Sit Rep 31 Oct 2009

A cautionary note on the present situation re Gen Fonseka. Our task was to allow things to settle down on their own which has worked. However, recent developments led particularly by a section of the diaspora Sinhalese is a cause of concern for DefenceWire.

DefenceWire team's stance up to now has been to avoid commenting on this dispute knowing fully well the capacity of both the present government and SF to come to a compromise on:

1. The direction the Sri Lankan Military will take
2. The direction General Fonseka would have to go

These may not be the most ideal directions for either, yet they are ones that are at best described as realistic and unavoidable.

There are many moves by politically motivated Sri Lankans, including Sinhala groups and also non Sinhala Sri Lankan groups to exploit a disagreement that has unnecessarily spilled over into the public's eye due to politics in the military and a very small section of the military in politics.

These groups, particularly those civilians involved who are not insiders or have little inside information can or will not understand the discipline of a professional soldier to take what he wants and to relinquish duty when required sans insubordination.

A professional soldier is not Dutugemunu. The Sri Lanka Army/Military is a modern Army/Military positioned within a democratic society. The professional soldiers serving in it will know when to let go. By asking them to perform a larger role based solely on selfish motives of individuals in the periphery, they may destroy that soldier and even themselves and their reputation.

The Sri Lankan Military and its leaders are now hailed the world over for their victorious feat. Their role in bringing peace to the country through military means will be remembered for decades to come as the ultimate example of a trained military executing its sacred task flawlessly from start to finish. But remember this, dear readers, military action is a means of achieving the end and the end is always political.

DefenceWire, as an impartial site whose work you have witnessed for over 3 years now wish to appeal to our readers to refrain from joining or supporting either 'camps' and to allow the professional soldier and professional politicians to resolve potentially resolvable issues mentioned above.

I agree DW, its the bloody opposition (UNP, SLMC, Mangala, Mano G, west etc) that is fuelling this.

Though they talk about a 'Common Candidate', they very well know SF will not align with them (considering all the sabotage they were involved during the war).

So if SF is foolish enough to come in to politics, what I see is we will have MR, SF & RW (or someone else) contesting a presidential election. What could happen is MR's vote base will split between MR & SF thus giving a sneaky chance for the traitor RW to win it... at least this must be the thought of the UNP led common alliance and the west...

What I would love to see now is for MR & SF to settle whatever the matter/s behind closed doors!

If not, it will turn out to be a very ugly scene if these 2 titans decide to go at each other in public...

On a last note and not whole heartedly, I think SF is crossing his boundaries as a soldier. I would love to see the Great General retire and live a humble life... he is too good for dirty politics!

Yes, there is always other side of the story. Your can have your own view from the prospective of an upper middle class member of the society. But, we, as majority of Sri Lankans understand the problem in a more realistic way.

In essence, Gen Fosnseka is a military man who spent most of his life fighting LTTE. If he is so bright, so efficient and so fierce, why he had to spend most of his life fighting this terrorists which was only a few thousands strong earlier. Not only that, for the last 30 odd years, whole Sri Lankan army was struggling with the terrorist group and could not wipe them out until 2009. Did you ever try to findout How this miracle happened.

It was the people, it was the people who won the war, it was the people who won the war by electing a new leadership.

Not only that, after electing a leadership, they really went further to scarify with all the comforts in their lives and with so much hardship to acquire the modern military equipment for the army. You should remember that every gun that used to fight the terrorists was given to the soldier by the people with their hard earned money.

The new political leaders, in turn, gave them the correct leadership and the proper guidance. It was not a secret any more that the West was behind this appalling terrorism and US and its allies together with the powerless politician discourage the war effort, and the US has kept on saying that we will never be able to get rid of terrorism. So, If you have one ounce of grey matter in your head, you will be able see who won the war. Not the army top brass, its is the people, the majority, not the minority like you.

The way the information reaching us, Gen Fonseka to become a surrogate politician in Sri Lanka by the illegitimate father of US and its allies. But we all have the answere.

The terrorist site hiding under the name Sri Lanka Guardian is showing all the spots these days. Early days, the site showed moderate facade with articles from Johnpulle, Bailey, Malinda etc. Now that they have decided to rip the facade and appear with all the spots, only the terrorists and top scum get the spotlight. Despite their yarns about freedom to speak, they "moderate" comments. Unlike DW, the term moderation has a different meaning at LG. Just like DBS Jeyaraj's site, that is to block any comment not favorable to their terrorist cause. The latest feature is from a terrorist with writing style similar to Iqbal Athas asking for an investigation how Vihilupundey was killed. The only thing I have for this doofus is that he needs to wait in line until we investigate all 70,000+ brutal killings by Vihilupundey's LTTE.

If General Fonseka stuffed ballot boxes, went on plundering and killing in favor of the govt I am pretty sure there wont be any complains about army 'professionalism'. How do I know? The Wayaba elections back in 1990s Gen. Ratwatte runs amok while in uniform for this same party. The army and the govt was both corrupt and inept bunch of thieves. Neither did the Army win nor was there any political stability.

Later Gen SF enters the arena with an entirely different ideology. He gives position to those who earn it, absolutely no corruption or nepotism. This ideology beat LTTE.

What exists now is Gen. SF ideology in one corner and in the other Mahinda Rajapaske - the nepotist, corrupt despot of the Ratwatte ilk. What Gen SF said was he would leave the army to fix the problem if the environment that turn back to one that would breed terrorism again.

A hint of Wayaba election appeared back in southern PC election. Mahinda Rajapaske govt went stuffing ballot boxes, abusing state resources and terrorising candidates from other parties.

The option now in the hands of the people is choose the ideology for the country going forward. Do you want a losing army, political instability that would inevitably create another prabararn or wijeweera? Or do you want a winning, incorruptible govt that give place to those who deserve for long term peace and stability.

Have you been to the southern province recently? My guess is not. I don't think that the government is not corrupt and forthcoming in everything. However, this is the government and the leader who restored our peace and dignity after 30 years of living under shadows of terrorism. In the case you are not aware, more than 50% of the soldiers who died in the battle against Eelamist terrorists are from South. Not only that, there is lot of development happening in the south, even during the war. Corruption was equally bad with UNP. The difference is that we eliminated the terrorists. I am not sure how much you have been in a Sinhala society to feel how people treat anybody who had outdone Prince Gamini Abhaya? What Ranil Wickramadonkey is up against is the most unenviable task of challenging President Mahinda Rajapakse who shines equal or brighter than Prince Gamini Abahaya. If you don't believe what I say, I suggest you to take a tour in the country side of the Southern Province.

That is the theory you like to put forward. However, this theory doesn't work well in politics. What happened in the past will always follow in politics. That is exactly what President Premadasa did in his time to make Sajith instantly recognizable politician, not to mention that Sajith developed it very well. That exactly is what D.A. Rajapakese did to make his off springs known politicians. Think of how Sirimavo, Chandrika, and Anura rode the fame and name built by SWRD. I can give you plenty of examples around the world how somebody's past influence the political future. In the case of Mahinda Rajapakse, thing done by hero kings Gamini Abhaya and Kiththi Vijayabahu makes him shine brighter.

Well said. Herein lies the key point.

I remember visiting Colombo during the hay days of RW Huttha (during the days he was intoxicated with his CFA!) and seeing the rampant corruption in Colombo run by UNF big-wigs.

Colombo was virtually ruled by the organized crime aka "casino mafia" and it was gut-wrenching to see the amount of money they were raking in with child prostitution, drug pushing (with even openly peddling heroine to teenagers at Clubs - which I saw to my own eyes!) and the amount of money they were stuffing in the pockets of key UNF politicos and the Colombo Police to look the other way.

Some UNF big wigs who got rich during that time to this date are floating in money (most of it of course hidden in foreign bank accounts).

So any mommafucker who comes here and harps on "corruption" is just being hypocritical for the sole purpose of wanting those golden days of RW=LTTE UNF to be brought back - and of course LTTE whore granted their "thamileelam" to make sure no bombs go off in their casinos/brothels etc. as bombs are particularly bad for that type of business.

Who is tarnishing the Image of the Country?

Hundreds of people were gathered around the beach whilst the violent act was perpetrated on Thursday against this innocent and mentally disabled man. Police officers pursued the man who was seen stoning buses and trains on the beach side road. He was chased by the police towards the sea and the victim went as far as into the sea.

The police men did not find ways to get him out of the see, but went on to charge him with the batons. The video footage shows the man was defending himself from the police attack. His resistance was in vain, within few minutes the sea drama of the police came to an end and the man was dead choking in the water. For the spectators, it was real drama and for others the video footage is a real life film. This incident reflects the ugly face of the security persons at the time when the outgoing Inspector General of Police boasted them as exemplary service men.
Perhaps few weeks ago, we watched the video release by the Journalists for Democracy in Sri Lanka brought to the public domain by the UK based Channel 4 news. The footage showed young Tamil men being executed by the army.

There was even a video footage of abhorring dealings by the Sri Lankan forces of the dead bodies of Tamil Tiger female cadres.

These are in addition to the display of naked bodies of Tamil Tiger cadres in an open truck in the holy city of Anuradhapura following an encounter in the army base.

These incidents are strongly condemned by the Sri Lanka Government and it always qualifies them by saying these are huge conspiracies against the government to tarnish the image of the forces.

The latest footage of the killing of the mentally ill man makes the government defenseless and it has made everyone clear who has tarnished the image of the country. The government remains exposed and it is in a twisted knickers situation, unable to blame it on external forces. The denial spree government is good at creating another concocted story on the latest incident.

The victim, the 26 years old Shivakumara was a resident of Ratmalana - just few miles away from where he was killed and the area is mainly an ethnic Tamil minority concentrated place in Colombo.

‘This kind of police brutality has taken place all over Sri Lanka in the past few years. The IGP must take the responsibility for this shocking incident’ said Mr. Basil Fernando, director of the Asian Human Rights
Speaking from Delhi, Mr. Basil Fernando further said, “ This is just one single brutal act that was witnessed by the people. There are no law and order and a highly corrupted brutal Police service has carried out this act. We were seen this in Angulana when the wife of high ranking police offer took the law into her hand and brutally punished the school children, just few months ago.”

“The Asian Human Rights Commission condemns (AHRC) both the police and the Government of Sri Lanka for this incident and many other similar incidents routinely occurring in the country. And few, including myself, are pleading for vast improvements of governance by policing the police and creating a good civil service.

But we are neglecting one important improvement our society requires. During the past thirty years value of a human life has greatly reduced. This has to be changed. We need a just society in which the law should be equal to everybody and respected by everybody. We should aim for better Mutual respect, friendliness towards others and being soft towards each other. (Of course not towards the enemies of the nation). Present day government should get input of the sociologists in this regard. Movies, TV series and other media can always be used. (I heard that 'Little House on the Prairie' and the 'Kung Fu' series had large effects on American society).

Achieving all of the above goals are not easy. But one has to dream first. With proper actions the dreams can become reality. Instead of KISSING BIG POLITICO ASSES (of MR and RW) we should keep reminding them of our dreams.

If you watch the video carefully you will see that Policemen were indicating him to come out of the water. (We do not hear what they say. But see their hand movements). But he wasn't listening to them which is quite understandable. More beating would have been waiting for him there. Resulting beating was due to that I guess which made him move further in to the deep water.

The actions of these stupid Police men took the life of that unfortunate man.

Sri Lanka seeks access to suspected LTTE cadres held in Canadaby

Sri Lanka is seeking access to a group of Sri Lankan Tamils held in Canada following intelligence reports that some of them are members of the LTTE. The suspected LTTE cadres, including some of those believed involved in the group’s clandestine shipping operations, were apprehended recently while approaching the Canadian coast in an LTTE-operated ship.

A senior government spokesman told The Sunday Island that representations had been made to the Canadian High Commission in Colombo in this regard. He said that the Sri Lankan mission in Canada, too, called for access to the detainees as this would help Sri Lankan intelligence services to track down remaining LTTE operatives based abroad.

An intelligence official said that the Canadians have been fully briefed of the presence of LTTE cadres on board the seized vessel. Sri Lanka has also alerted Interpol.

Government sources said that the Canadian government may find it difficult to allow Sri Lankan officials an opportunity to question suspects though some of them could be hardcore terrorists. They said that the Sri Lanka could not ignore the fact that most of the 78 persons now in Canadian custody had boarded the vessel in Indian waters.

Responding to The Sunday Island queries, they said that there was irrefutable evidence that the vessel had been to India in August/September several months after the final battle on the banks of the Nanthikadal lagoon killed Velupillai Prabhakaran.

India too should be involved in this investigation for several reasons, they said. The vessel could have carried LTTE cargo at the time it had entered Mumbai and then moved to a second port.

Sri Lanka had every right to seek access to persons held in Canada as there was absolutely no doubt of their involvement in terrorism, the sources said.

Foreign Ministry sources stressed the need for an international investigation to establish a possible link among the ship intercepted by the Canadians as well as about 370 Sri Lankans recently held by Indonesia and Australia.

Sri Lanka is yet to receive access to them despite evidence that LTTE cadres can be taking refuge among civilians.

On Tuesday, an Indonesian provincial governor stopped the Australian customs vessel Oceanic Viking from docking on Bintan island, near Singapore.


He said the island was not a `dumping ground` for refugees.

The Tamil asylum seekers were due to be taken to an Australian-funded detention centre on Bintan where other detainees have allegedly been beaten by guards.

The Tamils themselves have said they will not leave the ship voluntarily and have refused to co-operate with identity checks.

Mr Smith said they had no choice about where they claim asylum.

`They were picked up on the high seas. They were rescued on the high seas - it`s not their choice.`

The 78 Tamils are the latest in a flood of asylum seekers trying to reach Australia.

Indonesia`s navy also recently agreed to intercept another boat carrying about 250 Sri Lankans off the Java coast, who are currently refusing to leave their boat.

Human traffickers often use Indonesia or Malaysia as staging points before putting the migrants on boats for the hazardous voyage to Christmas Island, an Australian territory.

Australia receives just a fraction each year of what the UN estimates to be more than 15 million refugees globally, but the issue has split the country.

The opposition blames Prime Minister Kevin Rudd`s government for relaxing the country`s refugee laws.

Others criticise the government for not allowing the asylum seekers into Australia to have their cases examined.

Now you would think that if he had used his better judgment, or even listened to the many well-wishers aka SME’s (i.e. people with “know-how of international matters” that is), he would have postponed his visit to the US – at least until the “dust settled down”…but alas, no, he was determined to go ahead.

What most don’t care to keep in mind is that the LTTE whores have $1Billion in slush-funds (earlier meant for arms) that they are determined to use to “punish” SL and keep going for their “thamileelam” using corrupt western world-officials.

So, what have we here? We all know there is no grounds for “war crimes” here…but we can see that this can be a major embarrassment to SL. According to the story, GOSL is paying a hefty sum of money for SF’s legal representations to handle this new turn of event, but at the same time as he is a Green Card holder of the US, he can be considered a “US Resident” with all the complications that entails.

This was all very unnecessary.

What General Jayasooriya says is the obvious. Armed forces of SL are part of the elected government of SL. They serve the government elected by people,i.e., serving people. Irrespective which party is in power, they serve the elected government. That is the constitutional duty assigned to forces.

That cannot be correct. The daughters must be green card holders. Therefore it is unlikely that SF loosing green card would affect their status as U.S. green card holders.

Anyway the legal cost would surpass the cost of their education, plus really unnecessary risk. How difficult is it for SF earn few hundred grand? I would imagine their would be many countries willing to pay some one like him just for military advice.

I think we shouldn't worry too much about this for the moment as there are other forces in US might exert pressure to drop any serious charges against SF.If they ever do go against SF then there may be repercussions within that country that might lead to close scrutiny of the diaspora involvement in the campaign funds and lobbying of their politicians that might open a can of worms.Their media is wating for a such an oppotunity.

As far as I can see there is nothing substantial to prove any war crime.

Only thing significant witness accounts given by 3 doctors. But then they have already said they were forced to lie or LTTE. even if they change their story, it will go against reliability.

The others, i.e. shelling of hospitals, unless they have realtime satellite images proving shell originated from an army controlled area, there is no proof. also accidental fire does not constitute war crime. they must have evidence someone gave order to deliberately target civilians.

The graves recorded by ch4 are all LTTE graves with their number next to grave.

The only thing remaining is alleged killing of 8 "political branch" LTTE. where is the wittiness to prove anything? unless there is some audio or sat monitoring. Blake was involved in this. not sure if he has audio coverage over sat phone etc. even then its a petty crime when everything is put in context.

Whatever "evidence" Fonseka gives now needs not be made public immediately or ever.

However, should the Rajapaksas get jittery and decide on a Lasantha treatment for their new political rival, his "evidence" can be unwrapped and used against Gotha.

This may well be a simple move to guarantee security for Fonseka while he is electioneering in a country where beating a man to death on live TV is Friday evening entertainment.

One can call it Fonseka's "safety net". Now, don't we all know of experts that weave "international safety nets"?

Given the history between Blake and Gota, Gota will have trouble once he re-enter US but he may not want to. Given there is no extradition treaty Gota is safe even if anything was proven - agnain pretty remote.

I think even the Rajapaske supporter agrees Rajapaske bros are stealing. They may for example pocket 1/3 of the forex coming into the country as commissions and use 2/3 for "nation building". What they say is its all unavoidable. As we speak money from the treasury must be disappearing into Swiss accounts.

So what we have to be is happy they are at least giving us 2/3 of our own money. Not just ours but future generations who will be left paying back the loans.

But, there is a news item in SL - Daily Mirror as well as LankaeNews that General Fonseka is being "put under the microscope" by the US Homeland Security. Is the USHS Dept. trying to do a deal with Gen Fonseka? All of us know that Secy. Defense was in NYC to attend UN General Assembly sessions but there was no move on him then. I guess the Secy did a LRRP to the US so that Gen. Fonseka could go in and do wahtever he wanted to do. But this could be a trap and do you think we would see the last of Gen. Fonseka?

I have uneasy feeling in my gut :(

In the first place, with a War Crimes Report hanging in the air, I say that it is utter foolishness to go to the US.

This is one of many indications that GOSL - and I say rather brazenly - is now thinking with their balls. I mean isn't there anybody with an ounce of brain to tell the General that he cannot go? In my mind, both Secy. and the General went against requests made by Uncle Sam. So there is a threat that any of these people could be incarcerated if they step into the US.

But is someone, in this case, trading a horse for a donkey?

(November 02, Colombo, Sri Lanka Guardian) 18th of November 2009 - the hotheads in the political establishment will be celebrating six months of the victory over the LTTE. It is timely to analyse, why Sri Lanka that heavily invested on the defeat of the LTTE for its future progress is evidently progressing to fail.

The war that was conducted to defeat the evil LTTE was an immoral war. A country that is embedded in the just preaching of Lord Buddha failed to follow his guidance of truthfulness, love and non-violent conduct and sunk into irredeemable guilt that will haunt the country for decades.

Whatever the compulsion for an all out war, the forces should have mitigated themselves from prosecuting an unjust battle on the section of people, leaving aside the brutal LTTE. They should have been guided by the Buddhist Dharma, the rules of the Kurukshtra War of Mahabaratha and also by giving some respect for the modern international covenants Sri Lanka has subscribed to.

Brutality inflicted on the innocent civilians and surrendering enemies horrifies the conscience of the right thinking people who want Sri Lanka to be a self respecting nation giving credence to values. The Army Commander General Sarath Fonseka’s public comment ‘that the military had to overlook the traditional rules of war and even kill LTTE rebels who came to surrender carrying white flags during the war against the LTTE’ is disgusting and has to be the basis for any indictment against Sri Lanka.
The manner in which the LTTE leader Pirabakaran and family members were treated in the Dharmic society is incomprehensible. He should have put to trial and meted with the due process of the Law of the country or the International law.

In his address to the nation following the defeat of the LTTE, the President of Sri Lanka failed to hold him as a national reader. His speech was deeply sunk in the brutal bloody victory and failed to reach all the communities of Sri Lanka. He came out with his new analysis to submerge the deep wounds of the nation by classifying there are only two class of people can be there in Sri Lanka. One is those love the country and the other that hate. What a camouflage to bundle all the section that question the conduct of the government as enemies of the state. The haters include the opposition parties and the minorities in the country. He missed a golden opportunity to reach the cross section of the Sri Lankan’s to join force to arrest the underline crisis affecting the country for far loo long.

Within the past six months, he has failed to speak even about a political resolution to the conflict to educate the people for a broader approach to the crisis facing the country. Even his All Party Representative Committee (APRSL) proposal for a political resolution is held as a dandling carrot to mislead the international community.

Intoxicated with power, the government is on the attacking spree. Anyone questioning its conduct or revealing the hidden facts have come under terrifying attack by its officials. The government had gone beyond all limits to bludgeon anyone irrespective of their status to uphold its terror culture.

When the European Union put Sri Lanka on notice on the violation of GSP+ agreement well before it engaged in the full scale bloody war, it could have mitigated the annoyance of EU, if it had respected the international laws mentioned in the agreement in its final war. Whilst on notice, it went ahead with its brutal onslaught and response to the damning report is still on hold except for saying it would engage with the EU to redress the situation. What a arrogance after violating the very basics of an important agreement?

It is important to undertake a comparative analysis of the conduct of the Sri Lankan government with the conduct of the LTTE. Mahintha Chinthanaya of the President has been binned and methodology of the LTTE has become the guiding principles of governance in Sri Lanka.

v The LTTE thrived on the fear it imposed on its people by its violent and draconian conduct. This included arbitrary execution, punishment for not towing the line of the LTTE and many more random measures to uphold its control. Is there any difference in the state of affairs of the post war governance in Sri Lanka? Kidnapping, arbitrary killing, silencing the media, preventing the free functioning of the judiciary, marginalising the opposition etc are synonymous to the culture of the LTTE.

v Misusing the state funds and raising funds for political campaign work by threatening businessmen in the Armour St in Colombo is another comparable situation of the LTTE.

v Offering positions to pandangkarayas and marginalising the independent thinkers who make value judgements are the culture of the LTTE that government is practicing heavily.

v Then investing in covert operations in intelligence gathering and targeting individuals is a method pioneered by the LTTE under Pottu. The government of Sri Lanka has heavily invested in establishing sophisticated technological infrastructure to keep the population on tab which is semblance to the LTTE methodology.
Tamil aspiration was the cause of the LTTE and it carried out heinous crimes against the state and its people by espousing this cause and similarly the President of Sri Lanka too is foul playing by not implementing the constitution fully. Failure to implement the 17th amendment and abusing the implementation of the 13th amendment to the constitution incriminates the dishonesty of the government.

v The LTTE survived on the funding by the Tamil Diaspora. The so called legitimate government knowing financial potential of the Tamil diaspora too is on the spree to tout for money post defeat of the LTTE from the Diaspora. Issue of Central Bank bonds targeting the diaspora and inviting them to meet the President and the business leaders are methods followed by the government cream funds.

v The LTTE prevented the media to visit its controlled area and anything allowed were conducted tours. The government too learnt the benefits of preventing the media to the Tamil areas and stage managing it like the LTTE.

The minority issue is the cancer that is literally killing Sri Lanka since independence. It needs transparent and sincere political surgery to arrest the situation for the betterment of the nation.

Its said GR's name was in the list who attended UN meeting. So he was on official visit and under diplomatic immunity. And war crimes BS report was not released at that time. SF is on a private visit. I think any GC holder will be interviewed before getting citizenship. Only certain thing here is this is party time for LTTE di-ass-pora.

With respect to my comment vis a vis SF taking overall control, i have no problem if he cleaned up the political hypocrisy, corruption etc that exists in SL at the moment.

Just because you have elections (rigged in most cases) does not mean you have democracy.

Any government is only good to the extent of its accountability. Accountability demands responsibility and ensures citizen protection. Democracy without accountability is totalitarianism. Truth and justice are essentials of democracy
