We have received credible information on the arrest of two individuals, one a middle aged man traveling on a non-Sri Lankan passport at an undisclosed location in Bangkok in a joint stint launched by Thai and Sri Lankan authorities. The travel documents and said identity confirms with an alias of LTTE operative Shanmugam Kumaran Tharmalingham.
The man was carrying travel documents both under his own birth name and under other aliases at the time of arrest. A group of Sri Lankan officials is expected to fly the said two individuals to Sri Lanka shortly. Please await further information as it is made available.

The Channel 4 video seems to be an omitted part from the "My Daughter the Terrorist".
That movie also has the background location similar to the place of execution.
What I ask from Mr. Douglas Wickramaratna is to file a case against Channel-4 in the UK courts against fundamental rights violation and seek damages GBP 25M.
This will sort the Channel-4 out, and make them learn not to deliberately air fake videos discrediting Sri Lanka.
NO LTTE- I agree with you Channel 4 should be sued in the UK courts for libel and defamation.
However, i doubt this will ever happen as i'm sure GOSL and its defense establishment will be keen not to be under scrutiny under a British Court.

A report for the European Union into Sri Lanka’s fitness for preferential tariff treatment is unfavourable
(Septeber 03, London, Sri lanka Guardian) RARELY has a government soiled its reputation as dramatically as Sri Lanka’s. In recent months President Mahinda Rajapaksa’s regime has won a war and lost the love of many allies.
Its alleged wartime and other abuses make a grim catalogue: thousands of Tamil civilians allegedly killed by army shelling during the rebels’ last stand; scores of Tamils disappeared; nearly 300,000 Tamil war-displaced callously interned; murder and intimidation of journalists—including J.S. Tissainayagam, sentenced to 20 years hard labour on August 31st for criticising the army’s tactics (see article).
There is not much high-minded western countries—to whom Sri Lanka once looked for aid money—can do about this. Mr Rajapaksa has found alternative friends, in China, Libya, Pakistan—and others, who recently scotched a European effort to launch a war-crimes investigation into Sri Lanka. But the Europeans do have one wrench on Mr Rajapaksa’s government: a trade concession known as “GSP Plus”. This boon, which has helped make exports to the EU the country’s biggest source of foreign exchange, worth $3.3 billion last year, is up for review. Judging by an EU-commissioned report on Sri Lanka’s compliance with its terms, which include stipulations on human rights, it can kiss the concession goodbye.
The confidential 130-page report, which has been obtained by The Economist, concludes that Sri Lanka has failed to honour important human-rights commitments, and is ineligible for GSP Plus. Widespread police torture, abductions of journalists, politicised courts and uninvestigated disappearances have all played a part in creating a state of “complete or virtually complete impunity in Sri Lanka”. The internment of the Tamil displaced, which the government claims is necessary to weed out the last Tamil Tiger rebels and to protect them from munitions left in their fields, is “a novel form of unacknowledged detention”.
A final decision on GSP Plus is not due until October. The government, which barred the report’s authors from visiting Sri Lanka, called the study “outrageous” but seems resigned to losing the trade preference: a senior official in the trade ministry, S. Ranugge, admitted: “GSP Plus is very unlikely.”
Perhaps this does not bother Mr Rajapaksa: defying the West is part of his appeal. Anyway, his minions recently secured a $2.6 billion loan from the IMF. But as an indicator of where one of Asia’s oldest democracies may be headed, it should worry Sri Lankans, and all who wish their country well.

This editorial states, "[J. S.] Tissainayagam's main crime seems to have been writing two articles in the now-defunct Northeastern Monthly magazine in 2006 and 2007 criticizing the Sri Lankan persecution of the Tamils."
Really? Even a cursory scan of the Sri Lankan media will reveal an abundance of articles critical of the Rajapaksa government.
It seems that the National Post is exercising its "press freedom" by calling Mr. Tissainayagam a journalist while putting aside the fact that he was on the LTTE payroll. I also note that the editorial made no mention that Mr. Tissainayagam portrayed the Oxford-educated Tamil politician Lakshman Kadirgamar as a traitor. He was Sri Lanka's foreign minister at the time of his murder by the LTTE in 2005.
For nearly a quarter-century, the Western media has paid little attention to LTTE atrocities against Sri Lankan Tamils, Muslims and Sinhalese. Meanwhile, the LTTE jammed hundreds of millions worth of ordnance procured with Western funds down the throats of Sri Lankans. Considering that the World Bank's estimate of the per-capita gross national income of Sri Lanka is about 4% of that of the average Western country, one should easily fathom the devastating effect on the country and its people.
That Mr. Tissainayagam, a "quiet, slight" terrorist lackey, was the first to receive the Peter Mackler Award "for courageous and ethical journalism" is a fitting testimony to the standard to which journalism has fallen. Walter Duranty would have been impressed.

The Channel 4 too has a history of broadcasting distorted and misleading news about Sri Lanka. Specially, Jonathan Miller is doing his best to settle what appears to be a personal grudge he has with Sri Lankan people at the expense of his professionalism. It is interesting to watch how Miller has filed stories about Gaza and Iraq. There are few that can be easily goggled.
Even his story about Gaza after 22 days of bombing by the Israel in February was free from adjectives he often uses in his stories about Sri Lanka. He saw no "brutalism" in the bombing that many reliably claimed to have killed over thousand civilians including some 400 children, he found no "brutalized" people there. Moreover, it was not "shocking" for him to see the UN headquarters in Gaza bombed with white phosphorus. Nothing is "callous" or "sickening" about conflicts in Iraq, Gaza or in Afghanistan for Miller or for the Channel 4. This hypocrisy is of course common to many other similar media and is no longer a secret to the world.
It should be noted that it was this Miller who boastfully claimed the credit for having the first "face to face" interview with Interpol's wanted terrorist Kumaran Padmanadan alias KP few months ago. Unfortunately for Miller, the criminal that he ridiculed Sri Lankan government for being unable to nab for 25 years is now with Defence Ministry. KP is certainly spilling the beans and has given a very important place to the Channel 4 affair and Miller connection in his confessions. Though not much information on this is permitted to be revealed at this stage, it can be said with great responsibility that LTTE had made Channel 4 one of its propaganda allies.

Until very recently we had foreign expchange reserves equal to 1.5 months of imports. Non-alignment helped Sri Lanka in the past and it is commendable that President Rajapakse has chosen this path in his foreign policy.

I have been working to get an international law firm to look after SL's interests and sue the fucking pants off such as the Ch4 when the fuckers step out of line and defame the nation of Sri Lanka and her people...
However, this is not a meager task and it needs funding and support from the powers that be in SL....so far the interest has been some what lukewarm (as they like react rather than proact)...but I am going to go at it again with a different funding model this time....as I have commitment from many expats all over the world who have told me that they are willing to provide a "monthly subscription" for the upkeep of such a vanguard for our nation...
and hopefully then I am hoping the powers that be in SL will have the appetite to join in and make good on the balance of any shortfall...stay tuned.

They were an entire INDUSTRY all by themselves, that was ABOVE THE LAW and was PROTECTED by the foreign governments and agencies.
These Foreign Organizations soon started to TERRORIZE the GOSL itself, usurping the sovreignty of Sri Lanka, and DICTATING policy within the country. If any GOSL did not comply, various ambassadors would begin calling, threatening various PUNITIVE sanction to bring the GOSL to heel. Even as we speak this continues with the EU threatening to withold GSP+ trading status from Sri Lanka.
ALL OF THIS MUST BE ENDED, and Sri Lanka has to RECOVER its INDEPENDENCE from this TANGLED SPIDER WEB of Foreign Governments, iNGOs and NGOs. We must THROW OUT as many of these iNGOs intefering in Sri Lanka's internal affairs.
A national policy has to be established to EVALUATE & DENY ENTRY by iNGOs into fields where they have NO LEGITIMATE ROLE to play except for DESTABILIZING and UNDERMINING the nation. That POLICY must be backed up by a government department maintaining strict oversight of iNGO and NGO activities.
To enable the achievement of this goal, Sri Lanka MUST forge a wide spectrum of international alliances: diplomatic, economic and military, to inoculate itself against these kinds of INFLUENCES and to REGAIN our independance.
President Mahinda Rajapaksa's recent trip abroad to develop and cement alliances of this kind is an important step in that direction.

I am not asking GOSL to sue Channel-4, but anyone with Sri Lankan residency who permanently lives in the UK. News Agencies have been sued in the past by general public for mischief, and have been successful.
Tissanayagam was not convicted by MR. He was convicted by the Courts. The courts have followed due process.
Sri Lanka has not gone and criticized UK/USA or any other court decisions.. and those countries should show the same respect for country laws and court decisions.

The Tamil underworld operates totally separately from LTTE and actually the LTTE was only one customer of them.
The St. John fish market to Kathiresan St, Pettah Wholesale trades, Sea Street and many areas are still run by the Tamil underworld.

It reminds me the fact of using Children for fund-collection.
There are large number of organized criminals in Sri Lanka who uses children to collect bogus funds.
It works like this. They dress these kids up with good clean clothes and bring them to religious public places i.e. the car park of Kaluthara Bodhiya, Bellanvila Temple, Kelaniya Temple etc with one or two of their supervisors.
These kids were given bogus ticket books, and ask them to sell these tickets to the public. Usually the ticket books are priced at Rs. 10.00 to 20.00, and designed around a story like treatment for a kid needing bone-marrow transplant, or kidney transplant, etc etc.
These kids have been taught to be pushy as well as be extremely polite at the same time.
This is a huge racket that is well organised. I have heard that the persons behind these rackets have become multi-millionaires with amazing amounts of wealth.
It is time for the Police to look into this racket too, as it is widely being practiced.
I recently went to Kirinda Vihara, and the same thing went on there too. It was pushy mafia run by a man call "Mala Malli". Everyone supposed to buy a ticket from the girls, and if not you are not even allowed to park.

EU (and europe) is ethnically divided. TF they prefer (than US or canada, etc) to keep the "ethnic balance" in a region. it can strike a chord.

HNB Bank's net profit up 76% YoY in 2Q2009

Hatton National Bank s (HNB) net profit has risen by a sharp 76% YoY to LKR996.4 mn in 2Q2009 whilst lifting the cumulative 1H2009 net earnings by 32% to LKR1,708.2 mn. The net profit growth in the latest quarter has bettered our forecast and was driven by net interest income growing by 22% YoY and a 32% YoY dip in total provisioning cost.
HNB was incorporated in 1888 and since then has grown to become the second largest private sector bank with an asset base of around LKR275 bn and an island wide branch network of 178. The bank already has a relatively strong presence in the recently liberated Northern and Eastern provinces of the island and also boasts the largest low cost deposit base amongst the private sector banks. HNB has been fairly aggressive compared to its peers and is expanding both its corporate and retail loan books on the back of a strong deposit base whilst maintaining a loans to deposit ratio of around 90%. Further due to the stable low cost deposit base HNB s net interest margin has been approx. 50 bps to 75 bps above peer average. HNB despite being aggressive continues to be well capitalised with a Tier 1 CAR of 8.5% and Total CAR of 10.6%.
However the main negative of the bank has been its lateness in technology adoption and also the average performance in Non Performing Loans (NPL). However since lately HNB has made remarkable inroads in technology adoption and now offers real time ATM networks, internet/sms banking etc. The bank would also shift to a single IT platform in 2010E whilst phasing off the non compatible two IT platforms which are presently in use. Based on management reports, circa 64% of operational losses are due to drawbacks in delivery, process management and system failure, which we believe would be markedly reduced in future with the introduction of a single core banking IT platform. With regard to risk mitigation HNB has strengthened its credit risk analysis function and has managed to bring down the NPL levels to around the industry average. Further HNB had fully provided for a LKR2.6 bn bad loan (which was a resultant of the borrower going bankrupt) in 2006 and is presently awaiting to collect compensation in lieu of the land and building which was initially placed as collateral. However the recovery could be based on a phased compensation plan since the government has taken over the properties of the bankrupt borrower and compensation would be more so based on the terms put forward by the government.

I think I am the one who suggest this first in this blog. Even at that time I mentioned that it really doesn't matter whether they did it or not, but it is good for publicity.
But I still believe LTTE had a hand somewhere in it and some high ranking Pak. officials are complicit in this attack.

CHENNAI: Charging that 27 Indian politicians were on the paylist of the banned LTTE, Janata party president Subramanian Swamy on Saturday urged the Central government to appoint a multi-disciplinary monitoring unit headed by the CBI to investigate into the issue.
Addressing a press conference here, Swamy alleged that the LTTE had been funding some political parties and their leaders in Tamil Nadu.
Swamy said he had written to Prime Minister Manmohan Singh in this regard. “I have obtained a list of 27 such Indian politicians from reliable Sri Lankan official sources,” he said.
On claims that electronic voting machines (EVMs) were tamper-proof, Swamy said he was not against their use but wanted better procedures wherein the voter could have a documentary proof that his vote had reached the intended candidate. Swamy said he would prove the tamperability of the EVMs to the Election Commission soon.
Answering a question on India’s ties with China, he called for a two-pronged policy wherein India should focus on strengthening the defence forces matching Chinese military and at the same time pursue a foreign policy paving the way for friendly relations in the interest of global stability.

This is not going to happen, at least in the near future, due to:
1) The overwhelming SL population is today happy with this GOSL...and the mutineers will have a hard time running the country post-mutiny
2) "Mother India" will not allow it. She will intervene in SL in a blitzkrieg fashion that the mutineers will not know what hit them. One thing to stay off the SL war - i.e. to stay off and let SLDF finish off the LTTE mommafuckers and make a few calls for "restraint" now and then to appease the ToiletNadu - but it is totally another to let a military junta run SL and India will step in with the excuse that she is coming to safeguard the Tamils in SL.
Now it is true there are some dissatisfied old-fart deadwood SLDFs (who have been bypassed for promotion due to lack of merit for example) and some die hard RW-Huttha supporters too who would love to see the end of this regime....but they are a tiny minority and do not carry enough popular support in the nation. Sure they might have the hypocritical west's support, but without India's countenance, even that is highly unlikely.
What we need to keep in mind is that secretly India is VERY HAPPY that the LTTE is no more and "tamil separatist" agenda has been dismantled in SL as it would have been the precursor to such starting in ToiletNadu...no, it is unlikely India will allow a military coup in SL to bring forth a SL regime that we restart that again.

When you say 'the solution is "home-grown"' you trickily skip the western definition of "solution" and also the what the "question" is. Development is indeed a model and when MR says 'rejects western model' he clearly identify that the present model is 'western'. Nothing is 'absolute', (not even 'science', yet alone the rest) and every thing is 'relative'. However, western knowledge system supplemented by economic and military power is so powerful and public think (or convinced) that relative terms introduced by west are absolute.
An easily understood example is 'development'. SL is not 'developed' and that's according to 'western measurements'. It will be really hard people to convince that the term 'development' is a relative measure subjected to western norms, under western education system and highly influential western mass media. It will be even harder to come up with accepted alternative model.
The leaders of this 'west' are USA, UK, France, Germany, Auz, Canada, NZ, Japan and other nations follow them can easily be seen. Only a few nations could avoid being followers of west and come up with their own models in any field. These are strong countries - strong in the sense; population, natural resources, culture, and ideology. Examples are China, India, Pakistan, Russia, and Iran. (You can see how and up to what extent each country s correlated to above mentioned factors; But the common factor is leadership and determination of people.)
SL is the newest to join this group as SL proved their own model in defeating terrorism. We are yet to find a way in economic model.
It should be clear when you read western media/ di-ass-pora comments, now they group SL together with this "bad nations". Time is over for SL being their "good" nation. I am positive that MR and his team are well aware of what they do. But what about the people?

ppl want short term economic incentives TO DO ANYTHING. under whatever development model. they want to see that they can buy more, enjoy more, etc.
TF govt's economic development plan should diliver these in the short and long terms.
the old model of "years of hard work and sacrifices but not much economic rewards in the short term" is a failure in SL. this cannot be changed. and no point blaming the ppl.
there are many methods to bring both short term and long term development. rapidly expanding the agri sector, fisheries sector is one EASY and VERY VERY effective way forward.
1. ensures food supply. (the biggest problem is solved)
2. ensures unemployment IN THE MOST VULNERABLE SECTIONS of the society is taken care.
3. minimum govt repeated investments. most investments in these sectors are private.
4. ppl become rich. yes, rich enough. after that they invest. a garment girl or a EPZ worker will never become rich.
SL already has world's second highest yield per hectare in rice production. it cannot be practically increased radically.
what we can do is, increase the cultivated area and reduce cost. when area increases, cost per 1 MT reduces. the same goes for other crops.
there is enough land in the north and enough water.
having handled the most critical problems of basic food, unemployment of BIGGEST potential trouble makers, govt should develop industry.

You have drawn our attention to a very important incident .. that should be used fully to expose the DOUBLE STANDARDS of these western countries that habitually criticize Sri Lanka, but IGNORE or JUSTIFY their own transgressions.

In this instance two things are VERY CLEAR:
1. If the Germans were willing to risk more of their troops dying from dealing with these problems using ground troops, then "collateral damage" to civilians can be minimized .. but they want the easy way out .. bomb from air.
Ultimately, this war WILL NOT BE WON by airstrikes and a few hundred thousand ground troops (from all countries including Afghanistan). They will have to commit well over 500,000 troops to dominate and control the land, as the SLA had to in Sri Lanka.
2. On the other hand, it is also a CERTAINTY that the Taliban is EXPLOITING the situation and co-mingling their cadre and civilians to discourage air strikes, and are exploiting any deaths that do occur .. passing off ALL DEATHS as those of civilians .. just as the LTTE did in Sri Lanka.
This is quite a nice pickle for these bleeding heart critics of the SLA now find themselves in fightiong a war in a far off country where they really have no real stake.
3. The LESSONS that THESE western countries should LEARN AS SOON AS POSSIBLE are,
A. LEARN to FIGHT this kind of war understanding that the enemy is USING PROPAGANDA as a MAJOR WEAPON to UNDERMINE and DESTROY their WILL TO FIGHT.
B. Acknowledge DEFEAT and GET OUT as soon as possible if they are not WILLING TO COMMIT the NECESSARY RESOURCES and ASSUME THE RISK of having to PAY THE PRICE in BLOOD and TREASURE to WIN. If they are not willing to PAY THE PRICE, they will not be able to win this war.
Ultimately, ONLY the SONS OF THE SOIL .. the Afghans themselves .. will be willing to pay that PRICE .. as we did in Sri Lanka .. and the Vietnamese did in Vietnam.
The foreigners should turn over the war to the Afghans and leave Afghanistan, but support those who support the government with arms and money. Whether the Afghans are willing to fight for their own freedom should determine who wins. NO ONE ELSE CAN, or SHOULD, decide that issue for the Afghans.

BERLIN — Germany defended itself Monday against growing international criticism of a devastating NATO airstrike that German forces in Afghanistan requested on Friday, laying out a detailed version of events leading up to the attack.

The number of dead civilians is still in dispute, with German officials saying no civilians or few had been killed. But Afghan Rights Monitor, a national watchdog group, said that based on its interviews with villagers, 60 to 70 villagers had been killed, The Associated Press reported. The A.P. also noted that a spokesman for the provincial government, Ahmad Sami Yawar, said five of the dead were civilians.
The episode has been a debacle for NATO forces at a time when efforts are under way to reduce civilian casualties from airstrikes. It has also exposed rifts between allies over different approaches to fighting the war in Afghanistan, and has added to pressure on Chancellor Angela Merkel’s government ahead of elections on Sept. 27.

At a news conference on Monday, a Defense Ministry spokesman, Thomas Raabe, laid out the German case in an unusually lengthy account of the surveillance and intelligence that led a German commander on the ground to conclude that armed Taliban were near the tankers and that the fuel trucks could have been used in an attack on German or Afghan positions.
Mr. Raabe said the decision to bomb the tankers was based on surveillance by a B-1B bomber and then by a pair of F-15 fighter planes, as well as information from a reliable Afghan informant and an additional intelligence source “that we cannot speak about in public.”
He added, “We stand behind the decision, and we continue to consider the military strike correct.”
Yet Defense Minister Franz Josef Jung, who has come under the harshest criticism here in Germany, backpedaled Monday from his assertion that only insurgents were killed in the attack. He told the German television network ZDF that he could no longer rule out the possibility that there were civilian victims as well, though he continued to insist that “the predominant share were Taliban.”
The episode has brought to the surface long-simmering tensions between NATO allies. The United States and Britain, for example, have griped that Germany was shirking its share of the fighting.
German leaders, for their part, believe that their efforts have been considerable in light of the widespread pacifism among Germans after World War II and the opposition of the German public to a continued military presence in Afghanistan. Germany has about 4,200 troops in the country.
When Gen. Stanley A. McChrystal, the commander of the American and NATO forces, visited the site of the strike on Saturday, he asked Col. Georg Klein, the German commander, why forces from the Regional Command North had “not come here quicker,” news agencies reported Monday. The general recently tightened the rules on airstrikes, saying that if civilians may be in danger, troops should move in on the ground rather than call in an airstrike.

Rear Adm. Gregory J. Smith, a spokesman for the United States and NATO in Afghanistan, said the delay meant that insurgents could come out with their own version of events before all the facts were known, news agencies reported.
NATO has ordered an investigation into the bombing.
“We hope that the continued investigation will prove that this operation was correct,” Mr. Raabe told reporters on Monday. “We continue to consider it militarily necessary and correct, and that it will prove what we have said up to this point.”

A delegation of Sri Lanka's major Tamil party, Tamil National Alliance (TNA) met Sri Lanka President Mahinda Rajapaksa today at the Temple Trees for discussions on the Internally Displaced Persons (IDPs).
The TNA delegation was led by its leader and Trincomalee District Parliamentarian R. Sampanthan. The main issue at the discussion was the resettlement of the IDPs in their original homes in the Wanni before the rainy season.
Earlier the government said the TNA requested a meeting with President Rajapaksa and he agreed. This was the first meeting of TNA with the President since the elimination of LTTE from the North in May.
TNA members of the delegation included parliamentarians Mavai Senathirajah, Suresh K. Premachandran, Srikanthan, . Sivasakthi Ananthan, I.M .Imam, Ms. Thangeswary Kathiraman.
Ministers Susil Premajayantha and Rishad Badurdeen, parliamentarian and Senior Advisor to the President Basil Rajapaksa, President's Secretary Lalith Weeratunga, Governor of Northern Province Major General G. the longer and harder the afghan war goes, the better for us.
My take on German attack was that I stand by the Germans, in principle.
I agree there is possibility of foul play, and I'm sure they give rat's care to civilians. But war is war and civilian casualty is not 100% avoidable. In an strategic moment you may have to take up a certain maneuver which may cost civilian life. Maybe the true meaning of collateral damage.
Obviously we're unaware of pragmatic situ in the attack. Germans may have attacked in panic and cost unnecessary damage, or they simply never cared for civilians and carried out the attack. It may even be a serial killing for thrill. But those facts are not clear for us the outsiders.
In principle however, civilians are not an external party in terrorist war. Every terrorist is an interchangeable civilian, and rise from them. So civilian cost is inevitable. Everyone should understand that.
Some may debate that Afganistan is a diff country so German invaders have no right to conduct attacks there no matter what. I'm little light on that point. Terrorism is borderless, and eliminating it is equally the same. It sure leaves lots of messes, but I do not call any country an invader for sending troops into a place where their terrorists get oxygen from. For me, Iraq was invasion, but afganistan was a defensive act.
But the bottomline is that I am dumbfound why the same parties who conduct same acts fail to understand when we have to face our own version of terror war. What applies for Germans in Afganistan, should equally be applied for our troops too.
We should start our campaign right from that point. We should have a record of all such events. Whenever the diplomats of a certain country start pulling our leg, we should come back on to them with remarkable accuracy how their own armies conducted such and such acts and how they were defended by their own mouths.
There is no better way to shut a mouth than making one guilty.

The Colombo High Court today allowed the indictment in connection with the killing of former Foreign Minister Lakshman Kadirgamar to be amended, excluding the names of Vellupillai Prabhakaran and Pottu Amman.
High Court Judge Kumuduni Wickremasinghe had allowed the application made by the Attorney General, that the two main accused in the assassination trial of Minister Kadirgamar, LTTE leader Prabhakaran and Shanmuganadhan Shivashankar alias Pottu Amman, were confirmed dead.

(The Sri Lankan government is hugely dependent on outside aid in its efforts to deal with the human consequences of the war which the island had to endure for more than a quarter of a century. High military spending, collapsed tourism revenues, disrupted agriculture, reduced trade, and, to make matters worse, natural disaster in the shape of the tsunami have all undermined the economy.
The government simply does not have the resources to undertake, without international help, the work of repairing infrastructure, restoring economic life, feeding and temporarily housing large numbers of displaced people, and then returning them to their old homes in conditions approaching normality. Long before the war reached its end earlier this year, United Nations agencies, the International Committee of the Red Cross, and scores of voluntary organisations were all present in Sri Lanka ready and anxious to mitigate the impact of the fighting on ordinary people. They were kept at arm's length by the Sri Lankan authorities, who brooked no interference with, or oversight of, their military campaign. There was reason to hope that, with victory, this attitude would change. Unhappily, it has not. Colombo is still severely restricting access to the north, particularly to the area of the final battles, and to the camps where an estimated 280,000 people displaced by the fighting are detained.
The United Nations secretary general, Ban Ki-moon, came to Colombo a week after the war ended to ask for "unhindered access" to those camps. UN agencies have instead found themselves hampered in their attempts to bring in the materials to make life in the camps bearable, particularly vital as the monsoon breaks. Voluntary agencies have similarly found themselves blocked by regulations which seem to change weekly, if not daily, while some ICRC offices have been closed down on government orders. Independent travel by journalists is banned. In addition, the government reacts with fury to any criticism, from whatever source, of its slowness in getting the refugees out of the camps and back to their homes.
The secretary general's reward for the low-key approach he has taken to the Sri Lankan crisis since he assumed office has been to be ignored. Now the Sri Lankans have served an expulsion order on the Unicef spokesman, James Elder, after he warned that the monsoon would cause chaos and suffering in the camps. The Colombo government wants aid but it also wants to micromanage the way it is deployed and to bully those who have the job of delivering it. It is time that the donor nations and the agencies formed a united front to resist this unreasonable and ungrateful attitude.)

You seem to pulling unnecessary 'scare tactics', which is highly unusual for a layman.
As Sujeewa K mentioned, the case would be about authenticity and damages, but nothing to do with the allegations.
The only people who would need to testify is the CH-4 executives, the Plentiff (who could be anyone that files the case- and does not need to be GOSL), and the Expert Witnesses.
CH-4 will not have a cat in a hell chance to win such challenge, and would certainly resort to an out of court settlement.

In other words, the plaintiff in a defamation action may be required to expend a considerable amount of money to bring the action, may experience significant negative publicity which repeats the false accusations, and if unsuccessful in the litigation may cement into the public consciousness the belief that the defamatory accusations were true. While many plaintiffs will be able to successfully prosecute defamation actions, the possible downside should be considered when deciding whether or not such litigation should be attempted.

The western knights who are going hell for leather to condemn Sri Lanka to the stake for ‘war crimes’ find themselves in an unenviable position. They are in the same predicament as the proverbial cat that defecated on a rocky surface and had no way of covering up its stinking mess. In Afghanistan, they have laid bare their true faces usually hidden behind the human rights masks, once again.
On Monday, American troops stormed through a hospital in Central Afghanistan tying as they did health workers in search of wounded Taliban combatants there. That civilian medical facility is run by a Swedish charity, which has let out a howl of protest against the US action. A spokesman for the charity has said the US soldiers came late at night last Wednesday, kicked in doors, tied up four hospital employees and two family members of patients and forced patients out of beds during their search. They had occupied the hospital for about two hours before leaving empty-handed as there were no terrorists being treated there, with a dire warning that it was they who decided if wounded Taliban cadres could be treated.
This unfortunate incident happened close on the heels of US air strikes on two fuel tankers hijacked by Taliban. About one hundred civilians perished in the attacks. In a war against terrorism, terrorist assets need to be destroyed but why on earth did the US jets target the two fuel bowsers with civilians in the immediate vicinity? The US claims to possess the best of technology in the world and, therefore, cannot claim it was unaware of a heavy civilian presence near its highly inflammable targets. It is patently clear that the US military did not care a damn about human lives and went for the kill out of desperation. With the US-led forces being mired in the Afghan bog deeper, the ferocity of their counter terror operations is sure to increase manifold; civilians will continue to perish. And the world leaders will look the other way.

It is intriguing that Foreign Ministers of Britain, France and Sweden, to wit, David Miliband, Bernard Kouchner and Carl Bildt respectively, who cried blue murder about the civilian casualties during the final stages of Sri Lanka’s war on terror have not rushed to Afghanistan to protest against the US and its allies unleashing hell in that country. At least Bildt should have taken the red eye to Kabul last Thursday immediately after the hospital raid by the US military because of a Swedish charity’s involvement with that health facility.
In what looks an interesting development, Germany and the US have crossed swords over the civilian casualties in American air raids. Although the German troops that called for air strikes at issue have defended the US action, German Chancellor Angela Merkel has criticised the attack. This kind of political reaction has prompted US General Stanley McChrystal commanding US and NATO forces in Afghanistan to rebuke Germany. Rifts among the coalition forces seem to be widening with the Taliban stepping up resistance.
British lawmakers who have taken upon themselves the task of protecting human rights and preventing war crimes in the world have not made a whimper of protest against the tragic drama unfolding in Afghanistan, where civilians continue to die in large numbers. The UN Chief is behaving like the three proverbial monkeys, hearing no evil, seeing no evil and speaking no evil. How articulate he was when he commented on Sri Lanka’s war and looked for evidence of war crimes! Maybe he is wary of pitting himself against big powers capable of making his head roll in New York. Who doesn’t like his or her job?
If the brutal atrocities that the US-forces are committing in Afghanistan are not war crimes, what are they? How many people should die in a deliberate air attack on fuel tankers surrounded by civilians for it to be called a war crime? Isn’t it a war crime for an army to storm a hospital, force open doors, manhandle its staff, drag patients out of beds and threaten doctors not to treat the wounded enemies?

People are the same every where in world. They need to satisfy their basic needs and enjoy the life.
No question about basic needs; well, one can argue what really are 'basic'. One may say a cell phone is a basic need and another may disagree. For the moment let's assume people can agree on this matter. However, the question how, which way, under what conditions and upto what extent people should enjoy the life is more subjective than that.
This is where eastern nations, specially therawada buddist nations differ, SL is clear example. While rest of the world's objective is to enjoy the life as much as possible, at any cost, Sinhalese Buddhists, having satisfied the basic needs, try to exit the world. However, this happens at personal level and on personal choice.
As a nation, Sri Lankans (specially the sinhalese buddhists) need to make a clear choice between two. One is easy, practiced since independence and fcuk up in north for the last 30 years. The other is hard way, but proven doable within last 3 years.
1. Accept western nations as our masters, leaders, follow them, basically, keep west happy, do as they say.. we get loans from them, eat and drink on credit and we are their puppets forever. Risk free easy method as long as west take care of their obedient "good" nation.

"Around a hundred thousand captured civilians herded to Mullaiththeevu were kept in rows within barbed wires, most of the time without water or food under the hot sun, and were bullied and ill treated with arrogance," he writes in a lengthy note that reached TamilNet this week. Dear Chaps, I think I know this patriot, who is, if I am not mistaken, an oncological surgeon at Kandy General Hospital. I think he makes a good point about not appreciating local medical professionals who put in innumerable hours taking care of our soldiers while making a big deal about foreign physicians with Medecins Sans Frontieres or Indian Military doctors who come in for a short time and get all the publicity.

The War is finally over. Suffering, fear and insecurity are behind us. Every sensible countryman, except a few short-sighted power hungry politicians, is looking forward to rebuilding Sri Lanka. The sense of true freedom is almost palpable in the air. People stand up straighter when the national anthem is sung or the national flag is hoisted.
All this is possible because of the unwavering leadership of one man, President Mahinda Rajapaksa, who assembled the best possible team against the so-called invincible LTTE. An invincible Sri Lankan military was born right before our eyes, spearheaded by the very able and matter-of-fact Gotabhaya Rajapakse. And the real battle might and the push came from the brilliant strategist General Sarath Fonseka. All these brave men, ably assisted by other service commanders and IGP, had one goal –– wiping out the LTTE from the face of the earth – and they were committed and disciplined. They made sacrifices and placed the country before self. I had the privilege of meeting and treating some of these brave yet unassuming heroes, when the were hurt badly, and I will always remember their courage, determination and morale.
Promotions have been given, felicitations have been held at government level, ministerial level, and school level and even at village level. Even the reporters who reported the war were called heroes and accolades were on their way. Nobody should feel bad or envious about this. The whole country has a right to praise these people.
One question remains unanswered: Who looked after the tens of thousands of injured war heroes? Has it ever occurred to you? The doctors in the military?
I write this article to draw your attention to a group of people whose services are never ever appreciated. We know thousands of defence personnel lost their lives during the final war. Tens of thousand were seriously injured. In a battle, when there are 10 deaths, there will be at least 30 injured. Some will lose their limbs, hearing or vision. They require patient, dedicated care and long term rehabilitation. So who cared for them? The military Hospitals in Colombo and Palaly?
Yes, but in addition to them our ordinary hospitals looked after most of these victims, even though not a word has been written in appreciation of their silent contribution. There was a time it was a constant experience to hear screaming fleets of ambulances rushing towards NHSL, Anuradhapura Hospital, SJPH, Kalubowila Hospital, and Kandy Hospital. Who looked after the fallen heroes in their darkest hour? It’s the health workers –– doctors, nurses, paramedics and the minor staff members.
Kandy Teaching Hospitals were not provided with extra equipment, staff or drugs to treat the war heroes. No additional nursing staff, minor staff or doctors were allocated. Equipment which was requested for war related surgery in Kandy and approved by the Health Minister himself in December last year has not yet arrived! So how did Kandy Teaching Hospitals manage? Does anybody want to know?

Complicated war casualty cases were transferred to Kandy from Anuradhapura, and they arrived in large groups, all requiring complicated procedures, several times. In Kandy Teaching hospital, routine orthopedic operations were cancelled. War heroes were accommodated in the best possible manner. The Hospital Director allowed the use of five beds from each ward, so none of the injured heroes were ever put on the ground. The doctors worked around the clock in two operating theatres. They never complained or grumbled. The nurses in Orthopedic operating Theatres never grumbled. Tired, sleepy, exhausted, they kept on working. The minor staff, had all their leave cancelled, but they trudged on giving yeoman’s service without complaining. In Kandy orthopedic wards, no soldier or officer had to have a higher amputation; no one died and there were no serious infections in spite of the severely contaminated wounds. The injured were looked after as tenderly as possible. We understood their position and plight and we gave of our best. Every injured officer, every soldier and every coordinating army officer will vouch for this.
By February, we were certain that nothing was going to stop our heroes. They were so brave, committed, unrelenting, and their morale was over the moon. This feeling of euphoria spread to doctors, ward and operating theatre nurses, minor staff in operating theatres and wards and the medical teams consisting of orthopods and anaesthetists, spurring us on. The department of anaesthesia never grumbled and provided additional anaesthetists whenever required. The director and deputy director gave us their 100%. This is how Kandy coped.
The struggle continued long time after the battle was won. We had to look after injured heroes during the final days. Their injuries were gruesome. The security threat to the staff was immense. Some times we had more than 100 seriously injured soldiers / officers under our care. A suicide bomber could have achieved what the tigers couldn’t achieve in PTK, if he managed to smuggle in a bomb to the ward. But we continued with our task, unperturbed.
Now the war is over. The last patient who was injured ironically on 19 May morning also has now gone back home. We are happy as a team to have contributed to the forces during the war.
So why do I write this letter? Whenever a patient dies in a hospital, doctors or nurses are criticised mercilessly by the media. In a country notorious for lethargy, inaction and incompetence, every doctor and nurse is scrutinised under a microscope. Just read the letters to editor in any newspaper. The so-called newspaper journalists and electronic media journalists and even disc jockeys without any general knowledge blurt out their comments even before they verify the actual incident.
The doctor or the nurse is identified and crucified. They will never dare do this with political bigwigs. Doctors can’t hit them back; their explanations will never be published or given equal prominence. It is well known that GMOA members continue their emergency work during their strike. Can anyone name a single trade union which really maintains this? When CEB strikes, the patients in ICUs died. Health sector achievements are never appreciated by the plethora of ministers or high officials. Kandy received thank you notes from Brig. Sanjeewa Munasinghe, Head, Medical Corps, and Brig D Wijerathne CO, in Kandy. But that’s all.

Anyway we have another task now. Looking after the IDPs and their neglected war wounds. They are now being transferred by the dozen from Vavuniya. So we will attend to them as well. This will double our workload but who cares? Already doctors have gone in large groups, with only basic facilities to IDP camps on a voluntary basis. If a group of foreign doctors with dubious qualifications performs one operation on our soil, that hits the headlines. If a native physician claims that he cured leukemia or can cure any disease under the sun, our media gives him immense coverage. Do these so-called journalists follow up on these so-called miracles? Never! Their journalism ends the moment the drama is over.
Now the war is over. Isn’t it a good time to ponder how much the doctors of this country contribute to the sick people of this country? People are very critical about private practice and trade union action. Private practice is a necessary evil because of the minuscule salaries we get. Trade union action becomes essential when thick skinned individuals in the ministry try to bypass accepted time honoured procedures. We do that as a last resort and even then we maintain emergencies on our own volition.
So it is best to ponder now who treated the thousands of seriously injured war heroes, including the ultimate hero, Gen Sarath Fonseka. Even the reporters who were reporting the war were felicitated as heroes! We never ask for felicitations, but humbly ask our countrymen and the administrators to appreciate the yeoman’s service we provide. Same request goes to journalists who ruthlessly decimate reputations overnight, some even when they read newspaper headlines on TV!
Long live the President of this country, whose unwavering stand against terror finally stood its test, long live the Defence Secretary who streamlined it, long live the Service Chiefs who planned it an oversaw it, and long live the humble soldiers who did it. We always remember you and I have many stories to tell my grandchildren about the Sri Lankan war and the brave soldiers I treated. And Long live all my colleagues, the nurses, physiotherapists , radiographers and the minor staff of all the hospitals which catered to the injured soldiers, and civilians during the last three decades – you are the real unsung heroes. Long live our freedom!

Three pronged SLA offensive thwarted - LTTE

Sri Lanka Army (SLA) began moving ground troops through three fronts from two SLA bases towards Mavil Aaru sluice gate Monday morning, supported by Multi - Barrel Rocket Launchers, artillery fire and aerial bombardment from Kfir and MIG jets towards Liberation Tigers of Tamil Eelam (LTTE) controlled area in Mavil Aaru. The SLA advance was thwarted by the Tigers, according to Ilanthirayan, the military spokesman of the Tigers. Three LTTE cadres were killed and two wounded, Mr. Ilanthirayan said. Meanwhile, informed defence sources in Colombo said 12 SLA troopers including two SLA officials were kiled and many wounded. The SLA initiated operation has threatened the Ceasefire Agreement.
LTTE defence was being carried out under the supervision of LTTE's Trincomalee District Special Commander Col. Sornam, Mr. Ilanthirayan said.

SLA troopers launched a troop movement from Thirumangalam SLA camp towards Ankodai in LTTE controlled area, but the move was defeated at Valkottu by the Tigers, amidst indiscrimate bombing by Sri Lanka Air Force (SLAF) Kfir jets and MIG bombers.
"They [the SLA] could not move far, even a kilometer from Thirumangalam camp," Ilanthirayan said confirming intensive clash between ground troops from the both sides.
In the meantime, another move, made from Kallaru SLA camp eastwards in the direction of Eachilampattu, was also defeated, he said.

Not really.. USA and west help then RW/UNP admin becuz they wanted to keep the balance between GSL and LTTE so that conflict drags and both sides under their control. I thought of writing the following after observing few of the post war developments. Has to publish in few segments as it is too long. In my view the past is gone but there are so many lesions we will have to learn and survive in the present. The future is likely to be good but it all depends on how we take the present situation.
Rise … the new world order!
In 1991, Soviet Union was utterly defeated in the Cold War. Even though the rulers of Soviet Union managed to transform an impoverished region of the world to one of the most industrial while defeating Hitler in WWII within a relatively shorter time, (40 years!) due to lack of initiatives, the nation degraded and eventually disintegrated. Once the Soviet Union was defeated, United States of America with the support of its other satellite pooches in Europe, created the “New World Order”.
The concept of New World Order was initially originated in the Hitler’s mind. Once the Nazis capture the global power, the centre of the power is going to be the “Germania”, the capital of greater Germany. It was the capital of the world which endorsed the system “New World Order”. The purpose of the system is to enslave the whole world to serve the people with Germanic origin.
In United States of America, the whole system which is based on pure capitalism and market mechanism, is primarily controlled by the Jews. Name a few millionaires and billionaires in United States and naturally majority if not all could be of Jewish origin. The wise Malaysian leader Dr. Mahathir Mohamad once very rightly stated that the whole world is controlled by a bunch of “Zionists”. Zionism is the Jewish equivalent version of Nazism. Actually, Zionism has its nationalistic roots far earlier that Nazism. Naturally, Hitler borrowed the idea from Jews and wanted to eliminate them as he thought the main threat to Germania would come from Jews (because it is their idea!) than others such as other capitalists and communists. Today, we have the empire of the Anglo Saxons spreading the ideology of the new world order, based on Zionist and Nazi thinking, ruled by few rich companies. These companies create rules in US and influence the global bodies to implement similar rules throughout the world. They will rake billions of dollars once such laws are in place (Eg. Laws on intellectual property etc).
Thus, we see the so called new world order in action today. We see the key economic entities of the capitalist world, the companies are deeply penetrating into the regions which they were out of access before. The riches are getting richer and the poor are getting poorer. But naturally, there would be resistance. There is resistance. Now, to crush such resistance, the administrators of the new world order needs to be weaken the nations which are likely to rebel against the new world order which is being propagated. For this, they use various tactics. Some are new and innovative while the others are the same old tactics they used during the occupation of lands (British) and the Cold war period. One key factor is to create resistance, divide and rule.

Divide and rule
Once a nation is divided, the nation becomes weak. The history provides us with many such instances. Sri Lanka was a unitary country for majority of its two and half millennia old recorded history. There was a single ruling institution which overlooked the affairs of the total land mass. Most of the earlier attempts to divide the land were thwarted thanks to our courageous fighters and strategic rulers. During the latter part of our history, we had to face trouble on the political and economic angles when the country did not have a strong ruler who would guide people with a strategic vision. The country was divided into many kingdoms (not based on Ethnicity though) and the economy as a whole was weak. This naturally resulted in various forces invading the country and stealing our resources. Eventually the Anglo Saxons anchored here for good in 1915, after defeating the only kingdom which held against the invaders and never left since (Do you dispute and say they left in 1948? Well, think again!).
Naturally, Sri Lankans are from various nationalities with ancient wisdom. They cannot be fooled for ever, irrespective of their nationality (Sinhalese, Tamil, Muslim or other). They would understand what’s going on in the land and take steps to take over the resources which are being exploited by the Anglo Saxon forces and the Anglo Saxons wants to prevent this at any cost. After 1948, they lost certain parts of the game anyway. They regained a lot after 1977 and wanted to complete this regaining process over the economic resources of the country as soon as possible. But the situation is not static and it would get complicated. People of the land are vigilant and would understand clearly as to what is happening. So the Anglo Saxons would need to weaken the watchful nations with a conflict and they can enjoy the resources of the land.

What resources?
Oh! Come on, what are the resources we have in this land? This is such a small country that any Anglo Saxon force, if there is any such would hardly ignore it. It is just not worth wasting their resources on! This is one of the key arguments that our own ignorant lot put across when we say that they invade the land for our resources. This is a small country true, but this is so rich of resources, the word serendipity stemmed out from the Arabic name given to this land. There is no other place in the world like this. I am not saying this because it is my country, because it is true and scientific. Let’s see why shall we?
Sri Lanka divides the Indian Ocean into two parts. Placed very close to key commercial routes of the world between China and Europe, Sri Lanka can make riches from others who pass the sea routes by providing them with a place to land and necessary services. The placement is so strategic; any missile fired from SL can reach a major part of the Europe, Africa, Middle East and Far East.
Sri Lanka is a tropical island which has ample water resources. Water is a resources which is quickly depleting due to the global warming and other ignorant actions by the industrial countries. Water is an essential to life. People will pay heavily for water as this is an essential for life. Don’t you believe me? But it is true. Why did so many world organizations and NGOs talk about water management in a country which has experience over two millennia on effective water management? Because, they want to make water a commodity and sell, and they are already doing a good job with introducing the concept of bottled water. Sri Lanka, with such a heavy rainfall, is one of the ideal locations to collect and process water. So they are after our water.
The human resource of the land is another key element. We hear some old “walavve hamu”s complaining about there are no “gas nagina kollas” to get coconuts plucked etc. That’s because the free education has given a number of local and global opportunities to the sons of those “gas angina kolas”. The labour here is well disciplined and trained relative to most of the other labour markets. Our people are learning oriented and obedient while being loyal to their organization. They are committed in getting a task completed. This attributes cultivated in them through millennia of civilization coupled with training from the free education has opened a number of new avenues. The Anglo Saxons would like to have free access to human resources of this quality.
Apart from these we have number of other natural, biological and philosophical resources which the world can benefit from. The Anglo Saxons are not interested in extending the benefits of our resources to the world. They want to make them commodities so they can sell then on the global markets for money. Thus, it can be understood that we are resource rich and they would like to get their hands on them again the way they have done during the colonial times. In fact during the colonial times the sophisticated technologies for man exploiting resources, man exploiting nature, man exploiting labour and man exploiting knowledge were not at the stage they are today and the Anglo Saxons missed out a lot. That’s why its important that they regain the grip they lost and take the exploitation to the next level for their own survival. Well, this is the new world order.

LTTE
LTTE is from the inception is created by the Anglo Saxons as a part of their global koolie army who does their dirty deeds in nations that they would target to be exploited. LTTE is not the only organization of this level. But LTTE rose to the fame as the China was rising and Sri Lanka’s position was becoming increasingly important (militarily and commercially) due to this. Few other organizations created for this purpose still exist. Al Qida is one such organization. They created this to attack the Soviet Block. Once the Soviet Block was fallen, they thought the organization would implode as its purpose is served. How wrong were they there!
LTTE followed a cause which certain post Dominion Tamil movements conceptualized, a separate state for Sri Lankan Tamils in one third of the land mass of the country. Never ever in history has such a country existed. It is a dreamland promised to the global Tamil community by Sri Lankan Tamil politicians who were driven by the Anglo Saxon forces. LTTE raised the dream high and fought for it. India was mislead by the idea that if they would support this idea of Tamil Homeland in Sri Lanka, the Tamilnadu people will support such politicians in New Delhi. Thus, knowing LTTE is a monster created by the Anglo Saxons, they poked their finger in and tried to gain the control over the monster to their advantage. The monster took the advantage of India’s support but eventually proved only loyal to the Anglo Saxon white master when they “killed the hand that fed”.
From the other end, the masters of the LTTE were at work too. They made sure that only governments with a separatist agenda would rise to the power in Sri Lanka. LTTE supported President Premadasa to wipe out Sinhalese in 1989 who were against the India-Sri Lanka accord. Once the president started fighting against the separatists, they naturally turned around and killed him. The masters devised various dubious ways so the Sri Lankas would go against their own kin to gain power and money. Eventually, they with the NGOs as their key instrument, used the atrocities done in 1989 to bring down the UNP government which they were very much in accordance with during that time to get a president who is a major pooch of NGOs on the thrown. The division of the land is so close and as they say rest is history.

Is it happy ever after?
But that never happened. The patriotic forces fought back. LTTE was defeated to the disbelief of the global masters and LTTE fund providers. Does this mean that we are done for and will live happily ever after?
The Anglo Saxon koolie forces were defeated and even for them, it will take time to build a strong and a formidable force like the LTTE. On the other hand, these videos which would surface etc are just final cries who still have to work for the money they would have received from the LTTE and their masters. As there is no land and no fighting force, the LTTE tends to eventually diminish into the darkness of the history and be forgotten. This is true for sure, but this is not the end. The cause still remains alive and the Anglo Saxon forces will come after us until the cause remains. It is not easy to get rid of our cause either too. May I remind you that this is all because of our country’s riches and until we are resource rich, they will try various ways to take control or “Regain Sri Lanka”.
Does this mean a never ending war in the land? No. But we have to be ready. In 1970s and 1980s we didn’t know. We didn’t see and we did not listen to people who saw. We learnt the lesson the hard way and now we know. Now we see and we need to be ready. The dubious Anglo Saxon Empire would try its best to tarnish the image of the country and create political disorder. They will spread various rumors and buy progressive politicians and political parties. Certain progressive parties and politicians will sell their souls and enjoy the benefits they would get from the Anglo Saxons. So it is important that as a nation we watch out for these kinds of things. Such things can ruin our nation again easily.
We need to have a strong military. We need to continuously improve our defense capabilities and build our won weapons. After all it is the military forces which achieved this great victory over the Anglo Saxon forces. It makes sense to put the military first in a nation like ours under constant threat from the Anglo Saxon Empire.

However, nothing is forever and it is a fact that we would observe in this case as well. The new world order has become stale and rotting. The masters have lost their efficiency, new technologies and the ability to manufacture. They became so lazy to do things themselves and handed the processes over to the other nations to work for them. The August 31 verdict of a Colombo High Court sentencing the veteran journalist and columnist J.S. Tissainayagam to 20 years of rigorous imprisonment under the country’s draconian anti-terror law has raised concerns across the world on the state of freedoms in the country. The punishment is extremely disproportionate to the alleged crime of writing articles criticising the military in his North Eastern Monthly magazine. Tissainayagam, an ethnic Tamil who wrote in English and was a regular newspaper columnist, was arrested by an anti-terrorism division of police in March 2008. He was not formally charged or produced in court until August 2008, when he was indicted under the Prevention of Terrorism Act (PTA).
The court made a determination that his column, which was a mere expression of opinion on the government strategy in the war against terror, was intended to cause racial or communal disharmony. His raising money to run his magazine was construed as raising funds for the promotion of terrorism. The shock over the judgment is understandable as it is the first case in which a journalist had been charged and convicted under the PTA of 1979 and has come in the post-Prabakaran Sri Lanka that eagerly awaits reconciliation, after the military defeat of the LTTE in May this year.
Even before the court pronouncement, the case of Tissa made international headlines. On the occasion of World Press Freedom Day on May 3, United States President Barack Obama referred to the lack of media freedom in many parts and to the case of Tissainayagam along with another as “emblematic examples of this distressing reality.”
Reporters Without Borders, an organisation that has consultative status with the United Nations Human Rights Council (UNHRC), has called on the Council to intercede on behalf of the jailed Sri Lankan journalist. The incarceration and prosecution by the state and the court’s judgment have the effect of intimidating reporters and editors who may want to question the government’s anti-terror campaign and strategy.
President Mahinda Rajapaksa, who has earned all-round praise for his successful military campaign against the LTTE, should heed democratic voices and intervene urgently in the matter to set Tissainayagam free. Even in difficult times, the Sri Lanka Parliament had in 2002, during the tenure of Ranil Wickramasinghe and Chandrika Kumaratunga, repealed law relating to criminal defamation. The core post-war theme espoused by the government is, “let’s forget the past and rebuild the battered nation.”
The Tissa episode is an opportunity for the government to move towards reconciliation as well as to ensure that basic freedoms are protected.

The short answer is “yes”, but that doesn’t express the Sri Lankan reality that is found in the details. Sri Lanka is best characterised as a nation facing a death struggle between a hegemonic majority and a hapless minority tied by a double-edged fear to a nasty terrorist movement. Tamils find themselves between the devil and the deep sea. Moreover, the Lankan state faces dismemberment if it negotiates peace with the terrorists, but is afflicted by hubris if it defeats the terrorists on the battlefield.
The media doesn’t recognise this paradigm. For journalists, it is a trade union loyalty oath to defend journalists against the state, any state, irrespective of the rights and wrongs. To an extent this is a commendable pledge as state power has to be moderated in its dealing with free press, because the press must invariably expose the errors of the state. But every democratic constitution mandates that freedom of the press has to be subject to reasonable restrictions. One such reasonable restriction is that the press should not become a paid mouthpiece of either the state or the enemies of the state.
Hence, was the Lankan government wrong in taking action against some journalists, like recently charging J S Tissainayagam with treason and seeking his prosecution for a 20 year jail term? The Colombo high court has upheld the charge as the law of evidence in the Sri Lanka Prevention of Terrorism Act makes it easy. But I have read Tissainayagam’s writings, and they are pure LTTE propaganda. The LTTE has produced doctored videos, manufactured incidents and spread canards. We witnessed this perfidy too when the IPKF was in northern Sri Lanka. When Tamil journalists wrote against the LTTE, they found themselves driven out, ostracised or killed. Hence, one-sided criticism of the Sri Lanka state is de facto pro-LTTE propaganda.
Thus, the summarised long answer is: when a state fights a secessionist terrorist outfit, then press freedom suffers as a consequence. Therefore to say that Sri Lanka does not have press freedom is an occupational hazard, not a condemnation. Whatever price has to be paid by the state to exterminate terrorists must be paid.

18 Senior CID officers come under the axe – transferred to Kilinochchi
(Lanka-e-News, Sep.09, 2009, 5.40PM) On the orders of DIG Nanda Munasinghe in charge of the CID, 18 senior police officers of the CID with several years experience in that division have been transferred to Kilinochchi. 12 of these 18 Officers are from the investigation unit.
Mr. Munasinghe succeeded DIG Sisira Munasinghe who was earlier in charge of the CID. Prior to becoming the DIG , Mr. Munasinghe has been an SSP in the Division. Owing to the resentment shown against him by other Police officers , Mr. Munasinghe was transferred out of the CID.
It is noteworthy that these transfers have occurred following the return of Mr. Munasinghe now to the same Division as DIG.
It is reported that these transfers prompted by personal grudges against these officers had adversely affected the division , as these are officers who have several years of hands on experience on terrorism investigations before and after the war.

This transfer business one of the curses that came to us from the Colonial times and we are still continuing this horrible practice. Most of my father’s working life was filled with transfers every 5 years or so. This brought a lot of heartache to see our father away from home from the beginning of the week day costing him much for a second home and travelling and mum had to look after the house with young all alone which is very unfair. Just as the very lengthy court cases these transfer business, some time for revenge have never been done away with since independence.

Not really. Even I feel that the punshment far exceeds teh crime. It is true that the guy wrote nasty stuff, like justifying the killing of world class people such as Kadirgamar.
Abhorrant though such acts may be for us, the ability to express an opinion must exist in a civilized society. It is when that right is removed that violence becomes the last resort left to communicate with.
We did it, with an amendment to the constitution during JRJ's times which made talking of a seperate state an illegal act. And ended up having to deal with a violent reaction which cost us three decades of development and over 1-lakh lives. Now we have learnt to deal effectively with the symptoms of the problem, we seem to be over willing to forget that the problem itself isn't solved. We MUST talk it out, and for that we must find moderate people who will put the nation before petty communalism and serve all Sri Lankans equally.

LTTE is a heinous terrorist group and anyone who supported it morally, materially or militarily must be held accountable for their actions and within the soil of Sri Lanka (and that now includes all the way from Point Pedro in the north to Dondra in the south) I am glad they are being held accountable and my hat's off to this GoSL for doing so with diligence and zeal.
This was not another opposing cricket team, a soccer team, a basketball team, or even a political party, but a heinous band of killers who saw nothing wrong in setting off lethal bombs in trains, buses, supermarkets killing thousands upon thousands of Sri Lankans, and also sword/axe hacking of pregnant women and children in poorest of poor Sri Lankan farming villages!
Kudos GoSL...do continue to hunt these killers and their supporters down and subject them to due punishment - and I hope it will be nothing but "cruel and unusual"...

agree with the right to express as long as it doesn't violate laws.
1. this problem cannot be solved through TALKS.
2. MOST tamil ppl on earth want TAMIL ELAM within the land of SL. they have a right to that opinion. they have right to aspire. we cannot fool them or gritify them into giving that up.
3. we cannot demarcate tamils in SL and tamils elsewhere. as we can see clearly, such demarcations won't work!!! tamils the world over want a place to be called the tamil nation. only a fraction of them live in SL. so even if most tamils in SL don't want TE, still the problem continues. the tamil diaspora are only blood relatives of tamils in SL. they will NEVER consider sinhalas or muslims in a closer manner than their blood relatives abroad in the tamil diaspora. also they identify VERY VERY closely with tamil madu, india, socially, politically and culturally.
4. even MOST tamils in SL (in NE - which is TE to some - particular) haven't given up on TE. TNA, TULF, ITAK stand for tamil elam and they are the MAIN political forces of tamil ppl in N-E SL.
5. winning over the "moderates" is not going to change anything. "moderates" were always with us but nothing changed!!! even when GOSL did terrible mistakes the moderates were willing to co-operate and change the bad to good. but nothing changed. bcos MOST tamils are NOT moderates when it comes to tamil elam. they will never be. they need not be. and i have no problem with that. when it comes to violence, MOST tamils (95%) are moderates. they hate violence.
6. tell tamil ppl in NE to give up racism, nothing will happen. mark my word, at the next general election too, they will vote overwhelmingly to RACIST political parties. (unless EPDP goes on rampage).
7. also tell tamil ppl not to read HATRED in newspapers, not to listen to hatred 24/7 in sakthi fm, etc. or not to get carried away by hatred in toiletnet or sakki tv, etc., they will laugh at you.
if you have a CLOSE tamil friend, pls ask him to read the news of a popular tamil newspaper as it is in english. there is NOTHING other than RACIAL HATRED EVERYWHERE!!!
8. but they have the right to read, watch, listen to those stuff (subject to legal restrictions). we cannot call them idiots, fools, racists. no way.
9. this is why we should take the initiative to CHANGE the ROOT CAUSES that breed racism. mainly in politics.
10. look at tamils living outside NE. they NEVER vote for racist political parties. MOST of their elected reps don't try to die over tamil elam unlike TULF, ITAK, TNA motherfcukers. this is what we should bring about in NE.

I agree with this statement with certain caveats.
1) When a nation is fighting a heinous band of terrorists like what SL did, then one cannot say the atmosphere is a "civilized society" in the nation as inevitably the sheer horror that the terrorists bring about require the state to adopt certain strong or harsh measures that may be deemed "not so civilized"...this is a fact of life and no country on this planet has fought a terrorist campaign by maintaining a squeaky clean "civilized society" where, for example, the freedom of expression was the same pre-terrorism and post-terrorism
2) "ability to express an opinion" cannot include expressing the heinous terrorists' propaganda and demoralizing the country fighting force, i.e. the very critical tool that the state has deployed to combat that terrorism horror.
This is exactly what TissaN went afoul with and the rat got what he deserves!

We need to find innovative ways to snub the British High commissioner for the blatant act of refusing a visa to UK to the then Foreign Secretary of Sri Lanka. My suggestions are.
(a) Government ministers including foreign minister should not attend any function organized by the British high commission. They should delegate such functions to a person below the position of Asst. secretary of their ministries.
(b) President or the senior cabinet ministers should not attend any function that is also attended by the British high commissioner. This will make other diplomatic missions/other organizers of functions not inviting the British high commissioner for their functions if they want senior ministers or president /prime minster to attend.
(c) In allocating seats in national function s such as Independence Day etc. front row /prominent seats should not be allocated to the British high commissioner or his deputy.
This should be continued until the culprit formally apologizes to Sri Lankan government or until he leaves his position. Let’s see whether our ministers have the guts to do this.

IT is a dim spotlight the world shines on Sri Lanka and the human rights abuses that occur there.
The expulsion from the country of Australian-born Unicef spokesman James Elder this month, for speaking out against those abuses and child casualties in the bloody final stages of Sri Lanka's 26-year long civil war, dims it further still.
Elder was one of very few aid workers on the ethnically riven island nation who was prepared to brave the wrath of the Sinhalese-dominated government to highlight the plight of civilians, especially children, during the war and in its aftermath.
As Unicef's chief of communications in Sri Lanka, this was his brief and his responsibility.
That the government's chief spokesman, Palitha Kohona - an educated and charming man who spent several years as an Australian diplomat and many more as a UN official - should suggest otherwise is, as Unicef itself said this week, bordering on ludicrous.
Kohona, also an Australian citizen, has accused Elder of supporting a terrorist organisation and espousing the views of the pro-Tamil news website Tamil.net by highlighting issues such as child malnutrition in government-run internment camps.
About 250,000 internal refugees are now held in camps while the government de-mines the former rebel-held north and weeds Tamil militants from civilian populations.
It is a preposterous accusation, particularly given the Tamil.net forum far more often selectively reflects the news of the day than breaks it.
The government's real gripe would seem to be that Elder has contradicted the state propaganda saying no civilians were killed in the last stages of the war and that all is well in the camps.
The Sri Lankan government, as the victor in the war against the Liberation Tigers of Tamil Eelam, is determined to write its own history and is brutal in its suppression of inconvenient facts.
Led by the country's former human rights activist Mahinda Rajapakse and his two brothers, Basil and Gotabhaya, the government has successfully cowed most local media and aid organisations.
Local journalists have been arrested for casting the government in an unflattering light. Some have been murdered.
The media are refused independent access to overcrowded and unsanitary internment camps - about to get far worse with the coming monsoon.
In a self-penned eulogy that anticipated his own assassination last January, Sri Lankan journalist Lasantha Wickramatunga wrote: "Murder has become the primary tool whereby the state seeks to control the organs of liberty. No other profession calls on its practitioners to lay down their lives for their art save the armed forces and, in Sri Lanka, journalism."
In the weeks leading to Rajapakse's May victory declaration - as the army bombarded rebel forces along with a massive civilian population it knew was being used as a human shield - most aid groups took the view it was better to temper their comments and remain in the country for the mop-up than risk expulsion.
Elder continued to brief journalists and highlight abuses on both sides.
As triumphant Sinhalese Buddhists crowded the post-war streets of Colombo and Tamil Hindus sheltered indoors, he told The Australian: "People have paid a high price for this peace. Thousands have been killed, including large numbers of children."
In the weeks that followed, other aid groups would back those claims.
The UN now estimates as many as 20,000 civilians were killed in the final mayhem, as army shells rained down on as many as 200,000 civilians squeezed into a tiny land sliver between the two sides.
Elder called for aid groups to have unfettered access to the camps, to bring in medical aid and supplies.

"It's important to remember these people have arrived in camps in the worst possible state," he said. "They are hungry and sick, and many still have untended wounds from the war."
Hardly the statements of a terrorist sympathiser.
Some aid workers say Sri Lanka has become an almost intolerable place to work. Best known in Australia as a tropical holiday island, Sri Lanka is in fact a police state. Whether the massive security apparatus - considered a necessity during wartime - will be dismantled in peace remains a test of the Rajapakse regime.
The other will be whether Rajapakse delivers on his promise for a political settlement that grants some autonomy to the Tamil minority and addresses legitimate concerns over their discrimination.
But as Robert Kaplan wrote in the Atlantic Monthly: "Like the Serbs in the former Yugoslavia, the Jews in Israel, and the Shi'ites in Iran, the Sinhalese are a demographic majority with a dangerous minority complex of persecution."
The international community continues to hold out carrots - such as the $2.5 billion IMF loan granted in July - even as the Rajapakse government bites the hand that feeds it.
In the last days of the war it lashed out at all international attempts to broker a ceasefire so civilians could be evacuated from the conflict zone.
In return for huge arms purchases, China and Russia have given Sri Lanka cover at international forums such as the UN Security Council, blocking all attempts at censure.
This week, Sri Lanka adds another weapon to its diplomatic arsenal: Kohona flew out of Colombo yesterday for New York, where he will be Sri Lanka's ambassador to the UN.
No doubt his diplomatic grounding in our own Department of Foreign Affairs and Trade, including a three-year stint in the Australian embassy in Geneva, will assist him.
DFAT has refused to comment on Kohona's role in Elder's expulsion, or on his Australian citizenship, other than to say the decision "was made by a Sri Lankan official acting in his official capacity".
Britain and the EU have backed calls by the UN Human Rights Commissioner for an independent investigation into alleged war crimes on both sides. Australia has remained mute on the issue.
The US and Britain made public their decision to abstain from the IMF vote, a move widely interpreted as a shot across the Rajapkse government's bow. The Rudd government has not revealed which way it voted.
In that context, Elder's willingness to poke his head above the parapet is even more impressive.

Sri Lanka on a Collision course with the West.
Why on earth is the Rajapakse regime on a collision course with the West? Okay, we are being bullied by the West, but haven’t we asked for it mainly on account of our stubborn resistance to international appeals for independent investigations into war crimes and human rights abuses? Taking blanket cover under a ‘conspiracy theory’ to undermine Sri Lanka by the West due to our ‘strategic importance’ borders on the ridiculous. It sounds more like a ‘Jamis’ Bond plot to distract and entertain an impoverished and ignorant rural polity. From Solheim to Milliband, we have identified so called ‘international conspirators’ who serve as convenient scapegoats or punching bags. Alas, the regime does not stop to think of the long term consequences of the shortsighted unsustainable ‘ collision diplomacy’ which our role model authoritarian states such as oil rich Iran and Libya have the economic power to counter, unlike resource starved Sri Lanka.
The collision course became most evident with the horrendous mass murder of seventeen Tamil aid workers of the French aid organiation ‘action contre le faim’(ACF) during the last days of battle against the LTTE in the Eastern province. Mainly on account of an international furor instigated by ACF alleging involvement of the armed forces, the government was compelled to appoint a Human Rights Commission(HRC) and ‘stage’ an inquiry. In a defensive stance, the government took the opportunity to include, for investigation by the HRC, several other criminal acts allegedly perpetrated by the LTTE. The President also appointed a International Independent Group of Eminent Persons (IIGEP) to act as observers in order to endorse the HRC’s findings. Rajapakse’s appointment of retired Indian Chief Justice Baghwati as head of the group may have been deliberate in order to take advantage of his presumed frailty due to advanced age. Unfortunately the President seriously underestimated his mental capacity which turned out to be razor sharp in seeing through the staged inquiry to the consternation of the government. After nearly one year of prevarication by the government , the IIGEP decided to withdraw their observer status as they alleged that the inquiry was not being conducted in a fair and transparent manner. In order to save face, the government accused the IIGEP of conspiring with the West to bring discredit to Sri Lanka. Such a ridiculous accusation against a group of eminent persons struck the ‘last nail on the coffin’ of lost credibility. It made them appear even more suspect in the eyes of the international community and also provided plenty of ammunition for the Tamil Diaspora to make further allegations of racism and genocide.

The confrontational stance has additionally become a election gimmick to display the regime’s bravado in confronting world powers to the largely insular rural electorate whose patriotic fervor can be easily manipulated in order to divert their attention from their own as well as the nation’s dire economic straits. The regime constantly highlights the double standards and hypocrisy of the west with regard to war crimes and human rights abuses in order to vindicate themselves of the very same injustices which is a puerile and pathetic form of defence, to say the least.
Despite its ravishing scenic beauty, Sri Lanka still remain as a poverty stricken, resource poor inconsequential little island nation in the global scenario with little or no achievements to be proud of as a nation except for the recent blow up of the regime’s success in eliminating terrorism. Unfortunately, most of the democratic world has been slow to acknowledge this signal achievement as it has been marred by controversy on the ‘modus operandi’ adopted due to alleged violation of international conventions on warfare and human rights by the government in the final stages of the war when the enemy’s attempts to surrender were denied or ignored. Also, their lack of respect for ‘ safe zones’ by using heavy fire power resulting in mass killing of civilians shocked the world. Continued post war persecution of suspect Tamil civilians in internment camps in violation of their fundamental rights has aggravated the government’s image as racist and authoritarian.
Due to its collision course, the regime has antagonized Britain as well as the entire European Union and continue to do so without thought of the economic consequences and diplomatic deadlocks as a result of such actions. Locally, organizations and individuals who provide constructive criticism are relentlessly persecuted in a most ruthless manner and accused as traitors when, in reality, it is the regime that is the real traitor which is sacrificing the country and its people in order to remain in power to perpetuity like their role model dictatorial regimes such as Iran, Libya and Burma which have held power for over three to four decades by crushing all opposition and thereby denying their citizens of fundamental rights to freedom, justice and prosperity.
Before it is too late, the intelligentsia of this country must lift up their heads in defence of democracy instead of meekly endorsing authoritarianism by granting honorary doctorates to chauvinistic and despotic leaders who only pay lip service to democratic ideals while covertly advocating extremist notions of sinhala Buddhist supremacy prejudicial to ethnic harmony, equity and national prosperity.
