Fonseka Arrested

Gen Fonseka was arrested a short while ago by a contingent of Army officers on charges of conspiring to kill President Rajapakse.

Once again this government has shown they will not bow down to personal threats or any other threats to stop their agenda.

(RTTNews) - General Sarath Fonseka, who lost to president Mahinda Rajapaksa in the presidential election, was arrested at his office in Colombo on Monday night, reports quoting witnesses said.

Gen Fonseka was meeting a number of politicians who had supported his candidacy, when he was taken into custody in a "very disgraceful manner," witnesses said.

Reports say the arrest was not unexpected, as government was mulling a court martial against Fonseka on charges of plotting to overthrow the administration.

Rajapaksa defeated his main challenger and former army commander General Sarath Fonseka in the elction held last month. Fonseka rejected the outcome alleging vote-rigging and lodged several objections with the electoral commission.

Within a week of his re-election, Rajapaksa dismissed 12 senior military officers for being a "threat to national security" and hatching "political conspiracy" during the presidential elections.

Except for the last count, all other counts are for things Fonseka did wen he was in active service. Also in the western outcries, they can court marshal a retired military man.

Well, what a long twist when you look back at it from May19 on.

Now SF is behind bars. It is a moment of justice in one view, a moment of highest security importance as far as the "war crying" threat is concerned. For all fair reasons, the Rat is in cage, yet I am not celebrating.

It is a very significant decision to take him into custody. The higher sensitivity of the situ shud be handled properly, and the charges shud be proven transparently. Failing these charges shud set him free, yet that is a big big concern. It does not necessarily redeem him from his traitorous acts, however it will glorify him in support base to an unwanted high. So I hope that GOSL has substantial evidence at hand to justify this very critical act.

If not, it is a very foolish action.

Nevertheless, one good reason to keep him behind bars is his constant threatening and blackmailing to witness at war tribunals. Not all war tribunals used to bring charges against MR and punish him, some are there [kangaroo version] to redeem pussycats in the western mindset and lobby to lift strict embargoes etc. Although prior is hardly possible, latter is happening even today, so SF could have been a hen laying golden eggs to those ppl.

Considering the level of authority he had, and the kind of hatred he's fueled with, and the much he blackmailed, and the level of fake and lying he is capable of doing, ...... whoa... he shud be behind bars.

But I do not find it a moment of triumph, joy and celebrations. A part of me, even with cancer is a part of mine, and I mourn its loss.

SF has been held without even access to a lawyer, he was not arrested with proper military protocol, as far as i heard...nobody knows where he's been kept at and under whose supervision.
his house was searched last night without a search warrant by the CID and you expect transparency????

SF was truly sidelined after the war victory and made CDS, a powerless title that only carried a title and no thing more
SF made a request to be the commander till the army celebrated it's 60th anniversary and that too was denied..
In my humble opinion it was the government that took aim at SF first
since SF too isn't the smartest tool around, instead of taking the challenge up tactfully...he lost the plot and lost the game...
this what happens to military folks when they try to get into politics, a game reserved only for certain type of people

I'm unable to confirm or differ here. It looks to me that the info available for me at public domain does not provide a substantial light on matters. Was it the govt who felt jealous with SF's rise and sidelined him? Or was it SF's ego which could never be satisfied.

In military, SF had not done a fair deal all over. He seem to be jealous with many good and performing ppl, whereas he was keeping do-nothing men in high seats. He was teh worst man to apply "horses-for-courses" although he finally turned a big one of the kind.
in simple term leaving the army in SF's hand, regardless teh threat of coup, would still have been non-productive. Just like the greatest cricket captain of our nation running Cricket SL.

Had this been [my imagination] the case, well, govtis compelled to save army from the "dictator" commander.

But again I do not know for certain whether it was the case. But there are some facts leading us that way.

Note that this article was written before arrest.

It is a real tricky spot that MOD has entered.

Tomorrow begin the protests. .

It will be mostly JVP. UNP is always half hearted. And RW has handed over the Fonseka Affairs to his deputy.

SF was a genuine threat with his possible acts against SLDF and MOD. But the arrest will only complicate the issues. And I think that it will not be easy to keep him behind bars for long.

Let's wait and see.

Rala I disagree, that is the democratic process.

Government say the man conspired to topple the government while in uniform.

In authoritarian governments he might just dissapear.

But in SL, he was allowed to run to the highest office, and later he was arrested according to the rules in a democracy.

Military rules are a part of a democratic rule of law, all democratic nations have militaries and there are special military rules to deal with military problems.

If we was not a military man , but was treated under military rule then that is undemocratic, but he was a militray man, his crimes were committed while he was a militray man, therefore military rule is the only way to prosecute him.

I dont think we actually have civil laws to deal with this kind of a situation. Might be a good thing for the next parliament to look into.

Sarath Fonseka was involved in politics from August 2009 to November 2009, while in the position of CDS. He was also accepting large donations from known fronts of the LTTE.

Presented with overwhelming evidence, state prosecutors had no option but to seek his arrest.

Officers had to carry out the order of the higher authorities. To manhandle a suspect into police vehicle is common practice, especially when the suspect violently resists arrest. Fonseka was kicking and punching the air like a pathetic child while being dragged along.

Those who are opposed to his arrest,

1.Was Fonseka right to participate in politics while in the trusted position of CDS?

2.Was Fonseka right to accept money from known fronts of the LTTE?

3.Was Fonseka right to enlist into his security team army personnel who had not been granted leave from official service or allocated to Fonseka's security apparatus (essentially, these people were deserters)?

Chaps, retired General Fonseka's arrest was made purely on his violations of military discipline. He was arrested under the provisions of Article 57 (1) of the Sri Lanka Army Act. No soldier in the SL Army can take part or engage in politics. He was Army Commander for four years and CDS for a short period. The person who holds the Army Commander or CDS post is a member of the National Security Council (NSC) of which the President as the Commander in Chief is the Chairman. The commanders of the Navy and the Air Force are also members of the NSC and important decisions on national security are made in the NSC. While holding such an important position retired General Fonseka had held talks with political parties violating the Army Act and military discipline. The connection with the Army does not cease immediately after anyone retires from the Army. Under the Army Law a person who had committed an offense while in service could be punished during the first six months from his date of retirement. General Fonseka retired only in November 2009 and is still punishable under that law. So my dear fellows, this is a matter of military discipline and nothing for anybody to worry about. Like my Pater used to say 'Move on sonny, nothing to see here'.

I am against war crimes or any other crimes. I am agianst if our foreign thugs try to get Sri Lanka in to war path again by this or that means.

Since there were no big outcry against LTTE suicide killing and LTTE taking Tamil Civilians as human shield (yes there was a whisper of pretence) this outcry again the great hallucinator's (Remember the person who makes war crimes accusations says that he is the President of Sri Lanka) made up war crime should have another motive. This motive is to put Sri Lanka in war path again.

Now the war is over. We do not need to go to war over the war.During the war I insisted that civilian safety is paramount but the war cannot be stopped since civilians are getting killed. We just needed to take extreme care to avoid unnecessary deaths.

I am convinced that our true heros sacrificed their limbs and lives just to save civilian lives. I do not see that has been mentioned in the Western media.

The big thing most of you fail to see is that, although it is not so easy to imprison SL's leaders, the unnecessary propa that this provides easily bails out tigers from many crimes. It is not for him to dictate who is to arrest him; that is within the purview of the Government law enforcement authorities, military or civil.

He should know to comply immediately without resisting, if he wanted to be treated with respect. In the US, it is normal for authorities to immediately handcuff the person arrested. They routinely take all measures necessary, including bodily carrying the person, and restraining him with force, if necesary, during an arrest. It does not matter who that person is, once a legal order to arrest has been issued .. the subject must comply.

It is also curious that the former head of the Armed Forces had so little knowledge of Military Law that he was unaware that the Military System of Justice had Jurisdiction over him, until six months has elapsed after leaving the Service.

That is ENTIRELY consistent with his INATTENTION to REGISTERING TO VOTE in the Presidential election. What do we have here .. an illiterate of monumental proportion?

He also formed a paramilitary group composed of Army deserters, knowing full well that harboring deserters is a crime in Sri Lanka. He should have known better .. after all he was Army Chief and the Chief of the Defence Forces. These transgressions do not begin to define the full scope of his violation of Civil and Military Laws.

This is a man who blinded by unbounded personal ambition, betrayed his brothers-in-arms, allied himself with the stooges of his former enemies (TNA), and former terrorists who inflicted violence upon the people of Sri Lanka on two occasions (JVP), and a man who was ready to partition and deliver Sri Lanka, bound hand-and-foot, to its enemies (RW, UNP).

Please do not abandon your senses to emotion and embrace this foolish, unprincipled man who is now REAPING the consequences of the seeds of unbounded ambition and hate that he himself has SOWN!

I believe Fonseka is to face a Military Tribunal.
This would enable the government to minimise media scrutiny, especially by the international media. It will also enable his prosecutors to substitute theories and suppositions, canards and charges in place of solid proof.

It is hard to believe that the politicised military of today will give a verdict other than the one expected by the political leadership.
Sri Lanka's military justice system is subject to review by the Supreme Court.
Again,the politicised Supreme Court is highly unlikely to go against the leadership has we have recently witnessed.

Rajapakse Inc is plundering Sri Lanka. Even Supreme Court judgments cannot rein in the Gang of Four when it come to crooked deals to line their pockets. His network of appointments based on nepotism alone would outdo any other President; couple that with his disregard for the rule of law and weakness for Mervyn Silva PBJayasundra and White Vans (for gentle extra –judicial “persuasion”) to silence his opponents.

The man was arrested for engaging in politics while in uniform, accepting funds from known LTTE fronts and harbouring army deserters. All three are crimes punishable by stiff prison terms. He was manhandled because he resisted arrest.

In a country where there is rule of law, anyone who engages in same activities as Fonseka would have been meted the very same treatment.

So, do these protesters want Fonseka released, without trial and without punishment, just because they support him? If so, what about law of the land? Do they want to build a culture of impunity?

Question has risen on the ethics of arresting and prosecuting Ex. General Sarath Fonseka (SF). There are some who thinks we should let him go on the basis of the service he has done to the country. There are others who think he deserves the treatment he got based on treason he has committed or he is going to commit. The biggest question is, if we are prosecuting SF, what about others who have already committed wrong doings in Sri Lanka? We all know Sri Lanka is a very corrupt nation. Is this a case of prosecuting a criminal or taking a revenging on someone who has potential political power in Sri Lanka in the future?
The answer to this question varies since many different interest groups have their own opinion. Based on what is happening in Sri Lanka, this is a prosecution by choice due to the fear of SF. That fear is both political and what he knows as far as crime against humanity is concerned.
Sri Lanka has created number or warlords due to the military culture we had to develop to get rid of LTTE. This is not a battle for the national interest. This is the battle among warlords. Therefore, when one warlord tries to take down another, what should the general public do?
I'd say, we need to protect and preserve warlord culture. This is the only way we can prevent creation of a super warlord. Therefore we should all campaign for SF and ask the government to let him go. Cut a deal with SF not to testify against UN for his freedom and civil rights. At the end, we can offer him the multi million rupee SUV he deserves and did not get it with the mansion to park it.
Let the liberation of General Sarath Foneska begin.

i maybe wrong but i feel that in MR's absence...GR took control of the scene and got SF in! and the rest is history in the making.

GR and SF are equal IMHO in terms of getting pissed off for the slightest thing, over reacting and giving their opponents a lead in the long run.
I know lots of people are thrilled over the way GR handles media, especially the foreign media but IMO, him getting pissed off and jabbering like an idiot doesn't help anybody.
I've seen a few interviews where foreign media people were interviewing Mahinda Samarasinghe and the reporters were trying there best to tick him off and make a show out of it...
But Mahinda S was a step ahead. he never looses his composure, sticks to the point and deliver a strong message... Politely, smartly but still get the job done.
Personally i prefer that kind of approach to the one Gota and even SF seems to take

Yes, the gov. has acted rashly on many things. They have the election in the bag, but still they are using excessive force to crush the opposition, this can very well backfire.

The government's objective should now be to increase the majority in the parliament, with the view of having a stable and a small cabinet to facilitate development.

The people who voted for SF won't change and vote for the govt. just because he was arrested. Seeing the suppression, the jaded Tamil people who didn't vote for SF in large numbers may very well decide that they should support the UNP instead of the Gov. This will not only not help the govt. but also help the LTTE proxies TNA to become strong again.

As for the General, I can't just brush him off as a traitor. I need to see way more evidence than the hearsay that is floating around. I base my perspective on the way SF conducted himself throughout (the strait talking nature, and getting the best out of his men) his military career.

But his major objective was defeating the MR clan, even by using the support of really unsavory characters like the TNA and some of the UNP, and that was just dangerous.

Gota is one of my favorite personalities. It is so sad that SF and Gota are now on two different sides.

But still he's not proven guilty so he shouldn't be treated badly.

Nope, read my blog with patience. I its not only the top officials in the army, the whole country. Government by arresting SF, saved the whole county from repercussions of international investigations, remember its not only the top officials, the whole army will suffer. Already after SF's first comment on Gota, our army has ceased to get invitations from foreign governments on training etc.
If SF was to go on doing that kind of irresponsible talking, Tamil,-Sinhalese bonding will suffer, country could be threatened with many sanctions, international aids could stop, investors could stop, the repercussions are many.
Government by acting quicly even disregarding their own political advantage has saved the country from this disaster.

I don not beleive we have dirty laundary, where do I say that in my blog?

I base my view on other evidence some of which I discuss in my blog. The west are angry that MR didnt listen to them and crushed LTTE, they are looking for an excuse to take their revange.

They will use any falsified crap to attack MR regime. This is evident by how they used

1)An annonymouse channel4 vedio to pressure MR regiem, there was no reliable evidence on when it was produced, how it was produced, where, or even who shot the vedio, a complete unknown. They hyped up that kind of unreliable evidence to attack us.
2)Then even before there was this channel 4 vedio, the UNHRC wanted an investigation. There was a vote and the vote was divided on civilication lines, all the western countires voted for an investigation while all the non western countries, voted against, again prooving west is looking for revange but not justice.
3)The other evidence of west falsely accusing us, is Hillary Clintons talk at the UN, where she innitially accused SL for using rape as a wepon, with no iota of evidence, and then seeing she had no evidence she retracted the story.

These and otherevidence show that west is looking to punish us for not listning to them, if they can hype up this kind of annonymose , unverified, incogitable information, its clear they would jump to what would come out of SF's mouth even if it is false.

In they assured they would do it by asking for explanations for "Gota ordered- Sunday leader story even after SF himself retracted it.

This is why arresting SF and nullifying is fale claims are good in the long term.

Joke of the century, We had Ranil W, who bend over backwards for the west, he signed argeements with LTTE with Norway and other western agents beside him, he did everythig according to Norway instructions, he visited US several times in his short regim and met bush (in fact even Bush said that they are meeting more often than RW and Chandrika met).

After doing all what west has asked for, they didnt lift a finger against LTTE to help Ranil W, when LTTE was vilolating the ceasfire agreemnet and causing mayhem.

Give me an iota of evidence to show west trying to force LTTE to respect the ceasefire agreemnet and bring lasting peace through negotiations. All they did was just isseu statemnets that are of no value.

In fact this ineffectiveness of the ceasfire agreemnet caused the downfall of the RW regim. If western counteried wouldnt do anything to help their darling RW, they wouldnt even wink to help MR.


If you think when we prosecute our war heroes , we will be clear of all sin, you are living in utopia. They will not stop their, that will allow them to interfere more and more in our countries internal problems, and we will spiral into chaos.
