KP Arrest -- UPDATE

We have received credible information on the arrest of two individuals, one a middle aged man traveling on a non-Sri Lankan passport at an undisclosed location in Bangkok in a joint stint launched by Thai and Sri Lankan authorities. The travel documents and said identity confirms with an alias of LTTE operative Shanmugam Kumaran Tharmalingham.

The man was carrying travel documents both under his own birth name and under other aliases at the time of arrest. A group of Sri Lankan officials is expected to fly the said two individuals to Sri Lanka shortly. Please await further information as it is made available.

COLOMBO: India on Saturday conveyed to Sri Lanka that a “broad-based political settlement” of the ethnic conflict would enable the Rs.500-crore relief, reconstruction and rehabilitation package for the nearly three lakh war displaced to be utilised in a more effective and efficient manner.

In his message to coincide with the 63rd Independence Day, published in a special supplement in the local media, High Commissioner in Sri Lanka Alok Prasad said New Delhi looked forward to working with Colombo for quick and effective disbursement of the package.

India’s desire for a “broad-based political settlement” along with the resettlement of the war displaced assumes importance as Sri Lankan President Mahinda Rajapaksa, since the end of Eelam War IV on May 19, has been focusing on the need for relief and rehabilitation to take precedence over a political solution.

In his interview with The Hindu on June 30, in response to a question on the political solution — the 13th “Amendment Plus” — he had in mind, Mr. Rajapaksa had said “even tomorrow I can give that — but I want to get that from the people.”

He insisted that all parties, especially the Tamil National Alliance representatives, should participate in the discussions on the political solution. “I am waiting but it will be after my [re]election [as President].” Indications are Mr. Rajapaksa could order a presidential election by the end of 2009.

Mr. Prasad said India had always been committed to the unity, sovereignty and territorial integrity of Sri Lanka and restoration of peace through a political settlement that met the just aspirations of all elements of Sri Lankan society.

“The true quality of friendship was evident during the recent difficult times when India stood steadfast by Sri Lanka’s side. We will continue to support Sri Lanka’s commitment to heal the wounds of the past, to build a caring society which ensures a life of equality and dignity to all its citizens,” said the message.

The message also said India was supplying material for construction and would be willing to augment such assistance as the resettlement proceeds.

Independence Day was celebrated in the morning on the lawns of India House. Mr. Prasad unfurled the Tricolour in the presence of around 600 Indian expatriates.

No controversial, unfair treaty with India: Nepali PM

KATHMANDU, Aug. 16 (Xinhua) -- Nepali Prime Minister Madhav Kuamar Nepal on Saturday said that he would not sign any controversial and unfair treaty during his upcoming India visit, state-run newspaper The Rising Nepal reported on Sunday.

"The government will not sign any treaty that harms the national interest and feelings of Nepalese," Prime Minister M.K. Nepal said.

However, Premier Nepal said that he would discuss the mega projects prioritizing Pancheshwor Multipurpose Project, over the Mahakali river dividing Nepal and India, with his counterpart during his goodwill visit.

He said that the government was committed to revoking unfair treaties signed even in the past. "As much as the government can, it will maintain a balance in its relation with India and China. My visit will be focused on it," he said.

He also said that production of hydro-power at Pancheswor of Dadeldhura district, some 525 km west of Nepali capital Kathmandu, would be cheaper than Mid-Marshyandi, the costliest hydropower project in Nepal.

Unified Communist Party of Nepal (Maoist (UCPN-M), the opposition party, has warned the government not to sign any agreement on Pancheshwor Multipurpose Project during his upcoming India visit.

Speaking at a tea party with the locals of Mulpani in Nepali capital Kathmandu on Saturday, Prime Minister Nepal said that Nepal’s interest would get utmost priority if any bilateral deal was reached during his India visit. Nepal also urged the UPCN-M not to be suspicious of his India tour. He will leave for New Delhi, the capital of India, for a goodwill visit on Tuesday.

The arrest and assault of a 14 year old school student by the police just a month ago indicate that in Sri Lanka, today, extra-judicial violence perpetrated by the rulers and their acolytes, against political opponents and personal enemies, is a norm. According to a petition presented to the Supreme Court, 14- year old Jeewantha Ranasinghe, a Grade 9 student of the Subharatha Maha Vidyalaya of Meegoda "was arrested by officers of the Nawagamuwa police station… on June 22, 2009. Two or three days later, he was produced before the Magistrate and bailed out…..arrested (again) on July 7…. and bailed out on July 9…. The Kaduwela police had not given a reason for his arrest. …. While in police custody, Jeewantha had been assaulted" (The Island – 12.8.2009). This minor was arrested due to a "complaint made by a relative of a Pradeshya Sabha member named Suresh Priyadarshana of Kaduwela…." (ibid). Obviously the reason for this infamy was a boys’ quarrel between the victim and another student of the same school! When the rule of law is replaced by the law of the rulers, anything can become a crime and anyone a victim, even school kids. "

I think Khan was questioned not because he was MUSLIM; but because of his ROLE and MOTIVATION in making this movie "about racial profiling of Muslims after the Sept. 11, 2001, attacks". US authorities DON'T LIKE THAT ACCUSATION & view it as rabble rousing.

This is reminiscent of LTTE agents making accusations of racism against the GOSL, whenever a LTTE operative was questioned by the security forces!

Angry fans in the northern city of Allahabad shouted anti-U.S. slogans and burned an American flag.

Khan said he was detained Friday by U.S. immigration officials at Newark Liberty International Airport in New Jersey because his name came up on a computer alert list.

The actor is in the U.S. to promote a new film, "My Name is Khan," which is about racial profiling of Muslims after the Sept. 11, 2001, attacks.

The story was front-page news in India, where the ability to avoid being frisked at airports is seen as a status symbol. Politicians, sports celebrities and film stars often claim VIP status to avoid security checks.

"My name is Khan? Too bad. SRK (Shah Rukh Khan) feels the heat of American paranoia," said The Times of India, quoting Khan as saying he felt "angry and humiliated."

Khan later downplayed the incident. "I think it's a procedure that needs to be followed, but an unfortunate procedure," he told reporters Saturday in suburban Chicago.

U.S. customs officials told The Associated Press that Khan was questioned as part of a routine process that took 66 minutes. Spokesman Elmer Camacho said Khan was not detained, "but it took a little longer because his bag was lost by the airline."

The federal information minister, Ambika Soni, angrily suggested that India adopt a similar policy toward Americans traveling to India.

Wanted immediately: an effective and independent Police Commission

There are two names I first heard two days ago. Dinesh Tharanga and Danushka Udayakantha Aponsu, aged 26 and 21 respectively. They are dead now. They were killed, allegedly, by a gang of police officers led by T.W. Newton, the Officer in Charge of the Angulana Police. There’s another name I hadn’t heard before: Nipuna Ramanayake. He was abducted and beaten up allegedly by a gang led by one Ravindu Vaas Gunawadenra, the son of SSP Vaas Gunawardena, Director of the Colombo Crime Division.

The OIC of the Angulana Police and six other police officers were transferred and subsequently arrested, why they were not arrested first being of course a relevant question that remains unanswered by the Inspector General of Police. SSP Vaas Gunawardena has also been transferred, presumably to ensure that inquiry into the second incident proceeds without undue interference. The action has been relatively swift, but try telling that to the parents of Dinesh Tharanga, Danushka Aponsu and Nipuna Ramanayake!

There is a thing called ‘law enforcement’ because all societies breed thieves and transgressors who plunder the wealth of the hard-working, law-abiding and infringe on their basic rights for whatever purpose, respectively. The duty of law enforcement authorities is to monitor and protect the law-abiding, and to seek and stop rogue elements. This is what one can reasonably expect from the police. This is not what Dinesh and Danushka got. Today, instead, the protector has turned predator; rogue-elements are in position to facilitate and perpetrate thuggery. Correction: the protector continues to be predator; rogue-elements continue to facilitate and perpetrate thuggery.

The murders in Angulana do not constitute a first. Neither was the attack on Nipuna the first by someone who operated believing that papa’s position gave him the right to perpetrate assault and battery. We have had high ranking police officers partying with known drug-dealers. There is a lot of oiling of palms going on. This is common knowledge.

In September 2003 or thereabouts, the then Bribery Commissioner, Kingsley Wickramasuriya identified the Police Department among the top 12 state institutions in terms of corruption. Corruption, as far as the Police Department goes, refers to the failure to act to prevent theft and other forms of fraud, the perpetration of such acts, and deliberate negligence in enforcing the law. All this is further compounded by the fact that there is an unholy alliance between police officers and politicians who are not given to playing by the rules. It is common knowledge that there is a lot of ‘you scratch my back; I’ll scratch yours’ going on between politician and police officer (and of course police officer and criminal) and that this has been going on for decades.

When protector turns predator, the ordinary citizen is helpless. When protector-turned-predator operates under covering-fire from powerful politicians, I can’t think of a better term to describe the plight of the citizen than ‘f****d!’ I could add, I suppose, ‘twice over’.

All this forces me to reconsider the 17th Amendment, especially its articles pertaining to the Independent Police Commission. I am drawn to Section 155G of the relevant chapter, which lays down the powers of the Commission. The Commission, accordingly, is empowered to devise the regulations governing recruitment criteria, training criteria and improving the independence and efficiency of the police service. The key here is the matter of devising regulations. It implies that such regulations are necessary but are unfortunately absent. The 17th Amendment is not being implemented, we know, and we should continue to suspect that part of the non-implementing is attributable to the fact that it goes against the interests of the politician. If, on the other hand, competent commissioners had been appointed while the 17th Amendment was in force, they would have obtained the services of experts to formulate necessary policies which in turn may very well have prevented the kinds of horrific transgressions we are seeing today or those we have seen in the past 30 years or so.

Ok, so we don’t have the 17th Amendment (flawed as it is). We don’t have anyone offering an alternative model that ensures a healthy degree of insulation for the citizen from the politician and political interference and obtains effective, independent and ethical practices from the public service. We are confronted by a hard constitutional wall, where amendment requires two-third majority and a legislature that is sorely lacking in men and women of principle and integrity. Is all lost?

I believe to admit all is lost is to be irresponsible and moreover an argument that in the final instance boils down to a vulgar readiness to offer silent consent to unconscionable acts of transgression. We could take strength from the fact that there was a time when it was considered silly and illogical to say that the LTTE should be and can be militarily vanquished. The political leadership at that time was convinced this was not possible; it was committed to suing for peace at the cost of territory and much else. Things changed. Things changed because people argued otherwise, cogently and incessantly, and thereby turned public opinion against the then hegemonic view.

This time around, it would be tougher because the ideological fight will be more ‘personal’ from the point of view of the politician. He/she stands to lose at a very personal level; all the more reason for the citizens to expend more energy and exercise more vigilance. Moreover, it calls upon the citizen to be even more circumspect in choice of ally because it would be naïve to expect politician and political party to act against their self-interest.

We could not stop Dinesh Tharanga and Danushka Udayakantha Aponsu from being murdered. We could not stop Nipuna Ramanayake from being assaulted. We may not be able to stop some intoxicated cop from putting a bullet through the head of some person who has crossed his path tomorrow. We may not stop the son of some politician or senior police officer operating as though he is above the law. We have to understand, however, that if we remain silent, neither we nor our children will be safe.

I don't know how well versed you are with the shadowy part of SL society. I knew almost every notable characted from every strata, color and spectrum.

For instance, I knew the nephews of 'Nawala Nihal' and his brother Morley. In their heyday these guys thrived in Chandrika's inner circle and wielded powers rarely if at all given voluntrarily to the educated in a democratic society. As malefic as they may have been elsewhere, these boys were a benevolent presence in their own locale. But then they were outlaws, who had to be brought under control one way or the other. After the legal and law enforcement system had failed for many years to do that, the new 'expedited demise' system caught up with them. Nawala Nihal died in a hail of bullets in Narahenpita, mid day in a crowded place. No witnesses. His 3 other brothers also faded away quickly, as vigilante justice caught up with them.

No one in their right mind should applaud what is obviously happening to these uncontrollable criminal elements. They are the product of a brutalized societal psyche and will have to be cured by extreme means. Thus works natural justice.

When this dark episode of our history is over, we will simply flush it and fan away the stench. After all we've done these purges before and moved on. We can do this again with spectacular results and we will.

Its a purely Sri Lankan thing. No one else will understand.

May be my wishes were too high after decimation of LTTE. I thought everything will be fine after winning the war. May be it is too early to assess properly where SL is going.
Branding those who question/criticise certain unlawful incidents as traitors and blind followers as patriots do not go well with my wisdom of impartial thinking.
However, as Moshe suggested to Miserable; we should give more time to the present regime to organise things as required. Signs are not that pleasing but will wait and see.

The best hope of the majority like us is that the present outfit will turn out to be a Lee-Kwan-Yew clone in action in the long term. If you follow history, Lee also purged the unsavories to bring law and order to the pirates' cove which Singapore was for decades.

Our worst fear is that these boys will either by design or default last too long in power without being able to deliver on the economic front, say over the next decade or so.

If they turn out to be failures, the whole nation will suffer,since except for the Prez and Gota you can easily expect the others to be knee deep in sht and corruption.

Majority Sri Lankans are uncertain whether to like or dislike what's happening. As long as the out of control criminals are dealt with extreme prejudice, most would be apprehensively ok with it, hoping it doesn't make vigilanteism into a culture with a life of its own.

I am a US citizen having vested interests in SL. So it is worrisome that the essential ingrdient for democracy, a viable opposition, no longer exists in SL. And as long as the fashionably effeminates dominate the UNP, SL will continue to be on a path to a dire future, an almost dictatorship.

Trust me,even those who bravely defend the present administration in these forums are perhaps silently worried about what the long term holds for SL if a single party dominates our politics for too long.

In any case, it is unreasonable to expect a whole lot of improvements mere two months after the conclusion of the heaviest combat our nation has seen in her long history. We are also a nation which still has substantial numbers of people who wish her harm inside and outside her boundaries.

The shooting may have died down, but the fighting ain't over yet.

Agree 100% mate. This is the golden opportunity we were waiting for so long. SL will go down the gutter, If we are to miss the bus this last time. Look at Singapore and Malaysia; how they developed their respective economies during last 40 years or so. This will be our last chance for prosperity.
I am a dual citizen and living away from SL but have vested interest like you on well being of Sri Lanka.
I sincerely hope MR will change everything for good. After all our country is blessed by many celestial entities and things cannot go wrong anymore than this.

Yes in the long term we need a viable opposition, but a PATRIOTIC one able and committed to defend the country just like the current GOSL did.

Unfortunately, it is the very divisions along party lines that prevented the LTTE/separatist menace from being eradicated from Sri Lanka a very long time ago.

Unlike in many other countries, such as the UK and the US, our major opposing parties simply REFUSED to get-together IN THE NATIONAL INTEREST even when the country was being attacked and threatened with DISINTEGRATION.
If their PATRIOTISM transcended their party differences, a UNITY GOVERNMENT would have been formed and the problem solved in short order.

Part of the problem was that the the UNP is riddled with foreign influenced power groups, but yet they were a major party, holding power at critical times in the last 3 decades.

In my own case, I am not a die-hard party man; I am for whoever can best protect the country and foster the welfare of our people, that is my primary criterion. In my eyes, the UNP has utterly failed my ACID TEST of defending the country. Whatever anyone may say, the current GOSL has met and exceeded all expectations in that area.

As you point out, the fight to secure the country is not over yet. Now that the heavy lifting of winning the war itself is over, all of the familiar naysayers are gearing up to drag the country down and negate the gains.

If the division of power between two parties with nearly equal representation in parliament comes to pass again in the next few years, the internecine political warfare will begin again and all that has been gained in the last two years will be lost.

In the light of our past experience, a governing party with a substantial majority in parliament is needed to set the country right on the path to permanent peace and rapid progress. Whether that will happen under those conditions will depend on the character and integrity of the major political leaders who will set the tone and tenor of government. I have ABSOLUTEY NO CONFIDENCE that the Ranil Wickremasinghe led UNP can or will play a constructive PATRIOTIC role. In contrast, in the light of how they conducted the war in the last two years, I have much more confidence that a MR-led GOSL will do the right thing while making Sri Lanka militarily impregnable.

As you said, only three months has elapsed since the war ended, and people are expecting miracles and the immediate reversal of decades of war-conditioned misgovernance. Some of these people who are complaining and raising issues are Eelamists, others are political opponents jockeying for power ... we should ignore them, because they amply demonstrated the bankruptcy of their ideas when they were in power.

I join you in saying ... GIVE THIS GOSL TIME ... at least 5 years to set things right, and let us try to CONSTRUCTIVELY guide the government in the right direction, as PATRIOTS who want Sri Lanka to succeed beyond all expectations!

Dismissing UNP leader Ranil Wickremesinghe’s criticism that nearly 280,000 displaced persons had been held at camps in the Vavuniya region against their wish, Defence Secretary Gotabhaya Rajapaksa accused the Opposition of playing politics with essentially a security issue.

The Defence Secretary warned that LTTE terrorists masquerading as civilians, now taking refuge among the displaced, could resume attacks if the government gave in to internal and external pressure and released them. He said that there were a lot of explosives, arms and ammunition buried in the Vanni, particularly in the eastern part. Had they been given an opportunity to lay their hands on them, they would resume attacks, he said.

In an interview with The Island, over the weekend, he said that the opposition and a section of the press had conveniently forgotten that the LTTE collapsed a few months ago. He said that there had not been a single attack since the army had wiped out the LTTE leadership on the banks of the Nanthikadal Lagoon last May due to existing security measures. "If we loosen up security measures and bombs starts exploding, the same crowd will demand the resignation of the government," he said.

Wickremesinghe recently urged the government to expedite the release of civilians and also inform Parliament of the steps taken in this regard. Addressing UNP organisers, the UNP leader, flanked by his deputy Karu Jayasuriya and UNP General Secretary Tissa Attanayake, strongly criticised the government for detaining innocent people.

SLFP dissident Mangala Samaraweera, MP recently joined what the Sri Lanka Freedom Party (Mahajana Wing) called a collective of concerned citizens to make representations to Indian External Affairs Minister S. M. Krishna regarding Sri Lankan IDPs. The group urged India to pressure the Sri Lankan government to ‘demilitarise administration of all IDP camps and the rehabilitation process.’

The Defence Secretary said that after failing to throw a lifeline to the LTTE, the Opposition and a section of the international community had now launched a fresh campaign to exploit the IDPs situation. "This is most likely to be their last triumph card,"he said pointing out that recent statements attributed to various individuals and organisations had shed light on their plan.

He said that those who did not utter a word when the LTTE held over 300,000 people at gun point on the Vanni eastern front were now interfering with a legitimate government operation.

Recalling resettlement of the displaced in the Eastern Province as the army was battling to liberate the region, he said that a section of the international community and the Opposition strongly opposed Sri Lanka’s efforts to expedite the process. The resettlement of people in the East had been subject to UNHCR conditions, he said adding that the government had carried out the operation in keeping with the UN agency’s standards. Now that the LTTE had been wiped out, ‘international busybodies and their local henchmen’ were playing a different tune, he said. According to the UNHCR, the resettlement of people in a particular area should be preceded by clearing of mines and also provision of water and other basic facilities required to recommence their livelihood.

The Defence Secretary said that though some had forgotten, the government could not ignore that the Vanni population had been in the clutches of the LTTE for almost 30 years. He said that there could be many LTTE sympathisers and operatives masquerading as ordinary civilians accommodated at welfare camps. Acknowledging shortcomings at welfare camps, he said that President Mahinda Rajapaksa had wanted to provide the best possible housing facilities for the IDPs but those foreigners who now shed tears for them had opposed that. The President’s directive followed after his visit to a Chinese province devastated by an earthquake, he said. Although the President believed that every effort should be made to provide housing facilities, others opposed the move fearing an effort was being made to settle IDPs permanently outside their villages. Others had gone to the extent of claiming that the proposed housing units would be handed over to Sinhalese once the Tamils returned to their villages, he said.

Sarasota's John and Marian Morgan -- who fled the country in July to avoid federal contempt charges in connection with a get-rich-quick banking scheme -- have been arrested by authorities in Sri Lanka.

The couple were picked up on separate charges of running a fraudulent banking scheme, charges originating in the island nation off the southeast coast of India.

The Sri Lankan government is now reaching out to U.S. officials in an effort to figure out what to do next with the Morgans. The choices include extraditing them to the United States or prosecuting them first under Sri Lankan law.

Two weeks before a contempt-of-court hearing that was scheduled for July 16, the Morgans used their valid U.S. passports to fly from Miami to Switzerland, said Ron Lindbak, a spokesman for the U.S. Marshals Service in Tampa.

The Marshals Service learned of that flight only after U.S. District Court Judge Richard Lazzara ordered the Morgans' arrest at the contempt hearing. The couple had been summoned to the hearing to explain why they had failed to comply with an order from Lazzara to give an accounting of the money involved in the scheme and to bring it back to the U.S.

Two of the couple's alleged victims were delighted to hear about their arrest.

"When they bring them to court, I will come down there," said Jackie Allen of Moultrie, Ga., whose 84-year-old father, Jack Godbee, invested $150,000 with Stephen Bowman, an Omaha, Neb., man who is alleged to have pooled investors' money for the Morgans in the domestic portion of the scheme.

"I want to be sitting there -- and them look me straight in the face -- and tell them, you have basically killed my daddy and I want you to fry," Allen said. "This has just literally broken his spirit. For him to have to end his life like this, it is godly unfair."

Polly Atkinson, the lead U.S. Securities and Exchange Commission attorney in the case, said she was informed Friday afternoon of the arrest by the Washington, D.C., office of the Marshals Service.

"They got it from Interpol," Atkinson said, referring to the agency that facilitates international police cooperation.

The Morgans' presence in Sri Lanka surprised both Atkinson and the Marshals Service. "Last we heard they were in Switzerland," she said.

The arrest has created a flurry of phone consultations among federal agencies.

It is now up to the U.S. Attorney's Office in Tampa to determine whether the Morgans are to be extradited.

"It has to come through them," Atkinson said.

One possibility is that, having fled to avoid the civil fraud charges, the Morgans will return to face federal criminal fraud charges as well.

The SEC prosecutor has estimated that the couple took in at least $10 million from at least 100 investors.

But the SEC has leads into other investment groups that pooled other investors' funds on behalf of the Morgans, meaning there is a strong possibility that the losses could be even greater, Atkinson said.

A hint of that showed up this summer in Alberta, Canada, where a retired investor claimed in a lawsuit that he was defrauded of $500,000 by two separate Canadian promoters who convinced him to invest with the Morgans.

The SEC filed its civil fraud suit on June 11 against the Morgans; Bowman, the Omaha businessman; and Thomas D. Woodcock, Jr., of Rockwall, Texas, who also purportedly served as a middleman between investors and the Sarasota couple.

The government alleges that from April 2006 until recently, the defendants defrauded investors by offering and selling investments in a fictitious bank-to-bank trading program.

Investors were lured by the promise of monthly returns ranging from 14 percent to 70 percent.

Before their alleged Ponzi scheme fell apart, the couple were active on the Sarasota social scene.

They bought and occupied two consecutive bayfront homes in Sarasota and still own both of them, one in their own name and the other through a land trust.

Another of the couple's alleged victims, John Cartwright of Sacramento, Calif., works for the California Department of Justice. His job involves keeping track of the whereabouts of federal agents who are working undercover.

"That they were able to catch them in a place like Sri Lanka, that is amazing to me," Cartwright said Friday.

For roughly two years, the Morgans and Bowman stalled some earlier inquiries while bringing fresh money in the door, the SEC alleges.

Much of that was reportedly accomplished through a chatty series of e-mails written by Marian Morgan as the couple trotted the globe, telling investors they were working hard to get them their money.

Cartwright said he is "looking forward to the day when I can write to them in prison and and send my best regards from someplace like Hawaii and say, 'Too bad you're not here.'"

Not at all new. Nor are they politically motivated [even if politically motivated, that also is not new]. Each case has gone in right direction and so far actions have been swift.

Re: Maha Rajano

Cliamx in many minds have created a hype of raising MR to a pseudo-king state. It has no realistic meaning. Even MR seem not worried. MR will be yet another president, who'll be remembered for good deeds of his. In another few years Maha Rajano hype will vanish.

Re: One Team Show

MR seem to run the country under his team, disregarding the rest in administration, including MPs. This is primarily due to the inept and corrupted people who win pref votes and go to Diyawanna Zoo. Until we change these systems, the Presidents will be compelled to do this. Until presidents keep on doing this, the MPs will be more inactive and ineffective.

I do not like it happening, but I fail to see a way to correct it.

CBK gave powers to the ministers and we know how messy her time was. Corruption and nothing really got going. So MR must have learnt lessons from his predecessor.

Many ppl say, there SHUD be good politicians, but there seem not to be so. Most up and coming politicians are a level down compared to the generation of MR. Both parties lack any more charismatic leaders. Sajith is the distant call for any.

Re: One Party Show

Temporarily we support it as UNP went to dogs. If UNP has a leader whom we can call a leader, whom represent SL in any manner we will like a 60-40 power balance. But evil idiots like RW, Mangala, CBK has messed our nation so at this point we prefer UNP loosing everything, and realize the need for restructure.

It is also good if there is a third "normal" party. SL has two political parties and gunny bag full of ideologists. We need a third party. Last time one came with Rajaliya ppl, but it lost its way. If UNP breakaway can create a new party which is not supporting either UPFA or UNP, that's be wonderful.

I oppose to live under the rule of any other party of today than UNP or SLFP[UPFA]. I don't want my country to be restricted to some book or slogan worshiped by ideologists. Ideologist parties have never won significant votes anyway.

Re: Development

MR won war, although many said he won't. But war and development are two things. I will believe it when I see it happening.

So far MR is laying good foundation for development, yet we see nothing major getting started. For an ex he's started the irrigation projects probably after JRJ/Gamini stopped. We see some infrastructure like harbors roads power generation being constructed. Most such projects are BETTER finished compared to previous such project by GOSL. There maybe corruption but it looks like 75-25 in good way. Previously [sp under premadasa] it was like 20-80 for the corruption]

But we need industry to pick up. Nothing is happening so far. Govt is busy with finishing the remains of Pussycats, Resettlement and their political gains [yes they're humans]. A valuable time and effort goes awaste in talking about a devolution which I am failing to understand. We need to focus on development and I hope in couple of years we'll finish these topics and get there.

Re: Cost of living and Life in general

Better. Living cost skyrocketed in past few years, but now it has stabilized. Some items even came down. In SL terms today's life standard is much better than past. Just today some western agency reported that SL are the happiest Asian nation, which they conducted by surveying sections of society.

Main reason for Opposition to loose is that MR has not left any holes for them to capitalize.

None is over yet. We should continue in the same manner at least for another decade. But In my view the vigilance and security measures will be needed FOR EVER. We should understand the reality w/o being lulled by fantasy dreams and be good wishes.

I understand your frustation. My view on this is.

People need to have prospects of livelihoods to move. Many areas are yet to be cleared. Once cleared and when the developement work start many would move for work or business.

The PM has said more than 60% or so land in the area is government owned. It has to allocate some of the land for developement , residential activities. When this is done the land will have to be made available to people irrespective of their ethinicity.

The ythuru wasanthaya agricultrual program is one that can be used to settle people in that area. There should be food generation, job creation, schools. electricity and other infrastruture for people to settle down.

There also should be a mass movement within the people in general to migrate to those areas. Already people are moving to east for business purposes. Govt can't force people to migrate. Also climatewise they are not the best areas of the country to live in.

One thing government can do is to offer land from the areas to the landless people in all parts of the country such as Swarnaboomi program.

Other thing they SHOULD be doing is to call for information of people who lost property due to ethnic cleansing of LTTE and give them land plus compensation.

It is not easy to do it although we feel so. It has to be a long term program. Many parties have o encountered.

1. Innocent Wanni population [whoc shud not feel way too offended]

3. Opportunist TAMIL politicians [Who will try fishing on both above parties for votes]

4. Diaspora [who will further use such acts to create more horror films and spread them all over]

5. NGOs [who will find a new line to continue their BUSINESS in SL]

6. West [Will re-try to corner SL. Note that last time was a narrow miss]

7. Tamilnadu [who will again issue slogans and use it for their political campaigns]

8. India [it is essential that we keep good health with them, but surely they give rat's care for anything tamil as long as we take care of factor 7 above]

9. UN [Many parties trying to blacklist us with UN. We should not let that happen]

10. Settlees [How many will willingly go and settle in Kilinoshshi now? We need to create teh peaceful environment even for forceful integration]

I think the govt understands the need, as well as the calamity of the process. But to get something going it will take years if not for decades.

I hope you didn't miss the call for Sinhala settlements in North by none other than Karuna himself.

MR won the war because he has a brother who had hands-on experience in the issue. Unfortunately he doesn't have another brother who has good experience and passion on development.

He can easily win the next election. Ranil has said he is not going to contest (that’s what I hear). MR can get him to at least advise what is needed to be done. If not he should hire some people internally or from overseas.

You said govt is busy with the pussy cats. Govt can’t do all the development work. It should identify the work that needs to be down and invite local and foreign companies to finance and do them on BOO or BOT basis. Then government doesn’t have to spend money. They are for last 2 years trying to finalize the Colombo port BOT development.

Govt is trying to get maximum taxes. No plans for income generation. They have to offer incentives to local and foreigners to invest in manufacturing and other businesses.

They have suspended even the 'small miracle' program which was the first country promotion program for tourism after all countries in Asia have been doing that for over 3 years now. They just don’t get it.

We discussed before about education and lack of higher education and losing brains to outside and losing money to overseas universities. There are possibilities if private universities are allowed to be created the country can get foreign students. We also once discussed how to recover the costs of free education etc.

The other issue is job creation. Read my artcile on few things they should do if they are keen to create jobs.

Political speeches alone don’t make development. Needs vision, plans and commitment. Just like the war. SL will get investments just because the war is over. But I dont think govt has any plans or vision or ideas for agressive and planned push for mass scale development and job creation.

2. When there is no social net (i.e. a Dole), how do you plan to assure well-being of the employees who were terminated?

mate, it doesn't matter AT ALL!! they STILL HATE DSS for doing it. but it WORKED for SL!! (to the detriment of TE)

it was 100% successful. these settlements braved LTTE attacks, etc., etc. and now they are there making enough money.

remember there are 2 kinds of ppl. those who love SL and those who don't. so the plan need to work for SL ONLY. and it does. (of course it does NOTHING bad to anyone)

ppl have the right to live anywhere. it is merely on this right we work.

bringing ppl from another country ----> yes; that is TABOO. agree. otherwise it is perfectly ok.

the more we fear the VIOLENT DISLIKE for it by racists, the more it (the VIOLENT DISLIKE) becomes dominant.

it is not about sinhala colonisation. it is multi ethnic colonisation.

venturing into this like war in 2006. but that is the only way out. there is NO otherway.

i fully agree with those issues. hurrying up is not the way about solving them. this need meticulous planning and near perfect execution.

but there seems to be no plan for january 2010 and beyond.

1. one fine day, the EPC & NPC will pass a resolution declaring TE. ok, we can use violence and parliamentary and executive power and SUPPRESS them. but for how long????

2. how many times do we have to DISSOLVE PCs? as long as needed?? i don't think so.

3. what if the UN, US, etc. force SL to hold a referendum in N&E for TE or SL?? this plan to influence them is already underway and the question is when will it materialise.

4. as we have drawn parallels, this problem is VERY MUCH like a cancer. let me point out another aspect of this cancer. even if cured, unless 100% wiped out, it emerges when the body is weak.

similarly, when SL is weak politically and/or economically, pro-TE acts emerge again with success. the problem is it is TOO LATE at that time to do anything!! the anti-TE infrastructure must be laid beforehand.

this is why we need a plan ASAP. patriots fighting the tips of the iceberg that emerges from the water is not going to work. it is like war during CBK time.

they set fire, we douse it. again & again. exhausting patriots is definitely a part of their plan. they have nothing to lose.

the ATTRACTION (for TE) is still there. we have to take it away.

but LTTe activity started soon after these and now there are only abt 25000 Sinhalese left in vavuniya district...and abt 5000 in weli oya

eastern province was abt 33% sinhala 33% tamil and 33% muslim after mahaweli settlements...but war started soona fter mahaweli was completed....

also dimbulagala handuruwo played a huge role in doing this in the east....if he lived today he would have done quite alot after 2007...

agree with ian on the economic development program.

let me add a few more.

1. doing business should be promoted as a job.

2. cost recovery methods should go hand in hand with the consumption of resources. there is no point subsidising other than in a very few cases.

3. factor costs MUST be allowed to take over. meddling with these will be disastrous.

e.g. why the hell should ppl look for alternative energy sources when electricity is subsidised so heavily that it is prfitable NOT EVEN to consider other energy!!

e.g. the SL transportation systems will NEVER improve unless market forces are allowed to take over. if so, costs go up. sure. but there is no impact on the country in the long run bcos even now ppl are bearing it INDIRECTLY.

when transportation costs go up ppl tend to look for alternative trasport means.

SL train service has HUGE potential but why bother?? every additional service adds to the loss, so why add more trains!!

to compensate for vulnarable and critical industries, grant them a concession seperately.

4. GOBUs can do well in SL. but there should be STRICT laws and CG frameworks to control them.

5. co-operatives based on CAPITALIST concepts is another way forward. i strongly feel SL needs a more simplified partnership law and a business matters settlement court.

6. ppl should be educated to change their mindset on investments.

a father's business can be turned to a company with shares. then don't give the business to children, but give the shares. this way the business CONTINUES.

7. govt investments in developing the infrastructure for NEW BUSINESS DEVELOPMENT required.

but the sinhala population % in the north was never 15% and even in the east it never came to 33% (but did improve A LOT after the mahaweli program). i'm ONLY disputing the percentages.

i did hear about the resetlements. OK, good but there is no plan to do it beyond that. they were originally displaced from areas close to that.

there are simple things to start from.

e.g. in election law, ppl have the right to vote from the district they displaced from OR alternatively can vote in the district their IDP camps are.

in the jaffna district election results, along with electorates there is a section for "DISPLACED".

why the fcuking hell not register displaced muslims from jaffna under that??? leaving it to them won't do. what arseache they have to go through the hassle and register for that??? therefore they vote for puttalam candidates!!!

if they were registered to jaffna (where they belong), TNA could NEVER have got so strong. may well be even defeated in jaffna at some elections!! (LOW voter turnout is a permanant thing there!! lol!)

same goes to the sinhalas. have a national plan to register them to vote for the districts from which they were displaced.

with the low turnout from voters in the north/east, tables can be turned by the ethnically cleansed ppl!! this will teach the pro-LTTE MFs a good leasson that violence cannot achieve anything.

this will be the pre-colonisation appitiser!!

mind you, it is 100% legal, democratic and MORAL. violence cannot silence voters. BTW it is multiethnic colonisation.

i knw sinhalese families in vavuniya...even they have not gone to vote for the recent election.....in vavuniya

i gave a very rough figure abt the %...according to 1981 census...north pop is abt 8% sinhala...so i assumed...after mahaweli ..it became 15%


and in the east was 25% in 1981...after mahaweli..which even includes Dehiathakandiya in ampara...and some in trinco ...and dimbulagala handuruwo was contnously settling people...

but 1 mahaweli settlement in maduru oya batticloa district was called off due to severe international pressure...because the maduru oya settlemet nealry settled 40000 familes...if this wasnt called off sinhalese mayb the majority in the east


btw i dont think multi ethnic colonisation of the east will help...though it is good for the north...

The incident you refer to is different to actual downstream development on Maduru Oya.

The Sinhalese settlers were moved in an unplanned way (unfortunately) the Mahaweli Authority and Gamini Dissanayake to counter tamil families being planted by the likes of the Ghandian Movement (you can read about their involvement in some of tamil websites). However Thonda and etc kicked up a fuss and JR got rattled thinking that Gamini D was involved in a plot to overthrow him and there was an investigation. Some heads at MASL rolled but Gamini D escaped.

The problem with the hasty movement of Sinhala settlers into this area was that they did not have the basic facilities like shelter, drinking water etc etc. and this also led to restiveness among those moved.

Onething good came out of this incident. The JRJ investigation discovered the extent of illicit tamil settlements established by various tamil organizations like the Ghandian Movement helped by NGO's like Redd Barna of Norway

Let me first salute the fallen heroes of Sri Lanka who made a supreme sacrifice to defend the motherland from the clutches of terrorism.

We are indebted to them for generation to come for rescuing the nation from the grip of terrorism and protecting the territory and integrity of Sri Lanka.

When I was a young kid in school, I learnt the Great king of Dutu Gemunu who united Mother Lanka! Today we taste the same freedom & joy in our father’s land.

My best fear is that we will no more enjoy this freedom. The separatism comes in a different form. Now we have a daunting task to protect our motherland from India and the western world.

We defeated separatism and strengthened the political mainstream in the country.

I am sadden to understand that our politicians are conniving with India and western world to separate the country in a different way.

The proposed political solution through the 13th Amendment would foil the military victory and create a division in the country.

If the present Sri Lankan leaders are going to sing the same old song which was solely composed by India in 1987 for their own benefit, then the recent military victory would be a total loss and in vain.

The saddest thing for Sri Lanka is its worst neighborhood. India never helped Sri Lanka genuinely but always had its profitable motivation behind every move or planted problems in Sri Lanka for a short term or long term.

Can somebody forget what happened when Sri Lanka requested Indian help to fight terrorism? They always bowed to Tamilnadu pressure and twisted the hands of Sri Lankan governments. Thankful to Pakistan, China, Middle East and few other countries Sri Lanka could wipe-out the terrorism completely.

The government is planning to provide a political solution to the national problem through the 13th Amendment. India and several western countries are attempting to thrust upon us a proposed political solution against the wishes of all communities in Sri Lanka.

If the Thirteenth Amendment is to going to be implemented, then it is like the Ealam the terrorists were fighting for is granted and presented and that will be a most traitorous act of all time!

This is against my wish and wish of all the citizens of the country.

I will make a supreme sacrifice to defend my land against the politicos who ever they may be joining hands with India and western world.

I salute the valiant soldiers of the Army of Sri Lanka, emerging victoriously from their determined struggle against international terrorism. Please give me your full cooperation to protect our motherland.

vasudeva nanayakara is a great patriot and he would not have done what he has done without the President's consent and blessings. Chandrika gave away some of the most valuable government monopolies in Sri Lanka to her cronies for absolutely nothing (Lanka Marine Services, Waters Edge, and Insurance Corporation of Sri Lanka). Vasudeva has done an invaluable public service by getting the courts to return these to the general public of Sri Lanka.
Chandrika gave away prime UDA land in Colombo to het friend supposedly to build a gold course. He in turns sells it to an apartment developer. How much she made no one knows but quite a lot for sure. She similarly gave away Air Lanka to Emirates without any equity participation by Emirates. Well the country did not get anything but Chandrika did get something valuable (I am told in Egypt) I am sure the President would have kicked out Emirates completely except that the Government would end up in an international arbitration panel having to shell out millions in compensation.

This is what the International Crisis Group, a group of LTTE stooges, had to say about Vasudeva's action. Obviously he has done a lot of good.

This is a common fear or a reservation. Why would an employer abuse a productive employee? If you mean more hours by 'abuse', one can always have maximum number of hours per week etc. in the regulations. But if there is a need in the company the people will work extra hours and they will get paid for it. If it is easy to hire/fire then the employer can always get extra hands for peak periods etc, and hence no overwork situtaion. Basic concept is making labour factor more flexible to match other economies like China and other developing ones and most imporatnatly taking the fear and hassle out of employing people.



2. When there is no social net (i.e. a Dole), how do you plan to assure well-being of the employees who were terminated?

This is an issue when such a change is implemented. Thats is why I am suggesting to have the existing laws applciable to everyone who is already employed. Then only the people currently unemployed will be under the new one. If they are unemployed now getting a job even for a short period is good. It gets experience, exposure to work situs, and also money. GOSL can convert the EPF system to pay a allowance during period of unemployment. When this is implemented there will be unemployment insurance etc. coming. Also additional work force in the mainstream means govt get more taxes. Hence they can have a 'dole' system for people who gets employed in the new system and holds a job for 12 montsh or so.

There are many solutions to side problems. But the benefits are many. For starters the employees who are not in the main stream due to employers dont want the hassle, will come to main stream and giving additional payroll taxes to the government.

UNP strategy for Power

UNP, mainly RW faction, Mongal, CBK etc has employed a strategy which worked well in the past.

When RP was the president no one could imagine how to defeat him. The opposition was weak, with many factions. However, some media (ravaya, yukthiya etc) and INGOs continuously did their propaganda claiming that the government and ministers were corrupted. Finally, that helped Lalith-Gamini to break away. A new face was introduced and she won. Mongal and SB were behind some of these moves.

The strategy is to do the following continuously:

1. Whenever you see any thing wrong with the government/ ministers, criticize it. Get media propaganda in such a way that public believe once you form your government it will be free of such wrong behavior.

2. Create a lie which you like be a truth. Create your lie based on a truth. Propagate it. Then create a second lie based on your first lie. And propagate it. Do this continuously.

If government was silent about such propaganda some people may buy their lie. If government denied then they get free publicity, in large scale.

This is some what similar to what tamilnet.com did and during last few years.

This is what LNW is doing now. The di-ass-pora and other anti-GSL element love their punnakku dose. As tamilnet.com is out fresh punnakku LNW has become their new supplier. However, there is a difference; Tamilnet.com was leading the propaganda war, while war was there. They lost the propaganda war too automatically, when they lost the war. This is not the case for LNW. They can expect at "one day" the present ruling party to lose an election. Further, no one knows who is behind this website and they got nothing lose.

Thesawalamai is based on usages and customs. Custom begins where usage ends. Custom derives the force of intendment of law. A very long period of time, generality, uniformity and consistency are the determining factors for the maturity of custom as a source of law.

Anyone can buy land in Jaffna
The word ‘Thesam’ means ’state’ or ‘nation’; ‘walamai’ is ‘custom’. Thus, the term ‘Thesawalamai’ means ‘customs of the state or nation’. These customs were originated from the usages and customs of the Malabar Coast of India. ‘Thesawalamai’ is Dravidian in nature, unconnected with the Hindu law of India. It derives from Marumakattayan Law, which is the main source of Thesawalamai. With the passage of time it has been blended by the influence of Roman Dutch Law and English Law. It is the combination of patriarchal and matriarchal systems of societies existing side by side.

‘Thesawalamai’ was partly written in ola leaves and partly unwritten. The principles of Thesawalamai were handed down in the form of oral discourses from generation to generation. The Mudaliars who were learned in these customs were the then authorities to explain and interpret the intricacies of the principles of Thesawalamai.

During the Portuguese period, no attention was paid to the laws of the natives. The Portuguese did not codify the customs of Thesawalamai. The Dutch, anxious that ‘the natives should be governed according to the customs of the country if they were clear and reasonable, codified the Thesa-walamai law.

The Commander had the report translated into Tamil and delivered the translation to twelve “sensible” Mudaliars to revise it. They confirmed that the report conformed to the prevailing customs.

In 1708, the codification of the customary laws of the “Malabar inhabitants of the province of Jaffna” came into force.
The word ‘Malabar’ is held to be synonymous with the word ‘Tamil’. Claas Isaacsz in his foreword to the Thesawalamai Code refers to Malabar or Tamil inhabitants.
In 1806, Ceylon was ceded to the British Crown. By Regulation No.18 of 1806 the British declared that the Code of Thesawalamai, as collected by the Order of Governor Simons in 1706 shall be in full force and that “all questions between ‘the Malabar inhabitants of the Province of Jaffna, or in which a Malabar inhabitant is a Defendant’, shall be decided according to this Code of customs”.
In 1814, Sir Alexander Johnstone translated this Code into English and the English translation derives force in law as at today.
It is a personal law applicable to ‘Tamils with Ceylon domicile and a Jaffna inhabitancy’. It is not applicable by ‘reason of descent and religion to the whole Tamil population of Ceylon but an exceptional custom in force in the province of Jaffna, now the Northern Province and in force there, primarily, and mainly at any rate, only among Tamils who can be said to be inhabitants of that province’.

It is also a regional or municipal law in that it applies to all lands situated in the Northern Province irrespective of whether the land is owned by a Tamil, Sinhalese, Muslim, Burgher or by persons of any other race.

The Matrimonial Rights and Inheritance Ordinance (Jaffna) regulates the law with regard to property and Law of inheritance.
Thesawalamai Pre-emption Ordinance No.59 of 1947 regulates the law in relation to land affected by the law of Thesawalamai. This Ordinance came into force on July 1, 1948, repealing so much of the Thesawalamai and of the Ordinance No.4 of 1895.

The term ‘Pre-emption’ means that certain classes of persons enjoy a preferential right to purchase immovable property over others. This right of pre-emption under the present law is restricted to two classes of persons, namely (1) Co-owners and (2) Heirs in the event of the intestacy.

Accordingly, when immovable property is co-owned, one co-owner cannot sell the land to an outsider without first offering it to the other co-owner or heirs whether he is a Sinhalese or otherwise.

No provision of the Ordinance prevents him from selling the land to a Sinhalese. No reasonable man would refuse to sell his property to the highest offeror of consideration.

A pre-emptor has to be a co-owner or an heir of an undivided allotment of land. He can be a Sinhalese, a Tamil, a Muslim or any person of any other race. If an owner of an undivided land has conveyed it to an outsider, a pre-emptor has the right to institute an action to set aside the sale of an undivided share of the land on any of the grounds set out in the Ordinance.

No action is maintainable for pre-emption if the purchaser was one of the persons entitled to pre-empt or if more than one year has elapsed from the date of registration of the purchaser’s deed of transfer. It does not apply to property in respect of a share of a land which has been possessed and dealt with in divided lots by amicable partition among the shareholders, with each other’s knowledge and consent’. It also does not extend to an exchange of land.

The right of pre-emption gets extinguished by (1) transfer of property to pre-emptor, (2) waiver (3) release (4) forfeiture (5) frustration of the contract of sale (6) prescription - the right of pre-emption will not be available after three years from the date of the cause of action, (7) operation of law (8) merger and (9) any other restrictions by judge made law.

Thesawalame Law...contd

There is a general misunderstanding that Law of Thesawalamai or the Thesawalamai Pre-emption Ordinance gives exclusive right of purchase of immovable property in the Northern Province to Tamils of that province only and that the Sinhalese cannot have the right to buy any immovable property. It is a myth rather than a legal sanction: it is a misperception of the law of Thesawalamai.
An examination of the Law of Thesawalamai and of the Thesawalamai Pre-emption Ordinance would demonstrate very clearly that it is an erroneous thinking due to the lack of understanding, appreciation and tolerance of the applicability of these laws.

The Law of Pre-emption is expressly governed by the Thesawalamai Pre-emption Ordinance and not by Thesawalamai Regulation or the Customs of the Malabar Inhabitants of the Province of Jaffna, as collected by Order of Governor Simons in 1706. However, both these laws do not prohibit a person, whether, Sinhalese, Tamil or Muslim or a member of any other race from purchasing any allotment of land situated in the Northern Province.

The right to own or dispose any immovable property in the Northern Province is not restricted to Tamils alone as perceived by some of the politicians in the South. Neither the Thesawalamai nor the Thesawalamai Pre-emption Ordinance has any such provision.

A careful reading of the provisions of the Thesawalamai Pre-emption Ordinance shows that the co-owners or the would be heirs of the intending vendor of an undivided allotment of land, whether a Sinhalese or otherwise will have preferential right to purchase that share. If the co-owner is a Sinhalese, then, he will have the preferential right to purchase that share over others.
The widespread thinking that Sinhalese cannot buy land in Jaffna has no foundation at all both in fact and law. However, the legendary belief that the Tamils are invaders, infringing their exclusive right to the soil of Sri Lanka is deeply buried in the mind of some sections of the Sinhalese population. This wrong conception has created imaginary scenarios that Sinhalese are excluded from ownership of part of the land of Sri Lanka. Even well-educated Sinhalese will entertain fanciful emotional feelings that Sinhalese cannot buy land in Jaffna though it is common knowledge that there are thousands of Sinhalese and Muslims who are owners of land in Jaffna. Thus, the aforesaid apprehension becomes irrational and lacks any valid basis; yet, such fear has deeply pervaded some of the Sinhalese. To make things worse, political miscreants make this cry from time to time and disturb the harmony and tranquility of Sri Lanka.

It would be apposite to mention that neither the Dutch nor the English would have tolerated such anti-national law to remain in force. Great scholars like Dr. C.G. Weeramantry, Dr. L.J.M. Cooray, Professor

S.W.E.Goonesekera and others had contributed several articles on the law of Thesawalamai. Had there been any such obnoxious provisions they would have not hesitated to point it out: our Parliament would have long ago amended it.

So in the period of peace, let us clear our misunderstanding and distrust and refrain from acting on fallacies and emotional feelings. Let us stand united on a firm appreciation and application of one’s rights and obligations without jeopardizing or obscuring the rights of any person: let us by our unity bring glory and fame to the once ‘the pearl of the Indian Ocean’ - Sri Lanka.

today the t-law has become a PERSONAL law from a TERRITORIAL law. parts of the t-law applies to tamils from jaffna living in kamburupitiya (just an example) as well if they so wish to be governed by it. (obviously the territorial provisions don't apply).

Pushing to nominate Gen Fonseka as the next Prez will certainly earn the wrath of MR.

This could be a cute move by peelamist MFS to drive a wedge betweeen the united front against the LTTE. I would view postings by Fonseka2010 with suspicion. My most charitable assessment of Fonseka2010 is that he/she is either a Mangy Ponnaya or a Ranil Ponnaya supporter.

One must remember that without the political will, (withstanding all the external international pressures) and the finance for the armnaments, recruitment and training etc, none of this would have been possible. So due credit must be given to MR and GR for the achievements of the General.

Besides all that the General himself has said that he does not want to enter politics. As CDS he also wants to set up a failproof system so that anything like the LTTE will never have a chance to rise again.

CHENNAI: Though Viduthalai Chiruthaigal Katchi (VCK) is a part of the DMK-led alliance, the party will not compromise its ideology on the Eelam Tamils issue, said VCK president Thol Thirumavalavan here on Monday.

“Unarmed tigers of VCK from Tamil Nadu will continue their struggle for Tamil Eelam,” he said to a rousing applause of the thousands of party cadre who gathered for ‘Yelum Tamil Eelam’ conference organised on his 48th birthday which was being observed as 'Tamil Eluchi Naal' (Tamil uprising day).

Struggle against caste oppression and fight for the rights of global Tamils are the two policies VCK stands for, he said reiterating that the conference was a proof of their commitment to the two causes.

Driving home the point that his demand for a white paper on Indian government’s support to Sri Lanka during the ethnic war was not being fulfilled, he asked as to how the party’s stand on Eelam Tamils issue could be called anti-national?

“We are committed to the Indian sovereignty and integrity,” he said adding that VCK would not be a mute spectator when innocent Tamils were being killed.

Referring to a series of self-immolations in the State which started with one Muthukumar of Kolathur, whom he defined as a “black tiger” Thirumavalavan said that only the VCK cadre sacrificed their lives for the Tamil cause, while other parties were either reluctant or scared to even speak for the suffering Tamils brethren of Sri Lanka.

Separate Eelam was the only safeguard for the Tamils, he underpinned and said, “Prabhakaran will return and continue the war.”

Taking a dig at PMK, he said that it was popularly said that only an alliance including PMK would win polls, but it has proved wrong in the recently ended Lok Sabha polls.

blood donation delayed: VCK leader Thol Thirumavalavan dismayed his partymen by delaying a blood donation camp for hours together, which was organised as part of his birthday celebrations at M C Raja Men’s Hostel in Saidapet on Monday.

Though the VCK leader was slated to inaugurate the camp at 9 am as mentioned in the invitation, was late for over three hours.

When this reporter enquired about the arrival of Thirumavalavn, second level party leaders claimed that the former was on his way and will reach at any moment. One person said, the VCK leader was rushing, after he was informed that media persons were waiting for him. But, there was no sign for over three hours. After he reached the hostel at around 12.30 pm, 48 students from different colleges donated blood marking the 48th birthday of Thirumavalavan.

VCK banners pulled down

CHENNAI: In a surprising development, banners put up by the Viduthalai Chiruthaigal Katchi (VCK) on the occasion of party president Thol Thirumavalavan’s 48th birthday celebration here on August 17 were pulled down by the police on Sunday.

Party sources said every year the VCK chief’s birthday was observed as Thamizhar Yezhuchi Naal. This year, the theme adopted by the party for the meet was Ezhum Thamizh Eelam (Tamil Eelam will rise!). Digital banners prominently displaying the theme as well as photographs of slain LTTE leader V Prabhakaran were put by VCK activists across the State. On the eve of the meeting
on Sunday, the police either pulled down the banners or pasted strips of white paper covering the theme and Prabhakaran’s portraits.

Expressing perplexity over the “unilateral police action”, Thirumavalavan told Express on Sunday that the party activists had put up 2,000 digital banners in the city 10 days ago, while the wall writings had been there for nearly a month. “Many of the banners have now been torn down and the graffiti defaced,” he said.

When he contacted officials and demanded an explanation, they told him that it would not be “appropriate” to display either the Eelam theme or the LTTE leader’s photographs, Thirumavalavan said.

Maoists warns against Indo-Nepal deal

KATHMANDU: Nepal's former guerrillas, the Maoist party, Monday warned they would oppose any controversial deal between the coalition government and India during Prime Minister Madhav Kumar Nepal's maiden India visit that kicks off Tuesday, casting a shadow over the outcome of the five-day trip.

The communist leader is taking a jumbo delegation of over 60 people, including several ministers, secretaries, captains of industry and journalists, to the Indian capital Tuesday where he will meet his Indian peer, Manmohan Singh, president of the Congress party, Sonia Gandhi, and other Indian ministers and political leaders.

He will also pay a courtesy call on Indian President Pratibha Patil and convey to her the invitation extended by Nepal's President Ram Baran Yadav to visit the Himalayan republic.

The much-vaunted India trip however could remain restricted to a goodwill visit with little progress made in bilateral relations, given the current political turmoil in Nepal.

On Monday too, the Maoists, now the largest party in parliament, blocked the house, demanding action by the Nepal government against army chief Gen Rookmangud Katawal, whom they had tried to sack while they were in power; and against the president, who saved the general by reinstating him.

This is their second siege on parliament. After the fall of their eight-month government in May, the former rebels had obstructed the house for over two months.

This time, they began their siege again Aug 7 after their one-month ultimatum to the Nepal government expired. The continued obstruction could derail the scheduled implementation of a new constitution by May 2010.

The Maoists are demanding action against the army chief and the president as well as the dissolution of the government. They are seeking a new `national' government under their own stewardship.

Since they blame India for the fall of their government, the opposition party has now trained its sights on the prime minister's India visit.

Former Maoist minister Krishna Bahadur Mahara Monday warned the government that if it decided to take forward any controversial deal with India against their approval, they would oppose it.

Recently, India has shown keenness on expediting the Pancheswor multipurpose project, a 6,000 MW hydroelectric project that is the centrepiece of the controversial Mahakali Treaty signed between the two countries in 1996.

The Maoists want a review of the treaty. They are also opposed to the Nepal government signing an updated extradition treaty, trade treaty or new boundary agreement.

Given the Maoist opposition, the Nepal government would have a tough time trying to find any serious bilateral issue for discussion. Even if it does, the mplementation f the agreement is bound to run into trouble.

The prime minister has indicated his limitations himself. He has pledged to keep national interest at the centre of all bilateral agreements with India and not to undertake any major venture without the consensus of the parliamentary parties back home.

Five Bodo separatists arrested in Bangladesh

DHAKA: Five Indian separatists have been arrested from the wooded hills of Khagrachhari in Bangladesh's Chittagong Hill Tracts, an apparent indication of the growing cooperation between the two neighbours in curbing militancy.

Bangladesh Army and police personnel in a joint drive Monday arrested the five Indian nationals who they believe are members of the separatist National Democratic Front of Bodoland (NDFB) of India's Assam state.

Detained in a hilly area of Dighinala upazila in Khagrachhari, they were identified as Oadhish Narzari, 35, Pabitra Gowari, 25, Dhiren Khakori, 25, Jonatha Basumothari, 35, and Pradep, 30, the Daily Star reported.

Al Mamun Suman of Dighinala army zone and sub-inspector Rafiqullah of Dighinala police station arrested them in connection with illegal entry to the country.

Quoting the NDFB separatists, Dighinala Police Station officer-in-charge Suvash Chandra Paul told the newspaper that they had entered Bangladesh through a border with Tripura.

Bangladesh and India have stepped up cooperation in the last two years. It was earlier confined to criminals and has been extended to militants this year.

India has been alleging that several militant groups, among them the Bodoland activists, Naga separatists and members of the United Liberation Front of Asom (ULFA), are using Bangladeshi soil to stage operations.

India is seeking custody of the top ULFA brass who live in Bangladesh, where they have families and businesses while their cadres carry out operations
in Assam.

Dhaka, too, has been seeking to repatriate fugitives, both criminals and those who profess separatist causes.

It recently caught three Islamist militants that it says are Indian nationals, who were hiding in Bangladesh for several years and coordinating operations with Pakistan-based Laskhar-e-Taiba.

I don't think that we are going to see Devolution of Power to Separatists and Terrorists any time soon in India.

My advice to the GOI that they give more power to these groups, perhaps under the aegis of a 13th Amendment+++ to the Constitution of India, IS NOT BEING RECEIVED WELL AT ALL. In fact they get downright nasty when I mention it.

'Be prepared for fresh terror strikes'

Emphasising that cross-border terrorism was still a major threat, Prime Minister Manmohan Singh Monday warned that the government had credible information of terror groups in Pakistan planning fresh attacks against India.

"Coming to specific challenges, cross-border terrorism remains a most pervasive threat. We have put in place additional measures after the Mumbai terrorist attack in November last year. But there is need for continued vigilance," Manmohan Singh said at a meeting on internal security attended by chief ministers.

"There is credible information of ongoing plans of terrorist groups in Pakistan to carry out fresh attacks. The area of operation of these terrorists today extends far beyond the confines of Jammu and Kashmir and covers all parts of our country."

Calling for a coordinated response by both the central government and the states, the prime minister said more needed to be done to shore up intelligence systems and speed up the response to terrorist attacks.

"A well-calibrated coastal security scheme is being put in place. But we obviously need to do much more and we shall," he said.

"The challenges posed by asymmetric warfare and terrorism as also left wing extremism can only be met through new ideas and more resolute actions and determination. We need to be ahead of the curve if we are to succeed as we must."

While mentioning that the overall security situation in Jammu and Kashmir had improved in the past few years, with violence steadily declining, Manmohan Singh also spoke of "disturbing trends".

"There are some disturbing trends on the horizon. Levels of infiltration which had come down very substantially have seen a surge this year, alongside an increase in attempts at infiltration. The infiltrators appear more battle-hardened, better equipped, and in possession of sophisticated communications."

The prime minister, who addressed a similar conclave in January after the 26/11 terror strikes, said there were also signs of a revival of over-ground militant activities in the troubled state.

"Attempts are being made to link isolated and unconnected incidents -- such as those which occurred in Shopian, Sopore, Baramulla -- to create an impression of a ground swell of anti-national feeling. All this shows that efforts to disturb the current status quo have not been given up."

On Maoist violence, Manmohan Singh maintained that were indications of "yet more offensive action" by these groups.

"There have been heavy casualties inflicted recently on security forces by Naxalite groups. There are also indications of yet more offensive action by these groups," he warned.

"The problem of left wing extremism is indeed a complex one. There is a need for a balanced and nuanced strategy to deal with it. On the one hand the state should discharge its responsibilities and obligations and re-establish the rule of law in areas dominated by the Naxalites."

The prime minister has often described Maoist violence as the country's biggest internal security challenge and also made a mention in his Independence Day address of redoubling efforts to contain the rebels.

Referring to the northeast, the prime minister said there was overall improvement but the situation in some states, particularly in Assam, Manipur and Nagaland, remained problematic and worrisome.

"Assam and Manipur account for a disproportionately large number of violent incidents reported from the north-east, with the latter's share being as high as 30 percent."

While the communal situation in the country was more or less normal, Manmohan Singh singled out Maharashtra and Karnataka and said they needed to be more vigilant.

"States like Maharashtra and Karnataka need to exercise greater vigil to maintain communal peace. Karnataka, in particular, has witnessed a number of communal incidents during this year," he said.

"What is more worrisome is that the incidents were not limited to one or two districts. Like in other areas of internal security, we must all be on our guard against attempts by communal fanatics to accentuate communal tensions, disturb the peace and weaken the fabric of our inclusive society."

Sri Lanka to set up wind power plants in Northwest

Sri Lanka plans to set up two wind power plants in Puttalam in the northwestern region of the country.

Sri Lanka's Board of Investment (BOI) recently granted approval to four companies for investments worth US $ 68 million to set up the plants.

According to a BOI press release two investment agreements worth US$ 37 million were signed with Vidatamunai Wind Power (Private) Limited and Seguwantivu Wind Power (Private) Limited. The companies will set up two wind power plants at Vidatamunai and Seguwantivu in Puttalam respectively.

The two wind power plants will supply 20 megawatts of power to the national grid. The ventures will utilise 13 and 12 wind turbines imported from Spain at Vidatamunai and Seguwantivu respectively.

When the power plants are completed these will be the only wind power plants that are operational in Sri Lanka, BOI noted.

Anger swells over impunity in post-war Sri Lanka

Criminal impunity has become an increasing target of public anger in Sri Lanka since the end of a 25-year war in May, which exposed the extent to which the rule of law has eroded in the Indian Ocean island nation.

Sri Lanka, since it first battled Marxist insurgents in 1971, has had a history of criminals or members of the security services carrying out executions or torture with tacit backing from the nation's influential and politically-connected quarters.

But with the war no longer providing an excuse for acts motivated by personal, business or political reasons, public patience may be running out over impunity -- a challenge as Sri Lanka tries to reinvent itself as an investor-friendly nation.

A recent spate of violent incidents implicating police has spawned a wave of public fury and angry editorials -- rare under a government that in wartime was quick to brand critics traitors.

"The inescapable reality is that with normalcy or near-normalcy restored, the people are now opening their eyes to cases of police violence against ordinary people," the Sunday Island newspaper said this week.

"What we need now ... is to clean this clearly disintegrating system."

On Monday, a court remanded 11 police officers accused in the abduction and torture of a student over a dispute with the son of an influential police officer. The senior officer was transferred but not charged, a police spokesman said.

Last week, residents of a Colombo suburb stormed a police station and blocked trains to protest the killing of two men. Local media reported the men had heckled the girlfriend of the police officer in charge of the station.

The two victims' bodies were found the day after police arrested them, bearing bullet wounds and evidence of torture.

Seven officers including the officer-in-charge were arrested and remanded on charges of criminal links -- but not in the deaths of the two men. A police spokesman declined to comment, saying the case was under investigation.

Rights groups say the events are a risk to the emerging stability Sri Lanka is beginning to enjoy, after two Marxist insurgencies in 1971 and 1988-89 and the 1983-2009 civil war with the Tamil Tigers separatists.

"Perhaps the type of political system that has emerged in the country may require instability and chaos. For that, the police in Sri Lanka contribute enormously," said Basil Fernando of the Hong Kong-based Asian Human Rights Commission.

Fernando, a Sri Lankan lawyer, has long criticised Sri Lanka's record of letting the guilty go free.

The government has also declared war on the underworld, seen by many as a purge against gangs who helped the Tamil Tigers operate in Colombo or are linked to rival political parties.

Since the end of the war, police have repeatedly reported killing a criminal, giving the explanation that officers fired after the suspect tried to throw a hand grenade while in custody.

"The government had already taken action against the police officers who are guilty and we will not hesitate to take action against perpetrators' despite their position or seniority on the available evidence," said Lakshman Hulugalla, director general of the Media Centre for National Security. Good thing about the monkey dances is that it can sharpen the weapons bound to get blunt in the victory euphoria.

I prefer to see LEN spreading the bullshit, also UNP buying it. That is the only way for the message to get across as I don't expect many busy top brass to spend time on comments of this blog.

These are litmus tests that come from time to time and the nation can see it in pink or blue to recognize who's who.

Also it awakens the sleeping forces in rounding up these a*seholes. And it keeps nagging on the need to be further vigilant and alert.

On this particular matter of defamation on SF, I prefer to see a press conference from SF soon. It is just what we need right now to get few loose screws back in place.

All bigwigs gotta think of this more carefully. Few acts of police have dented the public support too. It is timely that we get things back on old ways.

Mahen said that arrest of KP and eventual crowning of his arch-rivals is the main reason for the possible hike in suicide attacks. That is true. KP had little more brains than the usually savage bastard children of Kali [who's the father? Elephant or monkey?]. Now we have Nediyawan who seems to be the perfect Monkey for the mafia movement. Sure he'll try to start his blood loving culture.

However even late pork curry Fatpig failed to batter the security network we had for Colombo in past two years. It wasn't that he didn't try, but million attempts were beaten and SLDF was always a step ahead than them. They reduced their intensity into microbombs [sashe version of 100grams] before fully diminishing. SLDF shud get its network working and eliminate the threat.

Note that there are two aspects of the security warning. Firstly it is truly a possibility. Secondly, many monkeys like Peter will be spreading the threats to raise fears and lower the morale of our people.

In my view the Peter clown is not anyone worthy to consider. He is not any bigwig in the pussycat movement. At most he may have been dragged to a camp in school days and was molested until he turned out with a weapon at hand. Lucky that Peter survived the cannon-fodder days to seek asylum. So do not consider his threats any serious.

In sinhala we call someone like Peter as "renna puke guu nathi moda ponnayek". Peter you can enjoy its meaning when you find it [and purists you can take a ride on my slum-dweller vocabulary]

I almost added those who were in that video link you gave me, one time (other than Mano Ganeshan). People like Rajitha, even though he is for 13th amendment, supported the war effort. Vasu on the other hand is genuinely trying to clean corruption with good intentions. Mr. Oneshot is just a doofus who parroted the party line once. What I felt is that those guys have not reached the levels of anti SL acts by others in the list. Virtually all of the honorees have repeatedly expressed pro-terrorist opinion or expressed blatantly pro LTTE opinion once (Example Boorubahu, some names at the bottom who signed a petition against us, and Sunanda Deshapriya who appeared in UN against us). However, we should keep our minds open.

It makes one wonder what happened to all the other ways of faster communication such as phone and email even if they find it hard to meet the leader due to reasons beyond my imagination. Now another similar joke is the starve to death of tamil politicos. We should first pay respect for Pussycat movement for they can organize starving programs better. We have seen pussycat supporters starving for periods close to months. And once a babe went on starvation for weeks on vitamins on a starve-NOT-to-death program perhaps to keep her shape. That is professionalism.

But look at how some tamil politicos starved to death. Mr Karunanidhi chose to starve to death few times in no where but hospitals and didn't really carry on with the program. He felt that his requests will be given so he himself gave up, whereas his Christmas eve was never delivered from North [pole]. Mr Thiruvalaman wanted to starve to death but after few days his close associates feared he'd die in starve to death so Mr Tirumalavan gave up listening to his pals. If not to die why starve to die.

Maybe some tamil politicos need starve-to-live programs as their pot bellies and oily chests must be brewing cholesterol.

This Thirumalavan chappie is a remarkable case. Even among the funny tamil politicos, Mr Thirumalavan is still regarded special. For an example read this article and see the funny tone which the writer uses to describe Mr Thirumalavan. Don't you feel that the article has the aura of a funny eccentric character like Mr Bean or Navjot Singh Sidhu?

Maybe Mr Thirumalavan is funnier even to be a tamil politico, perhaps someone like Peter the Clown.

Maybe, like our ultra intelligent pre-human species keep on telling us, we're not intelligent enough to understand the complex set minds of their advanced and superior species.

see, in colombo there are more tamil (col-north, col-west), more muslim (col-central, col-east), more sinhala (moratuwa, kaduwela, avissawella) areas. and that has worked good enough.

the same goes in the east.

but as time passes, ppl will slowly integrate to the extent THEY want.

but the nation has been saved. no MF with a separatist agenda can win in any district (at least substantially) and the tendency is towards multi ethnic politics.

We are proposing ETHNIC INTEGRATION to achieve a uniform mix of ethnicities throughout the country as the ultimate goal. Such a uniform demographic distribution would PERMANENTLY preclude both separatism, and the lack of empathy with, and understanding of, other communities that are evident in the North & East today.

The GOAL is DEFINITELY not to ethnically cleanse any region of any ethnic community.

As such, we should promote all communities: Sinhala, Tamil, and Muslim etc settling these areas and living together.

If one or more communities are not represented sufficiently in a given area in comparison to the national average, we should promote the settlement of those communities.

In any case, there should be no prohibition of any person settling down where ever he/she wants in the country, subject only to his/her ability to purchase property under the ordinary laws of the land.

electorate is the SMALLEST unit of measurement. power should be devolved to the SMALLEST responsibility centre.

These days almost all the floating voters JHU, CWC, some others and even some UNPers are with MR. Thus the SL nationwide vote distribution may look like;

TNA 2.5%
SLMC 2.5%

IF UNP wants to win PE they need 50% + 1 vote (without counting second preference). Thus the nationwide vote distribution UNP expect may look like:

CHENNAI: Seeking to virtually challenge the State government on its ‘no support to banned outfits’ notification, MDMK supremo Vaiko on Tuesday appealed the people of Tamil Nadu to name the newborn babies as Prabhakaran.

Addressing a function organised by the Periyar Dravida Kazhagam (PDK) to honour its cadre who had been imprisoned under the National Security Act here, Vaiko attacked the Tamil Nadu Government’s announcement that Unlawful Activities (Prevention) Act, 1967 would be invoked against those speaking in support of banned organisations (read LTTE).

“Will the State Government invoke the act and arrest all the parents if they prefer naming their children as Prabhakaran,’’ asked Vaiko.

Referring to a Supreme Court judgment, Vaiko said expression of opinion in support of banned organisations was not illegal.

“Action can be taken only against those who resort to violence or indulge in the activities of the banned organisations,” he said.

The MDMK boss said Chief Minister M Karunanidhi had raised the very same point in the State Assembly in the past. Calling Chief Minister a traitor, Vaiko said: “At a time when Anna centenary is being celebrated, Tamils in Sri Lanka have been annihilated in front our of eyes.”

agree with the DIVIDING effect.

but there is a BIGGER thing at play in the next PE.

the north has close to 1,300,000 registered voters. the bulk of it are actually inflated. the true number should be half of it.

1. that gives a MASSIVE benefit to those who MAY impersonate or rig votes in the north. they can win the election even losing the other parts of the country.

2. voters register must be verified against physical presence of ppl. valid excuses needed for absentees.

3. even if only the real voters vote, that will give a HUGE boost to ONE candidate. he/she can win even losing the other parts. still it cannot bridge the MR-whoever-it-is gap. the problem arises IF MR is not there.

4. so far they have not given a HUGE difference in vote to one main candidate against the other. but it is possible.

5. some "creative work" will be needed IF this is likely to happen. perhaps those voters may require a memory boost which means a few planned "skirmishes". road closures, curfews, posters, bomb blasts, etc. may be required.


on fixed votes....

may be true, still. may be not. remember MORE voters of UNP left SL than pro-SLFP voters. this trend is continuing. it also strengthens the SLMC, CWC. when these 2 get TOO LARGE, they split.
