The plight of the Human Rights Community

There is mass speculation regarding the number of civilians trapped inside LTTE areas. Human Rights groups who make a living out of such situations have claimed that 250-000 (MSF) to 300,000 (AI Report) civilians are trapped in these areas. How these organizations arrived at these figures is a mystery, or is it?

A careful observation of these agencies' information extraction process reveals that there is much to be desired in terms of their methodology for getting at the 'truth'. This is because the exact number of civilians trapped in those areas is not known even by the military. There has not been a census conducted in those areas in two decades. The Army's best guesstimates puts the number around 100,000 civilians at the most.

So how do these organizations gather their information?

When it comes to the collection of information from 'the other side', there has been a practice by these organizations, even diplomatic missions, of hiring or networking either directly or indirectly with Tamil nationals residing both in Colombo and in the Districts. This is based on the idea that they have better access and therefore better information about the Tamils in the said area.

The issue of natural bias is often overlooked as a result of high expectation for professionalism from the said officers. These networks are maintained by a 'local operation' meaning a small office/s maintained in Sri Lanka by a group of expatriates and their local employees. The major sources of these organizations are as follows:

  • Political affairs officers of embassies/High Commissions who rely on Tamil journalists from mainly the print media (Thinakkural etc)
  • Tamil nationals attached to NGOs/INGOs/UN agencies both at the head quarters and district level (ICRC, SLRC, Local 'Civil Society' and Human Rights Groups)
  • Tamil nationals attached to various Ministries (Ministry of Rehabilitation etc)
  • Expatriate staff of NGOs/INGOs/UN who meet randomly at Colombo's favourite watering holes (These expatriate officers disseminate information gathered through local staff)
  • Local officers/district staff obtain information through their own networks of Tamil journalists/Grama Niladhari etc. Some may have an opportunity to interview returning civilians.
  • Sinhala journalists who get tidbits from friends in the Military
There is however a serious problem with this methodology, particularly in the current context.

1. The area of contention has shrunk. One can cover the area under LTTE control with one's thumb on a map of Sri Lanka.
2. No rebel 'administration' exist, hence there cannot be accurate estimates even if they tried
3. Civilian and civil administration, interaction and communication systems within the area and connection to the outside world has ceased and replaced primarily by an LTTE Military communication system, which is naturally biased.
4. Returning civilians may have an 'idea' of the numbers displaced but it is by far inaccurate and limited to their immediate experience/individual networks/capacity.
5. Quality and capacity of the information gatherers and their methods are highly questionable. Many local journalists are part-time regional reporters and are untrained. Members of the networks providing ad hoc information are not trained professionals.
6. No scientific surveys are possible. Access to the areas under LTTE control, even the No FIRE ZONE is denied by the Tigers (though access to government IDP centers are allowed).

The repercussions of this failed systems of reporting on humanitarian conditions in the Vanni are numerous. These include:

1. 'Naming and shaming' the government based on inaccurate information backfires on the agencies themselves and their networks
2. Wide-spread animosity and antagonism towards functioning and sometimes useful civil society groups
3. Credibility and standards of practice of international humanitarian agencies get eroded
4. Defaming of Sri Lanka- defaming of a democratically elected government or its people supporting a military solution is sometimes tantamount to defaming the entire nation, particularly in the west
5. Based on the 'established credibility' of these agencies and their reports, international media continues to defame our nation and its right to defend itself
6. These falsifications strengthen the separatist ideology of the Diaspora pro-LTTE groups resulting in taxation of Tamils living in the west, self-immolation by misled individuals, diplomatic stand-offs (Indian Central Govt-Tamil Nadu and Sri Lanka) and finally;
7. Strengthening the hand of Tamil ultra nationalists hell-bent on eternal perpetuation of hatred and subsequently a 'Round-2' of the fight.
8. Undue external interference in the conflict- The reports issued by these agencies put undue pressure on the state actor whereas it is the non-state actor that is holding the civilians against their will. In fact, thousands of Tamils attempting to reach government controlled areas at south Puthukudirippu were fired at (some killed) and subsequently driven out to Mathalang, general area north of Puthukudirippu recently.

It is therefore only natural for these agencies to now take stock of their methodologies, particularly in Sri Lanka. We would strongly urge them to do so and go as far as saying that we would even offer our services in reaching out for the truth.

DW, I would like to add another point to the list of things that make a good estimation of the number of civilians trapped in Wanni impossible.

This is, gray-area that exists identifying between a terrorist and a civilian. Should we just take into account only the really small children and really old people that possibly can't fight for the LTTE or do we also include potential LTTE fighters in our list of civilians?

Observing that there are former terrorists among the civilians, I think the aid agencies have also included all the terrorists as civilians in their lists. But even then, still, the numbers are too large to be accurate.

By reporting this greatly inflated figure (currently by as much as x2), the aid agencies have increased the problem exponentially, giving, as DW mentions, a life-line to the terrorists.

The LTTE can only do what you mention only if they win over the civilians again. I doubt Tigers will be able to do this, given the horrendous way the civilians lived under VP's rule. Of course, the cycles of violence and pacificity will continue, if the majority do not identify the rights of the minorities. However, even this will change if GSL does something significant to boost the economic conditions of the people and educate them (not just to be myopic doctors and engineers, but to be liberal group of people).

It should be "One Sri Lanka" policy.

Anyone should be able to buy land, marry whom they want, live peacefully in anywhere in Sri Lanka.

Law and Order should be established with highest degree of respect to civic and human rights.

No favoritism whatsoever based on political affiliations or connections, wealth, ethnicity, caste, gender, social status etc.

I read the letter that has been written by the person who burnt himself to death in Geneva.

The letter is well articulated beyond his capacity. The writing style resembles one of the writers of Tamilnet. I wish the Tamilnet would publish the 'electronic text' than publishing the scanned version.

To me it looks like this person did not volunteer, but made to be do so by some elements (LTTE handlers).

Police should conduct a full investigation on who is behind this person's death and how the events progressed.

Police should check who 'typed this letter', who 'edited this letter', 'who printed', and 'who brought the letter' to the scene.

If they had done a finger-print analysis of the letter, they could find more. In addition, the Police should check who were associated with this person, and who made contacts with him in the past few months. Looks like serious crime has been committed here getting someone to burn himself to death.

The letter is too good to be written by a none-professional, and I was particularly amazed by the term 'Sinhalese Buddhist Chauvinist Government of Sri Lanka', which is used by LTTE extensively in their false propaganda campaign against Sri Lanka.

The Govt is not going to allow any civilians back to liberated areas for three years. Even after that Sinhalese people from the south and Army families will likely settle down and start townships and villages throughout the Wanni.

2. no hospitals run by GOSL
4. no access to Govt servants salaries and pensioners salaries
3. no hiding places among civilians as anyone found in these areas will probably be considered terrorists and dealt with appropriately

Paying attention to a issue in the battle front. After some time guys, so pardon me if this is an already discussed topic.

The new No Fire Zone in the shore

I know that it was not a choice but the inevitable as pussycats pushed most of civilians into it anyway. Also it is a wise move for now, in order to get 58th moving and to challenge PTK.

But my concern is the terrain of new NFZ.

So far the civilians were told to stay in mainland, where escape is possible in every direction. But new NFZ is an Island [isn't it the biggest Island of SL?] bordered by two lagoons which connects to one another by a narrow shallow point [See google maps]. Few bridges and causeways connect it to main land.

Anyone fleeing this will have to take up one of the known points, and pussycats are surely guarding them. Also it makes way for them to better organize suicide pussycats in civilian colors.

Right now it is all but clear that we are planning to take over A35 and PTK and hence SLDF has moved final battle to shore. Also it is clear that Pussycats are expecting the same, and have most likely moved the leaders there and now herding the civilian "live stock" for their consumption. Although this move makes it easy to take over main land, it would make the taking of this island increasingly difficult.

So far in rough terrain 55th firepower proved as the best weapon. But with this move, 55th will be pretty much tied.

This move, to me, will speed up the capture of PTK, but delay the overall end. I hope that grand chess master has more wisdom.

1. If any one become curious about SL in west due to these events he will study the problem carefully and find the truth.

The US Senate Foreign Relations Committee is to conduct a hearing on the Sri Lankan crisis later this month, the Foreign Policy website said.

Last week, the committee assigned senators to head up regional subcommittees. Among the new assignments, Sen. Robert Casey (D-PA) is heading up the subcommittee on Middle East and South Asia; Sen. Jim Webb (D-VA) is heading the subcommittee on East Asia, a long-time passion of his; and Sen. Barbara Boxer (D-CA) is heading up a new subcommittee on global women's issues, an interest of hers and of Secretary of State Hillary Clinton.

Senator Casey, who is planning his subcommittee's first hearing on the recent violence in Sri Lanka on February 24, envisions a robust agenda for the year, including hearings on Iran, Pakistan, Iraqi refugees, and the nuclear programmes in the Gulf States.

"We are going to be working very hard within the committee itself and within the subcommittee to take a hard look at a whole series of challenges we face in foreign affairs going forward," Casey told Foreign Policy. Although he and the chairman are very supportive of the Obama administration's foreign-policy team, he said the committee has to be an independent voice on foreign policy. He especially wants to "pay close attention to all of the areas under our subcommittee's jurisdiction, which are the subject of a lot of debate [in the U.S. government] and require a lot of vigilance, whether in Afghanistan, Pakistan, Iran, Iraq, [or] the Middle East." Next stage is a further outflow of remaining tamils from SL. That stage will effectively eradicate the tamil population below the point of recovery far beyond the next century. In a sordid way, this is exactly what the southern village anti-tamil racists of the day wanted to see; the day the tamils are reduced to insignificance. They are likely to see their wildest dream come true.

On the other hand, there are lots of sinhalese and others willing to return home to rebuild SL. If only the Rajapakse's have the same level of commitment to prioritizing that issue also, this could be the starting point of yet another economic miracle in Asia.

Following is my take on newly allocated No Fire Zone, which I already posted. Since many raised similar questions later on, I'd like to repeat it.

The new No Fire Zone in the shore:

I know [think] that it was not a choice but the inevitable as pussycats pushed most of civilians into it anyway. Also it is a wise move for now, in order to get 58th moving and to challenge PTK.

But my concern is the terrain of new NFZ.

So far the civilians were told to stay in mainland, where escape is possible in every direction. But new NFZ is an Island [isn't it the biggest Island of SL?] bordered by two lagoons which connects to one another by a narrow shallow point [See google maps]. Few bridges and causeways connect it to main land.

Anyone fleeing this will have to take up one of the known points, and pussycats are surely guarding them. Also it makes way for them to better organize suicide pussycats in civilian colors.

Right now it is all but clear that we are planning to take over A35 and PTK and hence SLDF has moved final battle to shore. Also it is clear that Pussycats are expecting the same, and have most likely moved the leaders there and now herding the civilian "live stock" for their consumption. Although this move makes it easy to take over main land, it would make the taking of this island increasingly difficult.

So far in rough terrain 55th firepower proved as the best weapon. But with this move, 55th will be pretty much tied.

This move, to me, will speed up the capture of PTK, but delay the overall end. I hope that grand chess master has more wisdom.

Many guys asked you to state the 'problem'. You state many things but unfortunately failed to state any problem. You stated mainly some unfortunate historical events happened (56 to 83), some historical stuff (Jaffna kingdom) and hence federal solution.

I don't think any thing already happened and corrective actions taken can be a problem for any one any more. ex. 56 act; now tamil is official language too.

So let me try to formulate your problem for you.

1. Fear about safety

Tamils fear about your life as SLDF mainly composed of sinhalese.
Past experience (58, 83 etc) support this fear.

You want federal to fix this but there is nothing preventing tamils joining SLDF so I suggest tamils to join SLDF rejecting LTTE.

2. Tamils do not feel being part of government

There are some individuals (DD, Thondaman and now Karuna etc) with center. I suggest tamils to join mainstream politics (SLFP, UNP) or TNA etc to work together with ruling party if you support them.

"NEW DELHI: Tamil Nadu is in an unenviable position. A report on urban poverty prepared by the government shows that, among the southern states, Tamil Nadu has the highest percentage of its urban population below the poverty line (69.13 per cent) and the lowest percentage of self-employed people (39.8).

The report, brought out by the Ministry of Housing and Urban Poverty Alleviation, shows that Karnataka has 63.83 urban people below the poverty line, while Andhra Pradesh has 61.40. For Kerala, the figure is 17.17 per cent, which is an indicator of the efficacy of the Kudumbasree and Asraya schemes of the Kerala government, which are worth emulating, it says.

The report adds that non-government organizations have successfully operationalised models of community-based and women-based efforts to tackle urban poverty.

Andhra Pradesh, says the report, has the highest percentage of urban self-employed among the southern states at 44.5 per cent, with Karnataka at 42.1 per cent and Kerala at 41.1 per cent. The figure for Orissa is 44.4 per cent. The report also highlights that the proportion of self-employed is higher is some of the poorer states of the country such as Bihar, Madhya Pradesh, Rajasthan, and Uttar Pradesh, than in many developed states.

Kerala, which has an enviable performance in the education sector, is in the worst position regarding urban unemployment, with 15.6 people per urban hundred going without jobs. This is complemented by the high out-migration, with the state topping the charts in this regard, too.

Kerala is closely followed by Orissa (13.4 per cent) in urban unemployment.

However, the other southern states have made significant strides towards wiping out urban unemployment, according to the report.

Tamil Nadu lags behind in the context of basic amenities. Among the southern states, Karnataka has the highest percentage of urban households with access to safe drinking water (92.1 per cent), followed by Andhra Pradesh (90.2 per cent). For Tamil Nadu the figure is 85.9 per cent and for Orissa it is 72.3 per cent.

However, the situation is far better than in Kerala, where the figure is a mere 42.8 per cent, one of the lowest in the country, the report said."

Then they burnt the Best Timil Liabrary in the Asia if not World. It is completely organised by UNP. JRJ should be responsible for that. As you said all normal Sinhalese didn't do any harm to Tamils infact they protected them.

I also strobgly believe that there should be a politically solution that everybody can have equal rights and opportunities.

But remember a lot of Sinhalese were also unfairely treated by different governments over the years and JVP got arms as a result.

Therefore we need a solution that address Tamils as well as all communities.

for starters I suggest that all tamils get together & do following-

1) renounce the vadukoddai resolution admitting it was a fatal mistake.

2) renounce tamil eelam, federal state & learn to exist in the present administration system peacefully.

3) give prominence to education, hard work & contribute to the economy. stop complaining about everything while planning the death & destruction of everybody around as well as ur own community.

unles these are done immediately, tamils will end up way behind all other communities, whether they like it or not. tamils got a clear choice ahead.

will they have the vision to succeed?

There seems to be a lull in news. I take it that army is waiting for civilians to trickle in. But how long will this go for?

I'd ask if LTTP were in the shoes of army if they would have any sympathy for our civilians?

unless the steps that i mentioned are met it'll be impossible. tamils will be nothing. the diaspora will have to join the local tamils in these three steps.

my whole point is that tamils have completely exposed their fake cause & now stand nude in front of the world.

I am trying to suggest the only possible way out for the lost tamil race in sri lanka. it's only tamils who can get out of it. looks like their getting deeper into the quagmire thanks to diaspora.

at the moment diaspora is running after white governments & foreign media with brown & BBC trying to re-colonize. diapora still call this ceylon. talk about still living in the slave age! ha ha ha!

the harder they push the harder we'll resist.

does it make matters better or worse for local tamils? the answer's obvious.

the much educated diaspora don even use a tamil spokemen or lawyers anymore. they have to hire sinhala spokesmen & white lawyers for their propaganda & law suits for god's sakes!

that's the status of their credibility. they've lost it.

Thats the biggest joke I have ever heard mate.In his political career spanning almost 3 decades,Vaiko has never won a single election so far.He has always been a nominated member.This shows how much support or the lack of it he has.I think LTTE is wasting their money on him.Time to find someother guy who has some sorts of weightage in Tamilnadu

triumphalism cannot be avoided.
after all wars & cricket matches there are celebrations. unlike terrorism triumphalism's not a crime.

therefore for the sinhala the end of foreign sponsored terrorism & LTTE is one hell of a truimph. it's the same for most of the local tamils. although they're too sick to realise it. but for diaspora the end of terrorism is a reason to burn themselves to death.

so mustn't be scared to celebrate. we're not planning to chase away the colombo tamils & celebrate like LTTE did to tamils & sinhala in the north, are we? so i see no problem with triumphalism.

LTTE will run its natural course to destruction. the tamil political aspirations will end at provincial councils. the tamil people will have to take it or leave it.

no amount of suicide bombers or diaspora demos are gonna change that.

triumphalism has nothing to do with political reality.

True. Ground war in Vanni may end soon. Another one which I believe Sri Lankan was/is "prepared for": for as long as Sri Lankan troops remain in the Tamil region, they (and their dependants) will continue to be targeted. More money, more men, and the spiral goes on.

But if they decide to stay and attempt to dictate terms, of course things will be difficult for us.

Challenge is to make occupation as difficult as possible.
