in authority will take notice of this solitary cry.

I don't think there will come a better time than the present, with its obvious national resurgence and the strong and patriotic national leadership, for that long awaited Great CHANGE in the history of this nation.

This action of GoSL makes me equally happier with the fall of Killi and Paranthan. This indicates at the very top level, patriotism and nationalism appear to be seeding. What angered me the most was Briton's reference to SL as an “ex-colony of Briton”.

One other thing I like to note is that MR predicted and declared year 2009 as the year where (despite the great achievements from armed forces)country should be vigilant about and guard against internal and international conspiracy againsts it's good name and the battle field gains. In fact this observation he made even after weathering the storm from Tamil Nadu jokers. That is gold. This guy knows what he is doing.

So brothers, the above GoSL response seems to me calculated and well prepared.

How lucky this country in it’s 11th hour of division managed to find leaders of this caliber.

I can see very healthy debate here in convincing Tamils – that they are no longer considered as people with special needs or special group but part of 20 mil or so citizens in Sri Lanka – take it or leave it. Great but that is only half the job done.

I feel our efforts must be invest on “deterring all foreign powers” who demand we need to treat Tamils as such - a special group (that includes India) - by not listening to them and rejecting them in point blank rage as GoSL has done in this particular case. If we succeed in doing that then “Tamils” have no choice but becoming citizens of SL who are willing to live with others in harmony. In other words, kick the white and black asses hard – who want us to believe and treat Tamils as a special group.

I think MR and GoSL are on that track.

However it is easy to find out the loyalty for Sri Lankan issue of frequent contributors here. I have the ability to screen out rocks from the rubble. If I really want to find out whether you are a loyal Sinhalese, it can be done in 60 seconds using few different ways. I am not going to write the method on a public forum.

I found the above site quite interesting...
There seems to be some truth in the article..though it does not change the truth,i.e. todays (false) propaganda will become tomorrows fact once the Tigers final lair is captured.
For all their failings, the Tigers have indeed retained almost all their functioning heavy assets till date..a monumental feat given their difficult circumstances.
We can also surmise at this stage, that the " Shot down in flames" story by media about TAF were wrong..or atleast the location of ' crash' is wrong.
It is my presumption that the Tigers would have transported and hidden the crucial Sea Tiger assest--eg Guns, engines and radars by transporting back down East/South..the fibre hulls would be weighed down in the marshes/lagoons for future resurrection.
The TAF prob would be dithced in midsea or lakes..
The artillery and armored vehicles will likely be the main heavy items to be recovered by SLA--though likely blasted.
The insurgency will likely go on indefinitely unless conditions change--The international network can easily supply high-tech weaponry in adequate numbers to a no-flab Tiger. If the Tigers change their nomenclature and leadership it may even grow..

* Re all the accusations of media bias--the solution is very simple--let in the media/aid orgs at their own risk. The GoSL has so much tainted its own credibility that even when telling the truth observers doubt it.
